HomeMy WebLinkAbout11v98.docxMINUTE ENTRY BILL CLARK’S COMPLAINT REGARDING U S WEST RESIDENTIAL VOICE MESSAGING SERVICE On November 17, 1998, the Commission reviewed Mr. Clark’s complaint.  As set out in Judy Stokes’ decision memorandum and attachments, Mr. Clark expressed dissatisfaction with the Company’s response to his voice messaging service complaint.  Mr. Clark requested that the Commission review this matter as a formal complaint. Upon our review, the Commission finds that it has no subject matter jurisdiction over the complaint.  Idaho Code §§ 61-121(2) and 62-603(13) provides that voice messaging services “shall not be subject to the provisions of title 61, Idaho Code, or title 62, Idaho Code.”   Consequently, the Commission is without jurisdiction to resolve Mr. Clark’s complaint.
