HomeMy WebLinkAbout20240326Decison Memo.pdfDECISION MEMORANDUM 1 DECISION MEMORANDUM TO: COMMISSIONER ANDERSON COMMISSIONER HAMMOND COMMISSIONER LODGE COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: DAYN HARDIE CHRIS BURDIN DEPUTY ATTORNEY GENERAL DATE: MARCH 26, 2024 SUBJECT: IN THE MATTER OF IDAHO POWER COMPANY’S APPLICATION FOR APPROVAL OF A MARKET PURCHASE AGREEMENT; CASE NO. IPC- E-24-12. On March 18, 2024, Idaho Power Company (“Company”), applied to the Commission seeking approval of a market purchase agreement with Powerex (“Powerex Agreement”). The Powerex Agreement will provide the Company with 200 megawatts (“MW”) of firm capacity from June through September between the hours of 7:00 am and 10:00 pm Pacific Time. Beginning on June 1, 2026, the Company will be able to call on up to 200 MW during the specified hours on a day-ahead basis. The Powerex Agreement has a five-year term that is slated to begin when B2H is placed in service.1 The Company requested the Commission process its Application by modified procedure and issue a final order by August 31, 2024. STAFF RECOMMENDATION Staff recommends the Commission issue a Notice of Application and Notice of Intervention Deadline establishing a 21-day intervention deadline for interested persons to petition to intervene. 1 The Powerex Agreement contains a bridge term in the event B2H is not in service by June 1, 2026, wherein the Company will still be able to receive electricity under the Agreement through the Company’s other firm transmission rights.
