HomeMy WebLinkAbout20160401final_order_no_33493.pdfOffice of the Secretary Service Date April 1 ‘016BEFORETHEIDAHOPUBLICUTILITIESCOMMISSION IN THE MATTER OF THE PETITION OF ) QWEST CORPORATION DBA ) CENTURYLINK QC FOR A WAIVER OF CASE NO.QWE-T-16-03 FCC THRESHOLD REQUIREMENTS FOR ) NUMBERING RESOURCES FOR NAMPA,) IDAHO ORDER NO.33493 _________________________________________________________________________________ ) On March 14,2016,Qwest Corporation dba CenturyLink QC (“CenturyLink”)filed a request for a waiver of number assignment requirements relating to an application the Company previously filed with NeuStar,the North American Number Plan Administrator (NANPA). CenturyLink states that the Application was filed to accommodate a request that it received from a large customer served by the Nampa,Idaho rate center for additional numbers—a full NXX (10,000 consecutive numbers)ending with either 3,5,or 8 to incorporate with the customer’s existing internal dialing plan.CenturyLink reviewed the customer’s request and determined it did not have the appropriate numbering resources available within the Nampa rate center.On January 12,2016,CenturyLink submitted a 1,000-block application form to NeuStar to satisfy the request of the customer for additional numbers to meet the customer’s business needs.NeuStar denied the request due to the months to exhaust andlor usage threshold calculations for the Nampa rate center. CenturyLink’s Application filed with the Commission includes the request filed with NeuStar as a confidential document. CenturyLink’s Application asserts that the denial by NeuStar triggers the waiver process as outlined in Federal Communications Commission Numbering Optimization Orders. The FCC permits a waiver of the kind now requested by CenturyLink when there is a demonstrated need,such as a specific customer request for numbers.FCC Orders delegate authority to hear requests for waivers to state commissions and recommends that commissions act expeditiously. Staff reviewed CenturyLink’s waiver Application and the available number resources in the Nampa rate center,and contacted the customer requesting the full NXX to discuss their specific resource demand.After discussions with CenturyLink and the customer,it was determined that the customer’s request could be satisfied with seven of the ten blocks within the code.They agreed to return three of the blocks to the pooi.This will fulfill the customer’s request ORDER NO.33493 1 and provide numbers to the Nampa rate center for future requests.Staff contacted CenturyLink to discuss the specifics of the arrangement and instructed CenturyLink to contact NeuStar and reserve the 208-205 NPA.Staff opined that this would satisfy the customer’s request and help preserve 208 inventory that is rapidly approaching exhaust. CenturyLink states that the customer is a single entity that needs these numbers as a result of expansion of its business.These numbers will be held solely by this requesting customer, enabling it to expand its business and meet its specific customer needs.Staff recommended the Commission approve CenturyLink’s Petition for a waiver for the NPA NXX of 208-205 with the understanding that the Company will assign the first seven blocks and return the remaining three to the pool. After reviewing CenturyLink’s Application,the Commission finds it appropriate to approve the waiver request filed by CenturyLink.The requested number assignment is necessary for CenturyLink to meet the needs of its customer,and granting the request will facilitate the business expansion of the customer.Accordingly,the Commission finds it reasonable to direct that NeuStar release the NPA NXX of 208-205. ORDER IT IS HEREBY ORDERED that CenturyLink’s request for a waiver of the FCC’s Numbering Optimization Requirement is approved. IT IS FURTHER ORDERED that NeuStar release the NPA NXX of 208-205 number block in the Nampa,Idaho rate center to CenturyLink to satisfy the request of a CenturyLink customer. THIS IS A FINAL ORDER.Any person interested in this Order may petition for reconsideration within twenty-one (21)days of the service date of this Order.Within seven (7) days after any person has petitioned for reconsideration,any other person may cross-petition for reconsideration.See Idaho Code §6 1-626.
