BOISE (March 26, 2024)—The Idaho Public Utilities Commission has ordered two railroad companies to appear and show cause why they should not face penalties for failing to pay their annual assessment fees. The St. Maries River Railroad Company was notified it owes $6,117.91 for its 2023 annual assessment, $127.72 in accrued interest for that year's assessment and$28.32 for unpaid interest from the 2022 assessment. The public utilities commission assesses regulatory fees on public utilities and railroads that are subject to its jurisdiction. The railroad is a short line railroad that provides freight service between Plummer and Bovill. Because it is a railroad corporation and a common carrier as defined by Idaho code, it is subject to the commission's jurisdiction. The railroad has been ordered to appear before the commission on Thursday,April 11, at 11:00 a.m. in Boise and show cause why it should not be required to immediately pay an outstanding balance of$6,273.95. Potential penalties include a fine of$2,000 for each day the amount is not paid and facing a lawsuit in district court to comply with commission decisions. BG& CM Railroad operates a short line railroad in Nez Perce, Clearwater and Idaho counties. It also is a railroad corporation and common carrier. BG & CM was notified it owes $14,775.57 for its 2023 annual assessment, $308.46 in accrued interest for that year's assessment and$49.25 for unpaid interest from the 2022 assessment. The railroad has been ordered to appear before the commission on Thursday,April 11, at 10:00 a.m. in Boise and show cause why it should not be required to immediately pay an outstanding balance of$15,133.28. Potential penalties include a fine of$2,000 for each day the amount is not paid and facing a lawsuit in district court to comply with commission decisions.
