FOR CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO PROVIDE LOCAL EXCHANGE SERVICES WITHIN THE STATEOF IDAHO. CASE NO. VYC-05- ORDER NO. 29830 On April 5 , 2005, V ycera Communications, Inc. filed an Application for a Certificate of Public Convenience and Necessity (CPCN) to provide resold local exchange telecommunications services throughout Qwest's service territory in the State of Idaho. The Company amended its Application with a revised price list filed with the Commission on June 3 2005. On June 16, 2005, the Commission solicited comments regarding Vycera s Application. See Order No. 29803. No comments were received other than those submitted by Commission Staff.After reviewing the Application and comments, the Commission approves the Application. THE APPLICATION Vycera plans to provide flat-rated local exchange service in combination with long distance packages and other vertical features to residential customers. V ycera plans to offer these services by reselling Qwest products. Vycera is a California corporation with its principal offices located in San Diego California. V ycera is authorized by the Idaho Secretary of State to transact business within the State of Idaho and has a registered agent for service in Idaho. Vycera is the parent corporation of Televas Comunicaciones S.A. de C., a wholly-owned subsidiary of Vyceras. Televas is a telemarketing company located in Mexico. Vycera currently has certificates to provide competitive local exchange service in California, Colorado, Nevada, New Mexico, Oregon, Texas, and Washington. When this Application was filed, V ycera had additional certificates pending in Utah and Arizona. Vycera owns and operates two long distance switches - one in Los Angeles California and the other in Dallas, Texas - which it uses to provide some interexchange interstate services. The Company does not anticipate collecting deposits, and therefore requests ORDER NO. 29830 a waiver of that portion of Commission Order No. 26665 that requires an escrow account be established. ST AFF COMMENTS In its evaluation of Vycera s Application, Staff determined the Company s filing complies with the requirements of the Commission. See Procedural Order No. 26665; IDAPA 31.01.01.111 and 112 (Rules III and 112). Staff believes that the Company understands and agrees to comply with the Commission rules and requirements. Staff further believes that the Company possesses the requisite financial, managerial , and technical qualifications necessary to operate as a provider of telecommunications services. Therefore, based on its review of the Application, Commission Staff recommended approval of the Application for a Certificate. COMMISSION FINDINGS Based upon our review of the filing and the record in this case, the Commission finds that Vycera s filing satisfies the requirements of the Commission s Rules and Procedural Order No. 26665. Thus, we approve Vycera s Application for a Certificate of Public Convenience and Necessity to allow the Company to provide telecommunications services throughout Qwest's service territory within the State of Idaho. We also waive the escrow account requirement on the condition that the Company does not collect deposits from its Idaho customers. ORDER IT IS HEREBY ORDERED that the Application ofVycera Communications, Inc. for a Certificate of Public Convenience and Necessity is granted to enable the Company to provide resold local exchange services throughout Qwest's service territory within the State of Idaho. THIS IS A FINAL ORDER. Any person interested in the Order may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code 99 61- 626 and 62-619.
