This statute prohibits any electrical corporation from constructing a generating plant "without having first obtained from the commission a certificate that the present or future public convenience and necessity require or will require such construction." The Company also sought expedited approval and authority to rate base the cost of the plant. On October 22, 2003, the Commission convened a prehearing conference. Intervention was granted to the Industrial Customers of Idaho Power and to the Idaho Irrigation Pumpers Association. In Order No. 29370 issued October 30, 2003, the Commission issued a Notice of Modified Procedure soliciting public comment on the Company's Application. In response to this Notice, the Commission Staff, the Advocates for the West, and one customer submitted timely comments. Idaho Power and Mountain View Power each submitted reply comments. After reviewing the Application, the comments and the replies, we issue this Order granting the requested Certificate as set out in greater detail below. THE APPLICATION A. Future Necessity Idaho Power maintains that its decision to construct a new generating plant results from its 2002 Integrated Resource Plan (IRP). In general, the IRP process evaluates the Company's future loads and resources and the various options for meeting projected loads. The combination of options for meeting load include: (1) purchase of power -from the regional wholesale market; (2) acquire additional generating resources; (3) implement pricing options to dampen peak loads; and/or (4) implement Demand Side Management (DSM) or conservation ORDER NO. 29410 1 price factors included: on-line start date of June 1, 2005; dispatchability; performance guarantee; experience of the bidder; delivery assurances; maintenance scheduling; etc. For bids that used natural gas as fuel, gas prices were assumed to be $4.52 per MMBtu in 2005 and were escalated throughout the life of the project based on price forecasts available to the Company. Id. at 5. The same gas price was utilized for all natural gas-fired project proposals. Eventually the bids were narrowed to two finalists: the Mountain View Power project and the Company's self-build project. The Company's RFP evaluation team recommended and the Company's Board of Directors selected Mountain View Power as the successful bidder to build a new generating plant. C. The Proposed Plant The proposed Bennett Mountain plant will be a nominal 162 MW natural gas-fired, simple-cycle power plant to be located on about 10 acres within the Mountain View Industrial Park in Mountain Home. The Industrial Park is located on the north side of I-84 and west of State Highway 20. The plant will utilize a single Siemens Westinghouse Model 501F combustion turbine. The plant site is also large enough to accommodate an additional future generating unit. The Bennett Mountain plant could be modified to operate as a combined-cycle plant at some point in the future. The Bennett Mountain site is approximately four miles southeast of Idaho Power's Danskin generating plant. Application at 3. Mountain View has contracted with Siemens Westinghouse to furnish all of the labor, equipment and materials, and to perform all of the engineering and construction of the proposed project. Upon completion of construction and the necessary performance tests,title to the project will transfer from Mountain View to Idaho Power. The plant is currently scheduled to be available to meet peak loads in the summer of 2005. If approved, the plant will be operated to meet peak-hour loads in the months of June, July, August,November and December. Williams Northwest Pipeline will supply the natural gas necessary to fuel the plant. The pipeline currently passes less than one mile from the plant. For Bennett Mountain to access the pipeline, an interconnecting pipeline of approximately 3,400 feet will need to be constructed. Mountain View's bid included an 8-inch diameter pipeline. Idaho Power and Mountain View are currently investigating increasing the pipeline size from 8-inch to 12 or 16-inch in diameter. A 16-inch diameter line would be sufficient to fuel two 162 MW units and also reduce the pressure drop between Northwest Pipeline and the Bennett Mountain plant. ORDER NO. 29410 3 ISSUES AND FINDINGS The Commission received comments from a Boise customer, the Advocates for the West, and the Staff. Idaho Power and Mountain View filed individual reply comments that addressed the Advocates and Staff comments. The one public commenter questioned the wisdom of building the natural gas plant when natural gas prices may go up. He also alleged that the Company has shown poor management foresight in the past. He suggested that ratepayers should not be required to pay for the plant until it is constructed and operational. A. Stay and Consolidation In its Application, Idaho Power requested that the Commission expeditiously process this.case. More specifically, the Company requested that the Commission issue its Order in this matter on or before December 31, 2003. Application at 6. The Company's Agreement with Mountain View contains a construction schedule that may require modification if the Commission has not made its decision prior to December 31. In addition, the Company stated that the prices contained in the Agreement are time sensitive.and the Commission's failure to issue a timely Order may"potentially [affect] the pricing for the Project." Id. The Advocates for the West questioned the reasonableness of processing this case on an expedited schedule. If the project is approved, they claimed it will significantly increase rate base separate and apart from the Company's current rate case (Case No. IPC-E-03-13). They also argued that this case be stayed until Idaho Power files its peak-load management study and implements DSM/peak-load programs. Comments at 3. Consequently, the Advocates recommended that the two cases be consolidated and this case stayed. "A five month delay under these unique circumstances is entirely reasonable." Id. at 1. Idaho Power opposed the Advocates' request for a stay and consolidation for two reasons. First, the Company asserted that the equipment prices and bid price from Seimens and Mountain View are only valid until December 31, 2003. Idaho Power noted that the Commission Staff observed that a favorable turbine price was obtained because of the surplus of generators in the market. Second, combining or consolidating this case with the general rate case would add a new and major issue to the rate case. Introduction of this significant issue at this stage of the rate case would be unreasonable. Idaho Power Reply at 2. Commission findings: We deny the request that this case be stayed and consolidated with the Company's general rate case for several reasons. First, the primary focus ORDER NO. 29410 5 3. Staff. In its comments, the Staff indicated that it believed adoption of the 70th percentile water condition is appropriate. Staff Comments at 4. It asserted that Idaho Power's adoption of a more conservative planning criteria was prudent. Using this new criteria, Staff noted the Company had prepared new load forecasts analyzing future loads and resources. The Staff asserted these forecasts show that Idaho Power will be deficient during both the summer peak (June-July) and the winter peak (November-December) in 2004 through 20.11. Staff Comments at 5, Attch 1-3. Even with the additions of the Danskin and Bennett Mountain plants and the loss of the Astaris load, "the Company expects to have significant summer and winter [resource] deficits." Id. Compounding the problem of the load deficiencies is the issue of transmission constraints. The Staff observed that Idaho Power will experience summer transmission constraints beginning in 2007 under normal water and load conditions. Staff Attch. 4-6. Transmission constraints were in part the reason why Idaho Power eliminated two of the .11 RFP bids. Commission Findings: The Advocates argued that the Company's 2002 IRP does not give any reasonable basis to support construction of the Bennett Mountain plant. However, upon closer scrutiny, their argument is not so much with the forecast of peak-resource deficiencies, but with Idaho Power's solution for addressing the peak loads beginning in 2005. They fault the Company for relying on generating resources — rather than non-generating alternatives—to meet these deficiencies. . Based upon this record, we find that the Company has adequately demonstrated that there is a need for future power to meet the projected peak loads beginning in 2005. We further find that no commenter has disputed that the Company will experience peak load deficiency in the future. Consequently, we find that Idaho Power will experience peak-load deficiencies in the summer and winter beginning in 2005. C. Meeting the Public Need 1. Idaho Power. To address the peak-load deficiencies, Idaho Power proposed to acquire additional generating resources through the 2003 RFP process. The Company relied upon its 2002 IRP which included an assumption that the Company would purchase up to 250 MW of capacity from the [now abandoned] Garnet plant. This capacity was to be acquired in the summer of 2005. In response to its February 2003 RFP seeking bids to supply between 85 and ORDER NO. 29410 7 continuing need for additional resources similar to Bennett Mountain. Id. at 30. In addition to the previously authorized air conditioning pilot program, Staff noted other load management programs that warrant the Company's serious attention include water heating, energy exchanging, and load shifting programs for irrigation customers. Staff was critical of the Company's failure to embrace load shifting and alternative rate designs to reduce peak-load demands. Staff characterized the Company's evaluation of alternatives as only looking "at the immediate costs and revenues associated with the programs, and failing to consider long-term impacts." Id. at 32-33. In Staff s view, a program that reduces critical peak hourly demand "has great value, especially if peak hourly demand is what dictates Idaho Power's need for new generation. The value of reducing critical peak hour demand equals the value of eliminating or deferring the need for new generation." Id. at 33. 3. The Advocates. The Advocates did not argue that Bennett Mountain is not a cost effective supply resource. Instead, they generally asserted Idaho Power has not adequately explored other options to the proposed power plant. In particular, they recommended that peak- load management programs should have been seriously examined. Comments at 2. Although the Company has reportedly been studying peak-load management options for over a year, the study is not complete. The Advocates suggested that all cost-effective, peak-load management or load reduction resources should be fully explored before the Commission considers authorizing the Bennett Mountain proposal. Consequently, the Advocates requested that the Commission stay this case pending release of Idaho Power's peak-load management study and implementation of cost-effective programs for peak management. Id. The Advocates also fault the Company for not requesting bids for other kinds of generation resources, including wind power. The Advocates maintained that wind power costs "about 03 cents/kWh (or about 4 to 4.5 cents without the federal production tax credit)" and is comparable to Bennett Mountain's first year fuel costs of 5.7 cents/kWh (based upon $4.52/MMBtu). The Advocates -asserted that wind is a "cost-competitive resource alongside natural gas even for targeting peak load needs." Id. at 3. 4. Idaho Power Reply. In response to the Advocates' criticism of the RFP, Idaho Power stated that the RFP was open to all generating technologies, including wind. Idaho Power also asserted that its 2004 IRP planning process will address the benefits of DSM and renewables, peak-load management programs, and gas price volatility. Idaho Power suggested ORDER NO. 29410 9 $44.6 million and the Commitment Estimate for the project is $54 million. Application at 7. The difference between the base price and the Commitment Estimate includes costs such as: sales taxes; AFUDC on progress payments made to Mountain View during construction; the cost of Idaho Power oversight; the cost of capitalized start-up fuel; construction change orders; and other unforeseen events. The Commitment Estimate also does not include legally required equipment changes (e.g., requirements to comply with new air quality laws) and for escalations in assumed forecasts such as inflation. Idaho Power stated it will absorb the extra cost of the project that exceeds the Commitment Estimate. The Company will include in its Idaho rate base only the amount of actual costs incurred 0 to the Commitment Estimate. The Commitment Estimate does not include the costs of connecting the plant to the Company's transmission system. Idaho Power is currently evaluating how the plant ought to be connected with the Company's existing transmission system. Depending on the outcome of these studies, one of two alternatives will be implemented to upgrade the transmission line between Mountain Home and Boise. The more costly upgrade plan will cost approximately $11.6 million while the least costly will be about $5.5 million. 2. Staff. Staff stated that the Commitment Estimate for the project is reasonable. While the Staff believed that the Commitment Estimate is reasonable, the Staff recommended that the authorized capital costs for the Bennett Mountain project be limited at this time to $44.6 million. Staff suggested that the costs above the $44.6 million contract—up to the Commitment Estimate of $54 mullion—should be subject to scrutiny iri a future proceeding once the plant becomes operational. The Staff agreed with the Company that the actual cost of the contract above Mountain View's bid cannot be quantified with precision at this time. Application at 4; Staff Comments at 18. Consequently, Staff recommended that these expected costs (up to a maximum of$9.4 million)be subject to audit by the Commission Staff. Staff also recommended that Idaho Power should be required to provide the Commission with periodic percentage completion and cost expenditure reports, and that rate base consideration of the costs above the base price should be withheld until after the project is constructed and the audit completed. Commission Findings: We find that in the ordinary course of events, Idaho Power may anticipate ratebasing $44.6 million, the amount of the Mountain View bid. The reasonable and prudent actual costs incurred above that figure cannot be quantified with precision at this ORDER NO. 29410 11 that one solution would be for Idaho Power to internalize any cost of hedging and offer a "long- term fixed-price electricity contract, much like renewable energy typically provides." Id. at 5. 3. Staff. Staff recommended recovery of fuel costs in the annual PCA. The Staff indicated that Idaho Power has not yet negotiated or entered into any agreements for the purchase of natural gas for the Bennett Mountain plant: However, in general, the approach Idaho Power intends to pursue includes: (1) resourcing fuel from several geographic areas; (2) staggering the terms of gas supply agreements if multiple agreements are executed; (3) incorporating a mixture of forward and spot purchases; and (4) utilizing a combination of firm and non-firm or released transport capacity. Idaho Power has already purchased firm fuel transport rights that can be used for both Danskin and Bennett Mountain projects. Significant transport rights to serve the Bennett Mountain plant are available without an expansion of the Williams pipeline. Staff also recognized that Idaho Power claims it employs a hedging strategy when purchasing natural gas for the Danskin plant. The Company intends to develop its fuel procurement strategy for both natural gas and transport capacity as well as .expand its hedging guidelines and risk management strategies to cover both Danskin and Bennett Mountain. Staff Comments at 14. Management of the Company's fuel supply will either be done by its own personnel or in conjunction with a third party. Staff recommended that hedging strategies be discussed at the next Risk Management Customer Advisory Group meeting. Commission Findings: While we recognize that gas prices significantly contribute to the levelized cost of energy from a new natural gas generating plant,we find it is reasonable to allow the Company to recover its fuel cost through the PCA mechanism. In Order No. 28799 we allowed recovery of fuel costs for the Danskin plant in the Company's annual PCA rates. We find that similar treatment here is reasonable. Although we decline to lower the fuel recovery below 90%, we expect the Company to utilize hedging guidelines and risk management strategy to mitigate the volatility of fuel prices for both Bennett Mountain and Danskin. We shall review the Company's hedging and risk management strategy when it seeks recovery of fuel costs in the PCA proceeding. F. Miscellaneous Issues 1. AFUDC. Staff observed that recovery of AFUDC is typically allowed only in instances where the utility itself is constructing new generating plant. In this case, however, ORDER NO. 29410 13 Mountain View also responded to the Staffs TIF comments. Mountain View asserted the Staff was in error in assuming that TIF financing remains a component of Mountain View's bid. Mountain View explained that the TIF component was contained in its original bid but this bid was subsequently revised. Mountain View Reply at 1. Mountain View indicated that it currently "carries 100% of the risk that TIF funds will not be available, in some amount less than MVP's revised TIF estimate." Id. at 2. As an alternative,Mountain View supported Staff s recommendation"provided that it is revised to address both reward and risk concerning TIF." Id. (emphasis original). If TIF funding is available for project infrastructure, Mountain View will share that bonus with the- Company as a.reduction to the contract price. Mountain View offered the Staff full TIF audit rights. Commission Findings: Given Idaho Power's statement that it and Mountain View have deleted Section 2.3.b(iii) of their Agreement, there is no need to address this issue. Deleting this portion of the Agreement eliminates any risk to ratepayers that the base price of the project could increase as a result of TIF fmancing. 3. Sales Tax. The Staff assumed that the gas turbine was to be purchased from the secondary market. Consequently, Staff suggested that sales tax may not be assessed on the cost of the turbine. Staff Comments at 26-27. Staff did not object that sales taxes be included in the Company's Commitment Estimate. Mountain View asserted in its Reply that the Staff erred in assuming the generator was to be purchased in the secondary market. - Commission Findings: The Company and Staff generally agree that sales taxes on the project will be recoverable and are included' in the Commitment Estimate. The misunderstanding concerns whether the turbine was acquired in the secondary market and, thus, possibly exempt from sales tax. As Mountain View explained, the turbine "is a brand new unit" and may be subject to sales tax. We find no dispute here. CONCLUSIONS OF LAW Idaho Power is an electric corporation subject to the regulatory jurisdiction of the Commission. The Commission has jurisdiction over this matter pursuant to Idaho Code §§ 61- 526 and 61-528. We find that the future public convenience and necessity requires the construction of the Bennett Mountain project to be located in Mountain Home, Idaho. The purpose of the proposed line was to provide backup service for the existing Wood River/Ketchum 138 kV transmission line which runs along the east end of the Wood River Valley. Based on an extensive reassessment of the feasibility and need for an additional 138 kV Wood River/Ketchum transmission line, the Company concludes that the line is not needed. The reassessment study performed by the Company includes a review of both the capacity requirements and the reliability requirements for Idaho Power's electric service to the Ketchum/Sun Valley area. Regarding capacity, the Company contends that based on current projections the existing 138 kV Wood River/Ketchum transmission line has sufficient capacity to meet the area's electric needs for the foreseeable future. The Company states that it will continue to monitor area load growth and make modifications when necessary. Regarding reliability, Idaho Power reports that it has thoroughly reviewed the reliability of its electric service to the Ketchum/Sun Valley area. The Wood River/Ketchum 138 kV transmission line, the Company contends, has had an excellent record of reliability since its construction in 1962 (only two unplanned outages in the past 14 years, for a total duration of only three minutes). Nonetheless, the Company states that it has taken a number of steps to further improve the reliability of the line including the following: structural assessment. electrical ORDER NO. 26107 - 1 - assessment, fire protection, avalanche study, conductor assessment, maintenance plan and emergency action plan. The Company reports that it has also recently completed an extensive public participation process regarding the possible construction of a second 138 kV transmission line from the Wood River substation to the Ketchum substation. The Company received input from public officials and citizens of the area. The overwhelming response from the parties commenting, the Company states, was that, despite the unavoidable risk of an outage to the existing transmission line, the proposed transmission line should not be built. The reasons for public opposition to the line include the difficulty of finding an acceptable route for the transmission line, aesthetic impacts, health and safety concerns, and the excessive cost of burying part or all of the line. Idaho Power reports that it has been unsuccessful in obtaining the necessary rights-of-way for the additional 138 kV Wood River/Ketchum transmission line. Based on the Company's need analysis and public comments, Idaho Power concludes that construction of an additional 138 kV transmission line from the Wood River substation to the Ketchum substation is not feasible at this time. The Company reports that it will continue to monitor the condition of the existing Wood River/Ketchum transmission line, the increase in load growth in the Ketchum/Sun Valley area, and the feasibility of obtaining the required right- of-way and public permits for a second 138 kV line. Because the project, the Company concludes, is neither needed nor feasible, the Company requests authority to amend its Certificate of Public Convenience and Necessity No. 272 by removing the language authorizing the construction by Idaho Power of a second Wood River/Ketchum 138 kV transmission line. Reference Case No. U-1006-89, Order No. 11315. The Commission issued Notices of Application and Modified Procedure in Case No. IPC-E-95-6 on June 22, 1995. The deadline for filing written comments or protests was July 14, 1995. Commission Staff was the only party to file comments. Staff recommends approval of the Company's Application. COMMISSION FINDINGS The Commission has reviewed the Application of Idaho Power Company and the filings of record in Case No. IPC-E-95-6. We have also reviewed our prior Order No. 11315 in ORDER NO. 26107 - 2 - ' Case No. U-1006-89 which granted Idaho Power authorization to construct a second 138 kV transmission line from the Wood River substation to the Ketchum substation. The Commission continues to find it reasonable and appropriate to process the Company's Application under Modified Procedure, i.e., by written submission rather than by hearing. Reference Commission Rules of Procedure, IDAPA 31.01.01.204. Based on our review of the record, the Commission finds it reasonable to conclude that the present public convenience and necessity no longer requires construction of a second 138 kV transmission line to provide adequate, efficient,just and reasonable service to the Ketchum/Sun Valley area. We therefore find it reasonable to cancel the Company's Certificate No. 272 authorization for the construction of a second Wood River/Ketchum 138 kV transmission line. In reviewing the remaining language of Certificate No. 272, the Commission notes that it does not depict prior modifications to Certificate No 272. Apart from authorization to construct a second 138 kV line, Certificate No. 272 also authorized construction of a 50 MW combustion turbine generator, i.e., the Hailey turbine. The Hailey turbine, after it was built and installed, was with Commission authorization subsequently sold. Reference Order No. 24676, Case No. IPC-E-92-9 (January 27, 1993). Although the Commission's Order No. 24676 cancelled certificate authorization for the Hailey turbine, an amended certificate was never issued. The present elimination of authorization for a second 138 kV line effectively removes all authorization previously given by Certificate No. 272. The Commission therefore finds it administratively appropriate to cancel Certificate No. 272 rather than to amend it as requested by the Company. CONCLUSIONS OF LAW The Commission has jurisdiction in this matter and over Idaho Power Company, an electric utility, pursuant to the authority and power granted the Commission under Title 61 of the Idaho Code and pursuant to the Commission's Rules of Procedure, IDAPA 31.01.01000 et seq. ORDER In consideration of the foregoing and as more particularly described above IT IS HEREBY ORDERED that Idaho Power Company's authority to construct a second Wood River/Ketchum 138 kV transmission line as previously authorized by the Commission in Case ORDER NO. 26107 - 3 No. U-1006-89, Order No. 11315 and Certificate of Public Convenience and Necessity- No. 272 is cancelled. APPLICATION According to the Application,-the Hailey Turbine is a General Electric Frame 7, model MS 7001 B (C), dual fuel turbine electric generator with a rating of 49,580 kW. The equipment proposed for sale includes the fuel handling equipment, two auxiliary transformers, the carbon dioxide fire control unit, the waste sump, the 4.16 kV auto transfer unit for starting, all special tools, spare parts and manuals as well as the turbine generator unit itself. The Company notes that on February 6, 1974, in Case No. U-1006-89, by Order No. 11315, Idaho Power was granted Certificate of Public Convenience and Necessity No. 272 for the construction and installation of the Hailey Turbine. The original purpose for the turbine was to provide increased reliability to the Hailey-Ketchum-Sun Valley area. The Application states that Idaho Power has completed construction of a second 138 KV transmission line into the Wood River Valley, rendering the Hailey Turbine redundant. Idaho Power contends that problems involving the availability of fuel and the local environmental impact that the Hailey turbine has had at its present site have forced the Company to omit the turbine as a resource for planning purposes from Idaho Power's current studies for new resource planning or avoided cost determination. Because of this, the Company contends, the sale of the Hailey Turbine will not affect Idaho Power's "Appendix A" loads ORDER NO. 24676 - 1 - copy of the Purchase and Sale Agreement executed by Idaho Power and Longview Fibre. Under the Agreement, Longview Fibre agrees to pay Idaho Power $8 million for the turbine. The net book value of the turbine as of December 31, 1992 was $1,473,000. In addition, Longview Fibre is responsible for the costs of relocating the turbine to its pulp and paper mill in Longview, Washington. Idaho Power will incur as of yet unknown costs in restoring the former site of the turbine. Idaho Power proposes to file for an accounting Order with the Commission no later than September 30, 1993 to determine the appropriate ratemaking and accounting treatment to be given the sale. CO ON STAFF The Commission Staff supports Idaho Power's Application. Staff agrees with the Company that, because of the recently constructed transmission line serving the Wood River Valley, the Hailey Turbine has been rendered superfluous. Staff analyzed the potential use of the Hailey Turbine as a peaking resource. For purposes of its analysis, Staff accepted Idaho Power's relocation, refurbishment and interconnect cost estimate of $10 million as reasonable. Based upon a rated capacity of 50,000 kilowatts, this computes to an approximate $200 per kilowatt cost for the Hailey Turbine. To this estimate, Staff added the Company's estimated lost sale opportunity cost of $131 per kilowatt. This is calculated as follows: $8,000,000 sale price - $1,473,000 net book value at 12/31/92 = $6,527,000 _ 50,000 kilowatt rated capacity = $131 per kilowatt. Combining the $202 per kilowatt cost of refurbishing the Hailey Turbine with the $131 per kilowatt lost sale opportunity cost yields a unit capacity cost of keeping the turbine of $333 per kilowatt. Assuming a 1993 delivered gas cost of $2.10 per MMbtu escalating at 4.5% per year, Staff found that the unit cost of this resource is well above the Company's applicable avoided cost rate even assuming a 70% capacity factor. In reality, the most optimistic capacity factor that could be reasonably expected for this unit is 35%, with 25% being much more probable. Because lower capacity factors mean higher fixed cost allocations, Staff concurs with Idaho Power that the Hailey Turbine is not economical at this time. ORDER NO. 24676 - 3 - portion thereof, shall sell, assign or transfer, directly or indirectly, in any manner whatsoever, any such property or interest therein, or the operation, management or control thereof, or any certificate of convenience and necessityy or franchise covering the same, except when authorized to do so by order of the public utilities commission of the state of Idaho. Such authorization and order shall be issued only following public notice and hearing, upon verified application of the parties setting forth such facts as the commission shall prescribe or require, and if the commission shall find that the public interest will not be adversely affected, that the cost of and rates for supplying service will not be increased by reason of such transaction, and that the applicant for such acquisition or transfer has the bona fide intent and financial ability to operate and maintain said property in the public service; provided, that no such order or authorization shall be issued or granted to any applicant or party coming within the prohibitions set forth in this act. The commission shall have power to issue said authorization and order as prayed for, or to refuse to issue the same, or to issue such authorization and order with respect only to a part of the property involved, and may attach to its authorization and order such terms and conditions as in its judgment the public convenience and necessity may require. Will the public interest be advemly affected by the sale of the Hailer turbine? As we have previously held, the Hailey Turbine is no longer of use to Idaho Power or its ratepayers. The longer Idaho Power retains ownership of the turbine in its present configuration, the more obsolete and, therefore, the less valuable it becomes. We find, therefore, that not only will the public interest not be adversely affected by the sale of the turbine, the Company's ratepayers will actually realize a financial gain by the sale of an asset that is non-functional and almost fully depreciated. Will the cost ofand rates for suppbd" service be increased by the sale of the Haney turbine? As held above, Idaho Power's ratepayers will actually realize a financial benefit from the sale of the Hailey Turbine. Therefore, we find that rates will not be increased as a result of the proposed sale. The Applicant requests authority to construct a new powerhouse on the Snake River in Power County, Idaho, approxi- mately 300 feet downstream of the American Falls Replacement Dam being constructed by the American Falls Reservoir District as the Constructing Agency pursuant to Federal law. The new powerhouse to be constructed by the Applicant will be known as the American Falls Power Plant . The new power plant , by utilizing the full head of the American Falls Replacement Dam and the falls, will have a total installed (nameplate) capacity of 92 . 4 MW. The powerhouse to be constructed by the Applicant will replace the powerhouse presently operated by Applicant approximately one-fifth mile downstream from the existing American Falls Dam on the Snake River in Power County, Idaho, said existing powerhouse having a generating capacity of approximately 27. 5 MW. III. On the 21st day of September, 1973, Idaho Power Company made application to the Federal Power Commission for an Order authorizing the construction of the proposed American Falls Power Plant, and on the 31st day of March, 1975, the Federal Power Commission issued its Order authorizing the construction of said power plant as Project No. 2736 . A copy of Idaho' s Application to the Federal Power Commission and the Order of that Commission authorizing the construction is attached to the application to the Idaho Public Utilities Com- mission. Said Application and Order fully describe the proposed works of Applicant herein. The estimated total cost of Appli- can t works as of April 1, 1976 , of the proposed American Falls Power Plant and associated facilities is in excess of $42,000,000 . The Commission has determined that Idaho is capable of financing the project . IV. As indicated in the exhibit attached to the Application, water releases from the American Falls Replacement Dam for irrigation purposes occur during the summer months during the Applicant ' s peak load period. The proposed American Falls Power Plant will permit greater utilization of the waters being released to meet the Applicant ' s existing and future load requirements . V. Idaho, in filing this Application, is complying with statutory requirements of Section 61-526 , Idaho Code, Title 61, Idaho Code, and the Rules of Practice and Procedure of the Idaho Public Utilities Commission. VI . Pursuant to the Rules of Practice and Procedure of the Idaho Public Utilities Commission, Rule 1 . 4, the Commission has reviewed this matter ex parte . This approach was used because of the Federal Power Commission' s authority and proceedings in this case, the Idaho Public Utilities Commission' s knowledge of the issues and the immediate need for approval of this project . The Commission issues its order based upon the evidence before -2- it in this application and upon the evidence presented to the Federal Power Commission in its independent hearing on this matter. VII. Through this proceeding and its other utility hearings the Commission is aware of the projected needs for additional power. The present and future public convenience and necessity require that this proposed construction be approved. IPC-E-95-6 MENT TO CERTIFICATE OF PUBLIC ) CONVENIENCE AND NECESSITY NO. 272 ) ORDER NO. 26107 On June 2, 1995, Idaho Power Company (Idaho Power; Company) filed an Application with the Idaho Public Utilities Commission (Commission) requesting an amendment to its Certificate of Public Convenience and Necessity No. 272 deleting its prior authorization to construct a new 138 kV transmission line from the Wood River substation to the Ketchum substation in Blaine County. The prior authorization was obtained from the Commission in 1973 in Order No. 11315, Case No. U-1006-89. The purpose of the proposed line was to provide backup service for the existing Wood River/Ketchum 138 kV transmission line which runs along the east end of the Wood River Valley. Based on an extensive reassessment of the feasibility and need for an additional 138 kV Wood River/Ketchum transmission line, the Company concludes that the line is not needed. The reassessment study performed by the Company includes a review of both the capacity requirements and the reliability requirements for Idaho Power's electric service to the Ketchum/Sun Valley area. Regarding capacity, the Company contends that based on current projections the existing 138 kV Wood River/Ketchum transmission line has sufficient capacity to meet the area's electric needs for the foreseeable future. The Company states that it will continue to monitor area load growth and make modifications when necessary. Regarding reliability, Idaho Power reports that it has thoroughly reviewed the reliability of its electric service to the Ketchum/Sun Valley area. The Wood River/Ketchum 138 kV transmission line, the Company contends, has had an excellent record of reliability since its construction in 1962 (only two unplanned outages in the past 14 years, for a total duration of only three minutes). Nonetheless, the Company states that it has taken a number of steps to further improve the reliability of the line including the following: structural assessment,electrical ORDER NO. 26107 - 1 - assessment, fire protection, avalanche study, conductor assessment, maintenance plan and emergency action plan. The Company reports that it has also recently completed an extensive public participation process regarding the possible construction of a second 138 kV transmission line from the Wood River substation to the Ketchum substation. The Company received input from public officials and citizens of the area. The overwhelming response from the parties commenting, the Company states, was that, despite the unavoidable risk of an outage to the existing transmission line, the proposed transmission line should not be built. The reasons for public opposition to the line include the difficulty of finding an acceptable route for the transmission line, aesthetic impacts, health and safety concerns, and the excessive cost of burying part or all of the line. Idaho Power reports that it has been unsuccessful in obtaining the necessary rights-of-way for the additional 138 kV Wood River/Ketchum transmission line. Based on the Company's need analysis and public comments, Idaho Power concludes that construction of an additional 138 kV transmission line from the Wood River substation to the Ketchum substation is not feasible at this time. The Company reports that it will continue to monitor the condition of the existing Wood River/Ketchum transmission line, the increase in load growth in the Ketchum/Sun Valley area, and the feasibility of obtaining the required right- of-way and public permits for a second 138 kV line. Because the project, the Company concludes, is neither needed nor feasible, the Company requests authority to amend its Certificate of Public Convenience and Necessity No. 272 by removing the language authorizing the construction by Idaho Power of a second Wood River/Ketchum 138 kV transmission line. Reference Case No. U-1006-89, Order No. 11315. The Commission issued Notices of Application and Modified Procedure in Case No. IPC-E-95-6 on June 22, 1995. The deadline for filing written comments or protests was July 14, 1995. Commission Staff was the only party to file comments. Staff recommends approval of the Company's Application. COMMISSION FINDINGS The Commission has reviewed the Application of Idaho Power Company and the filings of record in Case No. IPC-E-95-6. We have also reviewed our prior Order No. 11315 in ORDER NO. 26107 - 2 - Case No. U-1006-89 which granted Idaho Power authorization to construct a second 138 kV transmission line from the Wood River substation to the Ketchum substation. The Commission continues to find it reasonable and appropriate to process the Company's Application under Modified Procedure, i.e., by written submission rather than by hearing. Reference Commission Rules of Procedure, IDAPA 31.01.01.204. Based on our review of the record, the Commission finds it reasonable to conclude that the present public convenience and necessity no longer requires construction of a second 138 kV transmission line to provide adequate, efficient,just and reasonable service to the Ketchum/Sun Valley area. We therefore find it reasonable to cancel the Company's Certificate No. 272 authorization for the construction of a second Wood River/Ketchum 138 kV transmission line. In reviewing the remaining language of Certificate No. 272, the Commission notes that it does not depict prior modifications to Certificate No 272. Apart from authorization to construct a second 138 kV line, Certificate No. 272 also authorized construction of a 50 MW combustion turbine generator, i.e., the Hailey turbine. The Hailey turbine, after it was built and installed, was with Commission authorization subsequently sold. Reference Order No. 24676, Case No. IPC-E-92-9 (January 27, 1993). Although the Commission's Order No. 24676 cancelled certificate authorization for the Hailey turbine, an amended certificate was never issued. The present elimination of authorization for a second 138 kV line effectively removes all authorization previously given by Certificate No. 272. The Commission therefore finds it administratively appropriate to cancel Certificate No. 272 rather than to amend it as requested by the Company. CONCLUSIONS OF LAW The Commission has jurisdiction in this matter and over Idaho Power Company, an electric utility, pursuant to the authority and power granted the Commission under Title 61 of the Idaho Code and pursuant to the Commission's Rules of Procedure, IDAPA 31.01.01000 et seq. ORDER In consideration of the foregoing and as more particularly described above IT IS HEREBY ORDERED that Idaho Power Company's authority to construct a second Wood River/Ketchum 138 kV transmission line as previously authorized by the Commission in Case ORDER NO. 26107 - 3 - No. U-1006-89, Order No. 11315 and Certificate of Public Convenience and Necessity No. 272 is cancelled. ORDER NO. 11315 On October 31, 1973, the Commission received an application from the Idaho Power Company (Applicant) requesting a Certificate of Public Convenience and Necessity for the construction and installation of a 50 megawatt (50,000 kilowatts) combustion turbine generator and related facilities at Applicant's Wood River Substation near Hailey, Idaho, and the conversion and rebuild of the present 46KV transmission and distribution lines from the Wood River Substation to the Ketchum Substation to 138KV transmission line. On November 7, 1973, the Commission issued its Notice of Hearing setting the matter for Hearing at the Grange Hall, Hailey, Idaho, commencing at 9:00 A.M., Thursday, December 6, 1973, at which time and place the Hearing was held before Commissioners Ralph H. Wickberg and Robert Lenaghen, and the following appearances were entered: JAMES E. BRUCE, Vice-President, Secretary and General Counsel, and THOMAS G. Applicant proposes to construct and install a 50 megawatt combustion turbine generator and related facilities for the generation of electrical power and energy. The plant will be located adjacent to Applicant's Wood River Substation situated between the cities of Hailey and Ketchum, Blaine County, Idaho. The combustion turbine will be a General Electric model Series 7000, simple cycle turbine. In the simple cycle, air is drawn into the axial flow compressor and discharged into the combustion chamber at high pressure. Energy is -1- added in the combustion chamber where liquid or gaseous fuel is burned to produce high temperature gas. These high temperature gases are expanded through the turbine, which converts the thermal energy into mechanical energy of rotation. The unit will be 32.25 feet at the-highest point, 116.75 feet long and 61.52 feet wide. It is a modular type construction and will not have any open running parts. All the operations will be housed in a structure which will be painted a neutral color to blend it into its surroundings. There will be a fuel supply tank located on the property, but some distance away from the turbine to store the fuel supply for the turbine. The tank will be 32 feet high with a maximum diameter of 106 feet capable of storing 50,000 barrels of oil. An earth dike will surround the tank and will encompass an area that will contain all of the oil in the event of a leak. The ground will have an impervious barrier to prevent any escape of the oil into the ground. The turbine will be so constructed and installed that at 400 feet the sound level will be 47 decibels (dba) and 44 dba at 600 feet, which will produce approximately the same sound pressure level that existed at the site on September 10, 1973. At the present time there are no residents within 400 feet of the tur- bine and only 3 residences within 600 feet. The noise level from the operations of the turbine will not be noticeable at these residences. To determine the effect that running the turbine would have on the air quality in the area the Applicant had the General Electric Company to make a study on what would occur. The study was of the magnitude of ground level concentration of combustion products that might be expected from operation of the unit. The methods used in the study were those approved by the Environmental Protection Agency and included Holland Plume Rise Formula and Pasquel's Atmospheric Diffusion Formula and weather information obtained from the United States Forest Service offices in Boise, Hailey and Ketchum. Using the worst one-hour period that could occur to compute the ground level concentration, the study found that the highest concentration of any substance is less than 1% of the concentration permitted by the Idaho standards. There would be no significant deterioration of the air quality in the area resulting from the operation of the combustion turbine, either with natural gas or No. 2 heating fuel. -2- The Applicant anticipates a shortage of power on the system during the months of June, July, August and September, 1974, due to the delay of the first 500 megawatt unit of the Jim Bridger Steam Electric Generating Station now under construction in Wyoming. The first unit of Jim Bridger was scheduled for produc- tion in June, 1974. However, this schedule, due to labor turnover and harsh winter weather, has been delayed for 3 to 6 months. In these months, the Appli- cant, due to the very large irrigation and air-conditioning load, will need addi- tional power and energy to supply these loads. With the delay of Jim Bridger additional energy sources must be obtained by Applicant and the output of the 50 megawatt combustion turbine will aid in remedying this deficit and assist the Applicant in maintaining its large summer load requirements. Service to the Hailey-Ketchum-Sun Valley area is presently being supplied by a 46KV line from Shoshone to Hailey, which does not have the capacity to serve the entire load in the area, and a single 138KV line running 72 miles from the King Substation near Hagerman to the Wood River Substation. The residents in the Hailey-Ketchum area are primarily dependent on the operation of the 138KV line. The 138KV line transverses high desert and mountainous terrain, subject to storms, snow, avalanches, slides, fire and icing conditions. Although the opera- ting experience with the 138KV line since its construction in 1962 has been espec- ially good, the passage of time and corresponding deterioration of plant will contribute to a substantial outage sometime in the future. The winter load in the Hailey-Ketchum area is very high due primarily to the large amount of electric heat used and any prolonged outage of the electric supply especially in the winter months could cause great hardship. The combustion turbine generator will be used to supply energy to the Applicant's system for the summer of 1974 and until completion of the Jim Bridger Plant, but it will remain at this location to provide increased security of service in the Hailey-Ketchum-Sun Valley area and as reserve capacity after the Jim Bridger Plant is completed and in operation. The Applicant investigated alternate methods for increased electric reliability in the Hailey-Ketchum area. One method consid- ered was the construction of an additional 138KV transmission line extending from -3- the Hunt Substation hear Eden northerly across the desert and mountains to the Silver Creek area, across the Silver Creek area to Gannett and then northerly to Ketchum. The Applicant encountered a number of problems to this proposal, prim- arily the right-of-way. The Applicant contacted many individual landowners on the possibility of obtaining right-of-way and found that these individuals did not desire to grant such right-of-way across their property. Such a transmission line would cross a substantial portion of federal lands and obtaining right-of- way across these lands presented serious problems. Applicant also requests authority to rebuild and convert its existing 46KV transmission line extending from the Wood River Substation to a point near Gimlet to 138KV transmission capacity with distribution underbuild and to convert and rebuild the existing distribution line extending from Gimlet to the Ketchum Substation-to 138KV transmission capacity with distribution rebuild. The rebuild will be on a pole for pole basis; that is, a new pole will be located next to an old pole and upon completion of the new line all the old poles will be removed. The length of the new pole will be higher than the present poles and a curved type wooden mast arm will be used to carry the conductors and the distribution lines will be located on the new poles at a point below the transmission line. The rebuild will be done on the present right-of-way and no additional right-of-way will be required. The Applicant maintains that it is necessary to have an additional 138KV transmission line into the Ketchum-Sun Valley area for the reason that since the present 138KV transmission line was constructed, the load on the Ketchum Sub- station has increased from 2,664 kilowatts to 20,924 kilowatts, and with the present building and expansion going on in the Sun Valley, Elkhorn and Ketchum area, the load will continue to increase. All of the present load is served on the existing 138KV line that extends from the Wood River Substation to the Ketchum Substation on the east side of the Big Wood River Valley to the east fork of the Big Wood River, at which point it crosses along and over the east side of the mountains that lie adjacent to the valley floor. This section of the line is particularly vulnerable to snow, mud or road slides and is in a difficult area to -4- reach with ground transportation. As a result of the large increases in load and the line outage possibility it is prudent to provide an alternate source of power to the Ketchum Substation. The attorney for the protestant questioned the necessity of the const- ruction and rebuild of the present 46KV transmission and distribution lines from the Wood River Substation to the Ketchum Substation to 138KV capacity. The primary concern appears to be the effect the rebuild of the line to higher poles would have on the environment of the valley. He further questions whether or not there was an alternate route that could be utilized either for additional trans- mission line or the possibility of placing the proposed line on the present 138KV structures. It was his concern that whether or not the operation of the combustion turbine would cause a substantial deterioration in the air quality in the valley, especially during periods of low wind velocity. We have given careful consideration to the effect on the area of constructing a combustion turbine generator and the rebuild and construction of the present 46KV lines and distribution lines to 138KV capacity. We are of the opinion that if the proposed 138KV line were to be placed in another area the land use impact, which is the primary consideration, would be much greater on the total valley impact than in using some route other than the highway. The present plan would replace the present lines and would not add additional poles and wires in the valley. But placing the proposed line on the present 138KV structures would not meet the purposes for which the line is designed and that is an additional power source to Ketchum Substation by an alternate supply of power so that in the case of the loss of the present 138KV line then you would not lose the entire electrical supply to the Ketchum-Sun Valley area. The record is clear that the emission from turbine would, when compared to the National Ambient Air Quality Standards, be less than 1% of the standards and would be far below the "no signi- ficant" deterioration level in all categories to which these standards apply and would be lower than the minimum requirements of the State of Idaho and the Environmental Protection Agency. -5- We conclude that the benefits to be derived from the installation and operation of the combustion turbine generator at this site are greater than any detrimental effect that might be made on the environment of the area. If the unit is not installed on the proposed site and a major interruption should happen, harm to the public would occur by the loss of electrical energy for space heat- ing, the pumping of water for fire fighting and other purposes and the general disruption of activities that follow loss of electrical service for an extended period of time. We would not be fulfilling our regulatory obligations if we did not take action to approve an alternate source of electrical power for the Hailey- Ketchum-Sun Valley area to guard against the extended power outages that would occur if the 138KV transmission line were lost. It appears that the installation of the combustion turbine generator and the proposed construction and rebuild of the present 46KV transmission and distribution line to 138KV capacity is the most reasonable method to provide security at this time. F I N D I N G S I. THAT Idaho Power Company is a corporation organized and existing under and by virtue of the laws of the State of Maine and is duly authorized to trans- act business in the State of Idaho and is engaged as a public utility in furnish- ing electric service in the State of Idaho and in the states of Nevada and.Oregon with its principal office in Boise, Idaho. II. THAT Applicant has filed with this Commission an application request- ing a Certificate of Public Convenience and Necessity for the construction and installation of a 50 megawatt combustion turbine generator and related facilities adjacent to its Wood River Substation near Hailey, Idaho, and the conversion and rebuilding of the present 46KV transmission line and distribution lines from the Wood River Substation to the Ketchum Substation to 138KV capacity. III. THAT electric service is provided to the Hailey-Ketchum-Sun Valley area by a single 138KV transmission line extending for 72 miles from the King -6- Substation near Hagerman to the Wood River Substation near Hailey, Idaho. IV. THAT the 138KV transmission line traverses high desert and mountainous terrain subject to storms, snow, avalanches, fires and icing conditions. V. THAT the operating service of this line has been exceptionally good, but the passage of time and corresponding plant deterioration will contribute to a substantial outage sometime in the future. VI. THAT the Hailey-Ketchum-Sun Valley area has a very high winter load due primarily to electric heat and any prolonged electrical outage in the winter- time would cause great hardship. VII. THAT the construction and installation of a 50 megawatt combustion turbine generator at the Wood River Substation would provide increased security to the Hailey-Ketchum-Sun Valley area and alleviate any hardship that could be caused by a prolonged electrical outage. VIII. THAT the construction of an additional transmission line from the Hunt Substation to the Hailey-Ketchum-Sun Valley area to provide increased relia- bility is not feasible at this time. IX. THAT the rebuild and conversion of existing 46KV transmission and distribution lines to 138KV capacity between the Wood River Substation and the Ketchum Substation is required for increased security in the Ketchum-Sun Valley area. X. THAT the noise resulting from the operation of the combustion turbine will not be of sufficient pressure level to cause any hardship to the present residents of the immediate area. -7- XI. THAT the combustion turbine will be designed, constructed and operated in such a manner as to meet the air quality standards pursuant to the applicable laws, rules and regulations of the State of Idaho and of the United States. XII. THAT a Certificate of Public Convenience and Necessity for the construction and installation of a 50 megawatt combustion turbine generator and related facilities at Applicant's Wood River Substation and the rebuild and conversion of the present 46KV transmission and distribution lines from the Wood River Substation to the Ketchum Substation is in the public interest and a Certificate of Public Convenience and Necessity should be issued. O R D E R IT IS THEREFORE ORDERED that a Certificate of Public Convenience and Necessity should be, and the same is, hereby granted to Idaho Power Company for the construction and operation of a 50 megawatt combustion turbine generator and related facilities at the Wood River Substation near Hailey and the conversion and rebuild of the present 46KV transmission and distribution lines from the Wood River Substation to the Ketchum Substation to 138KV transmission line. WICKBERG My personal attitude toward authorizing a gas turbine power plant to serve emergency electric power to the Sun Valley-Ketchum-Hailey area is one of ambivalence. It is easy for me to understand that many people who reside in the area would like to avoid the construction of additional electric facilities whether they be power plants or higher poles for transmission purposes. My personal observation is that commercial and residential devel- opments now taking place require a firm and secure electric power supply to avoid the possibility of serious economic and personal discomfort that would come about as the result of a major electric power outage. Idaho law clearly requires the serving utility (Idaho Power Co.) and the Idaho Public Utilities Commission to use reasonable diligence in providing an excellent and reliable electric system to all consumers and areas. The testimony and uncontroverted facts of this case prove conclusively, to me, that the present electric transmission system serving the Hailey-Ketchum-Sun Valley area is deficient from reliability criteria. I believe that this Commission would be derelict in not recognizing that a present hazard exists to the health, comfort and safety of the residents of Hailey-Ketchum-Sun Valley. This Commission has before it a reasonable plan to eliminate much of the risk of a serious electric power outage to this area. The construction of the proposed gas turbine north of Hailey and the reconstruction of the transmission line to Ketchum, is, in my opinion, bene- ficial and necessary. On November 7, 1973, the Commission issued its Notice of Hearing setting the matter for Hearing at the Grange Hall, Hailey, Idaho, commencing at 9:00 A.M. , Thursday, December 6, 1973, at which time and place the Hearing was held before Commissioners Ralph H. Applicant proposes to construct and install a 50 megawatt combustion tur b-ine generator and related facilities for the generation of electrical power and energy. The plant will be located adjacent to Applicant's Wood River Substation situated between the cities of Hailey and Ketchum, Blaine County, Idaho. The combustion turbine will be a General Electric model Series 7000, simple cycle turbine. In the simple cycle, air is drawn into the axial flow compressor and discharged into the combustion chamber at high pressure. Energy is -1- added in the combustion chamber where liquid or gaseous fuel is burned to produce high temperature gas. These high temperature gases are expanded through the turbine, which converts the thermal energy into mechanical energy of rotation. The unit will be 32.25 feet at the highest point, 116.75 feet long and 61.52 feet wide. It is a modular type construction and will not have any open running parts. All the operations will be housed in a structure which will be painted a neutral color to blend it into its surroundings. There will be a fuel supply tank located on the property, but some distance away from the turbine to store the fuel supply for the turbine. The tank will be 32 feet high with a maximum diameter of 106 feet capable of storing 50,000 barrels of oil. An earth dike will surround the tank and will encompass an area that will contain all of the oil in the event of a leak. The ground will have an impervious barrier to prevent any escape of the oil into the ground. The turbine will be so constructed and installed that at 400 feet the sound level will be 47 decibels (dba) and 44 dba at 600 feet, which will produce approximately the same sound pressure level that existed at the site on September 10, 1973. At the present time there are no residents within 400 feet of the tur- bine and only 3 residences within 600 feet. The noise level from the operations of the turbine will not be noticeable at these residences. To determine the effect that running the turbine would have on the air quality in the area the Applicant had the General Electric Company to make a study on what would occur. The study was of the magnitude of ground level concentration of combustion products that might be expected from operation of the unit. The methods used in the study were those approved by the Environmental Protection Agency and included Holland Plume Rise Formula and Pasquel's Atmospheric Diffusion Formula and weather information obtained from the United States Forest Service offices in Boise, Hailey and Ketchum. Using the worst one-hour period that could occur to compute the ground level concentration, the study found that the highest concentration of any substance is less than 1% of the concentration permitted by the Idaho standards. 'There would be no significant deterioration of the air quality in the area resulting from the operation of the combustion turbine, either with natural gas or No. 2 heating fuel. -2- The Applicant anticipates a shortage of power on the system during the months of June, July, August and September, 1974, due to the delay of the first 500 megawatt unit of the Jim Bridger Steam Electric Generating Station now under construction in Wyoming. The first unit of Jim Bridger was scheduled for produc- tion in June, 1974. However, this schedule, due to labor turnover and harsh winter weather, has been delayed for 3 to 6 months. In these months, the Appli- cant, due to the very large irrigation and air-conditioning load, will need addi- tional power and energy to supply these loads. With the delay of Jim Bridger additional energy sources must be obtained by Applicant and the output of the 50 megawatt combustion turbine will aid in remedying this deficit and assist the Applicant in maintaining its large summer load requirements. Service to the Hailey-Ketchum-Sun Valley area is presently being supplied by a 46KV line from Shoshone to Hailey, which does not have the capacity to serve the entire load in the area, and a single 138KV line running 72 miles from the King Substation near Hagerman to the Wood River Substation. The residents in the Hailey-Ketchum area are primarily dependent on the operation of the 138KV line. The 138KV line transverses high desert and mountainous terrain, subject to storms, snow, avalanches, slides, fire and icing conditions. Although the opera- ting experience with the 138KV line since its construction in 1962 has been espec- ially good, the passage of time and corresponding deterioration of plant will contribute to a substantial outage sometime in the future. The winter load in the Hailey-Ketchum area is very high due primarily to the large amount of electric heat used and any prolonged outage of the electric supply especially in the winter months could cause great hardship. The combustion turbine generator will be used to supply energy to the Applicant's system for the summer of 1974 and until completion of the Jim Bridger Plant, but it will remain at this location to provide increased security of service in the Hailey-Ketchum-Sun Valley area and as reserve capacity after the Jim Bridger Plant is completed and in operation. The Applicant investigated alternate methods for increased electric reliability in the Hailey-Ketchum area. One method consid- ered was the construction of an additional 138KV transmission line extending from -3- the Hunt Substation hear Eden northerly across the desert and mountains to the Silver Creek area, across the Silver Creek area to Gannett and then northerly to Ketchum. The Applicant encountered a number of problems to this proposal, prim- arily the right-of-way. The Applicant contacted many individual landowners on the possibility of obtaining right-of-way and found that these individuals did not desire to grant such right-of-way across their property. Such a transmission line would cross a substantial portion of federal lands and obtaining right-of- way across these lands presented serious problems. Applicant also requests authority to rebuild and convert its existing 46KV transmission line extending from the Wood River Substation to a point near Gimlet to 138KV transmission capacity with distribution underbuild and to convert and rebuild the existing distribution line extending from Gimlet to the Ketchum Substation to 138KV transmission capacity with distribution rebuild. The rebuild will be on a pole for pole basis; that is, a new pole will be located next to an old pole and upon completion of the new line all the old poles will be removed. The length of the new pole will be higher than the present poles and a curved type wooden mast arm will be used to carry the conductors and the distribution lines will be located on the new poles at a point below the transmission line. The rebuild will be done on the present right-of-way and no additional right-of-way will be required. The Applicant maintains that it is necessary to have an additional 138KV transmission line into the Ketchum-Sun Valley area for the reason that since the present 138KV transmission line was constructed, the load on the Ketchum Sub- station has increased from 2,664 kilowatts to 20,924 kilowatts, and with the present building and expansion going on in the Sun Valley, Elkhorn and Ketchum area, the load will continue to increase. All of the present load is served on the existing 138KV line that extends from the Wood River Substation to the Ketchum Substation on the east side of the Big Wood River Valley to the east fork of the Big Wood River, at which point it crosses along and over the east side of the mountains that lie adjacent to the valley floor. This section of the line is particularly vulnerable to snow, mud or road slides and is in a difficult area to -4- reach with ground transportation. As a result of the large increases in load and the line outage possibility it is prudent to provide an alternate source of power to the Ketchum Substation. The attorney for the protestant questioned the necessity of the const- ruction and rebuild of the present 46KV transmission and distribution lines from the Wood River Substation to the Ketchum Substation to 138KV capacity. The primary concern appears to be the effect the rebuild of the line to higher poles would have on the environment of the valley. He further questions whether or not there was an alternate route that could be utilized either for additional trans- mission line or the possibility of placing the proposed line on the present 138KV structures. It was his concern that whether or not the operation of the combustion turbine would cause a substantial deterioration in the air quality in the valley, especially during periods of low wind velocity. We have given careful consideration to the effect on the area of constructing a combustion turbine generator and the rebuild and construction of the present 46KV lines and distribution lines to 138KV capacity. We are of the opinion that if the proposed 138KV line were to be placed in another area the land use impact, which is the primary consideration, would be much greater on the total valley impact than in using some route other than the highway. The present plan would replace the present lines and would not add additional poles and wires in the valley. But placing the proposed line on the present 138KV structures would not meet the purposes for: which the line is designed and that is an additional power source to Ketchum Substation by an alternate supply of power so that in the case of the loss of the present 138KV line then you would not lose the entire electrical supply to the Ketchum-Sun Valley area. The record is clear that the emission from turbine would, when compared to the National Ambient Air Quality Standards, be less than 1% of the standards and would be far below the "no signi- ficant" deterioration level in all categories to which these standards apply and would be lower than the minimum requirements of the State of Idaho and the Environmental Protection Agency. -5- We conclude that the benefits to be derived from the installation and operation of the combustion turbine generator at this site are greater than any detrimental effect that might be made on the environment of the area. If the unit is not installed on the proposed site and a major interruption should happen, harm to the public would occur by the loss of electrical energy for space heat- ing, the pumping of water for fire fighting and other purposes and the general disruption of activities that follow loss of electrical service for an extended period of time. We would not be fulfilling our regulatory obligations if we did not take action to approve an alternate source of electrical power for the Hailey- Ketchum-Sun Valley area to guard against the extended power outages that would occur if the 138KV transmission line were lost. It appears that the installation of the combustion turbine generator and the proposed construction and rebuild of the present 46KV transmission and distribution line to 138KV capacity is the most reasonable method to provide security at this time. F I N D I N G S I. THAT Idaho Power Company is a corporation organized and existing under and by virtue of the laws of the State of Maine and is duly authorized to trans- act business in the State of Idaho and is engaged as a public utility in furnish- ing electric service in the State of Idaho and in the states of Nevada and Oregon with its principal office in Boise, Idaho. II. THAT Applicant has filed with this Commission an application request- ing a Certificate of Public Convenience and Necessity for the construction and installation of a 50 megawatt combustion turbine generator and related facilities adjacent to its Wood River Substation near Hailey, Idaho, and the conversion and rebuilding of the present 46KV transmission line and distribution lines from the Wood River Substation to the Ketchum Substation to 138KV capacity. III. THAT electric service is provided to the Hailey-Ketchum-Sun Valley area by a single 138KV transmission line extending for 72 miles from the King -6- Substation near Hagerman to the Wood River Substation near Hailey, Idaho. IV. THAT the 138KV transmission line traverses high desert and mountainous terrain subject to storms, snow, avalanches, fires and icing conditions. V. THAT the operating service of this line has been exceptionally good, but the passage of time and corresponding plant deterioration will contribute to a substantial outage sometime in the future. VI. THAT the Hailey-Ketchum-Sun Valley area has a very high winter load due primarily to electric heat and any prolonged electrical outage in the winter- time would cause great hardship. VII. THAT the construction and installation of a 50 megawatt combustion turbine generator at the Wood River Substation would provide increased security to the Hailey-Ketchum-Sun Valley area and alleviate any hardship that could be caused by a prolonged electrical outage. VIII. THAT the construction of an additional transmission line from the Hunt Substation to the Hailey-Ketchum-Sun Valley area to provide increased relia- bility is not feasible at this time. IX. THAT the rebuild and conversion of existing 46KV transmission and distribution lines to 138KV capacity between the Wood River Substation and the Ketchum Substation is required for increased security in the Ketchum-Sun Valley area. X. THAT the noise resulting from the operation of the combustion turbine will not be of sufficient pressure level to cause any hardship to the present residents of the immediate area. -7- XI. THAT the combustion turbine will be designed, constructed and operated in such a manner as to meet the air quality standards pursuant to the applicable laws, rules and regulations of the State of Idaho and of the United States. XII. THAT a Certificate of Public Convenience and Necessity for the construction and installation of a 50 megawatt combustion turbine generator and related facilities at Applicant's Wood River Substation and the rebuild and conversion of the present 46KV transmission and distribution lines from the Wood River Substation to the Ketchum Substation is in the public interest and a Certificate of Public Convenience and Necessity should be issued. O R D E R IT IS THEREFORE ORDERED that a Certificate of Public Convenience and Necessity should be, and the same is, hereby granted to Idaho Power Company for the construction and operation of a 50 megawatt combustion turbine generator and related facilities at the Wood River Substation near Hailey and the conversion and rebuild of the present 46KV transmission and distribution lines from the Wood River Substation to the Ketchum Substation to 138KV transmission line. WICKBERG My personal attitude toward authorizing a gas turbine power plant to serve emergency electric power to the Sun Valley-Ketchum-Hailey area is one of ambivalence. It is easy for me to understand that many people who reside in the area would like to avoid the construction of additional electric facilities whether they be power plants or higher poles for transmission purposes. My personal observation is that commercial and residential devel- opments now taking place require a firm and secure electric power supply to avoid the possibility of serious economic and personal discomfort that would come about as the result of a major electric power outage. Idaho law clearly requires the serving utility (Idaho Power Co.) and the Idaho Public Utilities Commission to use reasonable diligence in providing an excellent and reliable electric system to all consumers and areas. The testimony and uncontroverted facts of this case prove conclusively, to me, that the present electric transmission system serving the Hailey-Ketchum-Sun Valley area is deficient from reliability criteria. I believe that this Commission would be derelict in not recognizing that a present hazard exists to the health, comfort and safety of the residents of Hailey-Ketchum-Sun Valley. This Commission has before it a reasonable plan to eliminate much of the risk of a serious electric power outage to this area. The construction of the proposed gas turbine north of Hailey and the reconstruction of the transmission line to Ketchum, is, in my opinion, bene- ficial and necessary. By its Order No. 10062. in Case No. U-1006-71 , this Commission granted to Idaho a certificate of public convenience and necessity in conjunction with Pacific Power & Light Company (Pacific) to construct a coal-fired steam electric generating plant and related facilities for the generation and transmission of electric power and energy , said plant to be located-,approxi- mately 7 miles north of Point of Rocks , Wyoming in the vicinity of Rock Springs , Sweetwater County, Wyoming. Idaho proposes to construct , own and operate one 345 KV electric transmission line , which transmission line , in Idaho , will run in a northeasterly direction from a point in Section 11 , T15S , R46E, BM , Bear Lake County , Idaho to the Goshen substation in Section 28 , T1S , R37E, BM , Bingham County , Idaho , a distance of approximately 101 . 49 miles . This 345 KV transmission line will , by' the summer of 1974 , run from the aforedescribed point in Bear Lake County , Idaho in a southeasterly direction in Wyoming to a point described as Naughton Junction in Section 16 , T22N, R116W, 6th PM, Lincoln County , Wyoming and thence in an easterly direction to the Jim Bridger steam generating plant near Rock Springs , Wyoming . Studies conducted by Idaho show that with Idaho' s generation and existing contracts with other utilities for the purchase of power , supply will be very critical during the years 1971 and thereafter. In order to insure that there will be sufficient power during the summer season , Idaho has agreed with Utah Power 6 Light Company (Utah) to advance the construe tion of a 345 KV transmission line from the four corners area in New Mexico to the Naughton steam plant of Utah in Wyoming. This is to assure that surplus steam energy from- the southwest will be available to Utah and Idaho systems . Idaho has also entered into contracts with Utah and Pacific to furnish steam energy in 1971 , 1972 and 1973 from their Dave Johnston and Naughton steam plants . In order to facilitate the transfer of this energy to its system, Idaho proposes to construct the first segment of the 345 KV transmission line extending from Naughton Junction, approximately nine miles north of the Naughton steam plant in Wyoming to the Goshen Substation in Bingham County , Idaho . This line will initially be operated at 230 KV until the completion of the Jim Bridger steam electric plant in the summer of 1974 . In addition, Idaho will construct a 230 KV transmission line - i'n Wyoming extending from Naughton Junction , southerly for nine miles to the Naughton steam plant ; after 1974 this section of line will be salvaged. Two additional 345 KV transmission lines will be con- structed by Pacific (Case No. U-1046-44 ) both lines will run parallel to the Idaho line from the Jim Bridger steam plant to a point near Montpelier. At that point the Pacific lines will -2- run in a westerly direction with one line terminating at the Kinport substation near Pocatello and the other line terminating in the Borah substation near American Falls . The line to be constructed by Idaho running from a point on the Idaho-Wyoming border to the Goshen substation will cross private , state and Bureau of Land Management land . In Wyoming and Idaho to Montpeli'dr , the line crosses rocky sage brush , high desert type land , north of Montpelier there is some dry agriculture and a small amount of irrigated land to a point about 20 miles north of Soda Springs . From this point the line crosses grassy , sage brush, mountainous terrain, and some forested area that is generally of non-merchantable classification, minimum clearing will be required in this area. The last 311 miles to the Goshen substation crosses high-use agricultural type land that cannot be avoided. After the approximate location of the line had been determined by Idaho , a detailed survey was made in conjunction with the Bureau of Land Management , Idaho Department of Public Lands and the U . S. Forest Service. As a result of this survey an agreement was made between Idaho", and the affected government agencies and the final design of the towers and their location was made. The line proposed to be constructed by Idaho will consist of what is commonly referred to as ""delta y guyed" towers , with each tower resting on a small concrete base and supported by four down guys . The towers will be constructed of aluminum and will range in heighth from 85 feet to 140 feet with an average height of 120 ,feet , and each tower will support three pair of aluminum conductors and two steel strand lightening protection wires on the upper masts . The towers will be fabri- cated in marshalling yards and will be transported complete to the tower sites by helicopter. The stringing of the conductors will require some equipment on the ground but there should be minimum disturbance of the land area during construction. -3- FINDINGS I. THAT Idaho Power Company is a corporation organized and existing under and by virtue of the laws of the State of Maine and is qualified to do business in the State of Idaho and is engaged „in the generation, transmission and distribution of electric energy in the State of Idaho and in the States of Oregon and Nevada and as such is subject to the jurisdiction of this Commission. II . THAT Idaho Power Company is presently engaged in the construction of a 500 MW coal-fired steam electric generating station approximately 7 miles north of Point of Rock, in the vicinity of Rock Springs , Sweetwater County , Wyoming , to be completed in the summer of 1974 . III. THAT to bring the energy to be generated at this station to the State of Idaho will require the construction and operation of a 345 KV transmission line from the generating station to the Goshen substation in Bingham County , Idaho. IV . THAT the loads of Idaho Power Company in the summer of 1972 and 1973 will require the . construction of a transmission line from the Naughton steam plant to Naughton Junction in Wyoming to the Goshen Substation in Idaho , this line to be operated at 230 KV until the summer of 1974 .- V . THAT the transmission line to be constructed in the State of Idaho will be so designed and constructed as to cause the least impact, on the environment and the. lands to be crossed by the line. VI. Idaho proposes to construct , own and operate one 345 KV electric transmission line , which transmission line , in Idaho , will run in a northeasterly direction from a point in Section 11 , T15S , R46E, BM , Bear Lake County , Idaho to' the Goshen substation in Section 28 , T1S , R37E, BM , B'irigham County , Idaho , a distance of approximately 101 . 49 miles . This 345 KV transmission line will , by' the summer of 1974 , run from the aforedescribed point in Bear Lake County , Idaho in a southeasterly direction in Wyoming to a point described as Naughton Junction in Section 16 , T22N, R116W, 6th PM, Lincoln County , Wyoming and thence, in an easterly direction to the Jim Bridger steam generating plant near Rock Springs , Wyoming. Studies conducted by Idaho show that with Idaho' s generation and existing contracts with other utilities for the purchase of power , supply will be very critical during the years 1971 and thereafter. In order to insure that there will be sufficient, power during the summer season, Idaho has agreed with Utah Power 6 Light Company (Utah) to advance the construe tion of a 345 KV transmission line from the four corners area in New Mexico to the Naughton steam plant of Utah in Wyoming. This is to assure that surplus steam energy from- the southwest will be available to Utah and Idaho systems . Idaho has also entered into contracts with Utah and Pacific to furnish steam energy in 1971 , 1972 and 1973 from their Dave Johnston and Naughton steam plants . In order to facilitate the transfer of this energy to its system, Idaho proposes to construct the first segment of the 345 KV transmission line extending from Naughton Junction, approximately nine miles north of the Naughton steam plant in Wyoming to the Goshen Substation in Bingham County , Idaho. This line will initially be operated at 230 KV until the completion of the Jim Bridger steam electric plant in the summer of 1974 . In addition, Idaho will construct a 230 KV transmission line , i'n Wyoming extending from Naughton Junction, - southerly for nine miles to the Naughton steam plant ; after 1974 this section of line will be salvaged. Two additional 345 KV transmission lines will be con- structed by Pacific (Case No. U-1046-44 ) both lines will run parallel to the Idaho line from the Jim Bridger steam plant to a point near Montpelier. At that point the Pacific lines will -2- run in a westerly direction with one, line terminating at the , Kinport substation near Pocatello and the other line terminating in the Borah substation ,near, American Falls . The line to be constructed by Idaho running from a point on the Idaho-Wyoming border to the Goshen substation will cross private, state and Bureau of Land Management land. In Wyoming and Idaho to Montpeli,04r , the line crosses rocky sage brush , high desert type land , north of Montpelier there is some dry agriculture and a small amount of irrigated land to a point about 20 miles north of Soda Springs . From this point the line crosses grassy , sage brush, mountainous terrain, and some forested area that is generally of non-merchantable classification, minimum clearing will be required i'n this area. The last 3;j miles to the Goshen substation crosses high-use agricultural type land that cannot be avoided. After the approximate location of the line had been determined by Idaho , a detailed survey was made in conjunction with the Bureau of Land Management, Idaho Department of Public Lands and the U. S. Forest Service. As a result of this survey an agreement was made between Idaho- and the affected government agencies and the final design of the towers and their location was made. The line proposed to be, constructed by Idaho will consist of what is commonly referred to as "delta y guyed" towers , with each tower resting on a small concrete base and supported by four down guys . The towers will be constructed of aluminum and will range in heighth from 85 feet to 140 feet with an average height' of 120 ,feet , and each tower will support three pair of aluminum conductors and two steel strand lightening protection wires on the upper masts . The towers will be fabri- cated in marshalling yards and will be transported complete to the tower sites by helicopter. The stringing of the conductors will require some equipment on the ground but there should be minimum disturbance of the land area during construction. -3- FINDINGS I. THAT Idaho Power Company is a corporation organized and existing under and by virtue of the laws of the State of Maine and is qualified. to do business in the State of Idaho and is engaged ,,in the generation, transmission and distribution ,of electric energy in the State of Idaho and in the States of Oregon and Nevada and as such is subject to the jurisdiction of this Commission. II . THAT Idaho Power Company is presently engaged in the, construction of a 500 MW coal-fired steam electric generating station approximately 7 miles north of Point of Rock, in the vicinity of Rock Springs , Sweetwater County , Wyoming , to be completed in the summer of 1974 . III. THAT to bring the energy to be generated at this station to the State of Idaho will require the construction and operation of a 345 KV transmission line from the generating station to the Goshen substation in Bingham County, Idaho. IV . THAT the loads of Idaho Power Company in the summer of 1972 and 1973 will require the , construction of a transmission line from the Naughton steam plant' to Naughton Junction in Wyoming to the Goshen Substation in Idaho , this line to be operated at 230 KV until the summer of 1974 . V .
