FOR RELINQUISHMENT OF ITS DESIGNATION AS AN ELIGIBLE TELECOMMUNICATIONS CARRIER ) CASE NO. WST-05- ) ORDER NO. 32053 On July 30 2010, WWC Holding Company, Inc. filed a Notice of Relinquishment of its designation as an eligible telecommunications carrier (ETC). The Commission approved ETC designation for WWC, doing business as Cellular One, in May 2005. The ETC designation was only in non-rural telephone company service areas of Qwest Corporation. WWC's notice states that the Company, through a series of transactions, became a subsidiary of Cellco Partnership dba Verizon Wireless in 2009. As a condition of the transaction, Verizon Wireless is required to relinquish its network and other assets in certain designated areas, including the area for which WWC is designated an ETC in Idaho. As a result, WWC no longer has any customers in its ETC designated area. Idaho Code 9 62-610D(4) states the Commission "shall permit an eligible telecommunications carrier to relinquish its designation as such a carrier in any area served by more than one eligible telecommunications carrier." The Commission is also required to ensure that customers of the withdrawing company will continue to be served by another ETC provider. WWC states it satisfies the statutory requirements because Qwest currently is a provider in the designated area, WWC has provided notice as required by statute, and it currently has no customers that require Commission assurance of continued service. WWC requests that the Commission issue an Order acknowledging that it properly relinquished and is relieved of its designation as an eligible telecommunications carrier. Staff reviewed WWC's Application and recommended the Commission issue an Order finding that WWC has complied with the statutory requirements for withdrawal of its ETC designation. At its Decision Meeting on August 23, 2010, the Commission determined that WWC satisfied the statutory conditions for relinquishment of its ETC designation in Idaho. ORDER NO. 32053 ORDER IT IS HEREBY ORDERED that WWC Holding Company, Inc., having met the statutory requirements for relinquishment of its designation as an eligible telecommunications carrier, is no longer an ETC designated carrier in the State of Idaho. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date of this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code 9 61-626.
