Confidential Attachment A1 is a copy of the customer letter and request for numbers which CenturyLink cannot meet with existing inventory. This waiver will allow PAAlleustar, the Number Pool Administrator, to provide 10,000 sequential numbers in the 208 NPA for CenturyLink to meet the specific customer request.2 Attachment B, Attachment C and Confidential Attachment D3, is the documentation that CenturyLink filed with PA/Neustar on April25,2018, seeking the additional number resources. Attachment E shows that this request was rejected on April 25,2018, because CenturyLink does not meet the Months to Exhaust and Utilization requirements in order for PAAlleustar to grant the request. According to FCC requirements (47 CFR 52.15 (g), to qualify for additional numbering resources a service provider must submit paperwork demonstrating that the rate center for which the numbers are requested is at or less than six Months-To-Exhaust (MTE) and is at75Yo or more utilization. ln cases where a service provider is not able to meet a specific customer request with available inventory, the FCC has determined that the state commissions will have jurisdiction to grant a waiver pursuant to FCC 0l-362, Section IV, C, paragraphs 57-66. In paragraph 66 of this same order, the FCC recommends that the state commissions respond within 10 days of a waiver request. I Confidential Attachment A is the customer letter requesting 10,000 numbers and contains customer specific confidential information. 2 Assignment preference: 208-517,208-510 or 208-516 NNX and associated 10,000 sequential numbers. 3 Confidential Attachment D contains confidential utilization numbers and confidential growth forecast information. CenturyLink petitions the Commission for review of the denial by the pooling administrator for the State of Idaho, NeuStar, of CenturyLink's application for use of central office code numbering resources in area code 208. Specifically, CenturyLink has requested that NeuStar provide a 1000 number block in the Boise Rate Center to meet a specific customer request for 10,000 sequential numbers. CenturyLink needs these numbers as soon as possible, and will begin using them as soon as this Request for Waiver is granted and the numbers are released for service. These numbers will be added to existing inventory to accommodate expansion and growth of CenturyLink technology to beffer meet the needs of CenturyLink customers. CenturyLink's specific request is submitted under separate cover as Confidential Attachment A. CenturyLink does not have additional numbering resources available within the Boise rate center to accomplish this technology deployment. On April 25 2018, Centurylink submitted a Thousand Block Application Form-Part I to NeuStar. NeuStar's denial triggers this waiver of the utilization threshold requirements outlined in the FCC's Numbering Resource Optimization Orders, FCC 00-429 and FCC 0l-362 released in CC Docket No. 99-200. The FCC permits a waiver of the kind requested here when there is a demonstrated need, such as a specific customer request for numbers. The waiver process is specifically addressed in the FCC Third Report and Order ('oOrder") as the "safety valve" process. See FCC 0l-362,7 57 -66 (Mar. 14, 2002). The Order delegates the authority to hear requests for waivers to the state commissioners and recommends that state commissions act expeditiously. Section 1.3 The date the Service Provider completes the application should be entered in this section, as well as the Effective Date of the requested thousands- block. Section 1.4 Service Providers should indicate their type, e.g., local exchange carrier, competitive local exchange carrier, interexchange carrier, CMRS or VoIP. Also indicate the primary type of business in which the numbering resource is to be used. Blocks with over l0o% contamination (101 TNs or more) shall not be returned to the pool except when a service provider is exiting the market or is exchanging a block that was identified as being over l0o/o contaminated.
