On December 28,2012,Zayo Group,LLC and 360networks (USA)inc.,requested that
360networks’Certificate of Public Convenience and Necessity (CPCN)No.453 issued by the
Commission on December 7,2005,be cancelled.
Zayo and 36Onetworks stated that pro forma intra-company mergers will result in the
assets and customers of 360networks moving to Zayo Group,LLC.The parties stated that these
changes are part of a series of intra-company transactions that will simplify the corporate structure of
Zayo and align the portions of the business with 360networks more closely with the business
structure of Zayo and Onvoy.Staff reviewed the request and believes the Company’s goal to
simplify the corporate structure will benefit its customers.In its Decision Meeting on February 25,
2013.the Commission approved 360networks’request for cancellation of Certificate No.453.
COMMISSION FINDINGS
In September 2005,360networks (USA)inc.filed an Application for a CPCN to provide
facilities-based competitive local exchange telecommunications services to commercial subscribers
and exchange access services to interconnecting carriers in Qwest and Verizon exchanges.In
December 2005,the Commission granted 360networks’Application for a CPCN.Order No.29925.
On December 28,2012,Zayo and 3ó0networks requested the Commission cancel
3ô0networks’Certificate and stated 360networks merged with Zayo Group,LLC.Staff
recommended the Commission cancel Certificate No.453 and remove the Company’s price list or
tariff on file.
ORDER
IT IS HEREBY ORDERED that 360networks (USA)inc.’s request for cancellation of
Certificate of Public Convenience and Necessity No.453 is granted.Certificate No.453 is no longer
in effect,and 360networks is no longer authorized to provide telecommunications services in the
State of Idaho.
