HomeMy WebLinkAbout20120905final_order_no_32633.pdfOffice ofthe Secretary Service Date September 5,2012 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF THE PETITION OF ) FRONTIER COMMUNICATIONS )CASE NO.VZN-T-12-O1 NORTHWEST INC.FOR A WAIVER OF ) FCC THRESHOLD REQUIREMENTS FOR ) NUMBERING RESOURCES FOR COEUR )ORDER NO.32633 D’ALENE,IDAHO ) On August 16,2012,Frontier Communications Northwest Inc.filed a Petition requesting that the Commission grant a waiver of FCC threshold requirements for numbering resources in the Coeur d’Alene,Idaho rate center.Frontier is deploying a new VoIP switch and is requesting the issuance of a new local routing number (LRN).Local routing number is a 10- digit telephone number that identifies a particular switch and is required for local number portability.The issuance of an LRN requires that a full NXX code,comprised of 10,000 numbers,be opened in the rate center.The Company indicated it will only need one block,or 1,000 numbers,and that the rest of the code will be returned to the pool. On July 30,2012,Frontier submitted a New Code application form to NeuStar that was denied because the months to exhaust (MTE)and/or usage threshold calculations for the Coeur dAlene rate center had not been met.The Company requires an LRN for the new switch; therefore,it is requesting a formal waiver from this Commission.Federal regulations allow a carrier to appeal a NANPA decision to withhold numbering resources to the appropriate State commission.The Commission may overturn NANPA’s decision”based on its determination that the carrier has demonstrated a verifiable need for numbering resources and has exhausted all other available remedies”See 47 U.S.C.§52.15(g)(3)and (4). Frontier participates in the 1,000-block pooling within its various rate centers in Idaho.After evaluating Frontie?s waiver request,the Commission finds that granting this waiver will not have any detrimental effect on the numbering resources in the Coeur dAlene rate center. Frontier has demonstrated it needs the waiver to meet number portability requirements.The Commission has granted waivers in the past to meet similar needs of other carriers. ORDER NO.32633 1 ORDER IT IS HEREBY ORDERED that Frontier Communications Northwest Inc.’s request for a waiver of FCC threshold requirements for numbering resources in the Coeur d’Alene,Idaho rate center is approved. THIS IS A FINAL ORDER.Any person interested in this Order may petition for reconsideration within twenty-one (21)days of the service date of this Order.Within seven (7) days after any person has petitioned for reconsideration,any other person may cross-petition for reconsideration.See Idaho Code §6 1-626.
