VOL-03- OF VOLO COMMUNICATIONS OF IDAHO, INc. FOR A CERTIFICATE OF PUBLIC NOTICE OF APPLICATION CONVENIENCE AND NECESSITY TO PROVIDE LOCAL EXCHANGE NOTICE OF MODIFIED TELECOMMUNICATIONS SERVICES.PROCEDURE ORDER NO. 29400 NOTICE OF APPLICATION YOU ARE HEREBY NOTIFIED that on November 17, 2003 , Yolo Communications of Idaho, Inc. ("V 010" or "Company ) filed an Application for a Certificate of Public Convenience and Necessity to provide facilities-based and resold competitive local exchange and interexchange services within the State of Idaho. Principally located in Altamonte Springs, Florida, V 010 is a subsidiary of V 010 Communications, Inc., which is a wholly owned subsidiary of Caerus, Inc. V 010 is incorporated in the State of Delaware. YOU ARE FURTHER NOTIFIED that Yolo requests authority to provide competitive local exchange carrier ("CLEC") services through a combination of facilities owned by it and the resale of exchange services of other carriers.The Company seeks authority to provide these services in the service territories of Qwest Corporation and Verizon Northwest Inc. According to its Application, V 010 has completed interconnection agreement negotiations with BellSouth, Sprint, and is currently completing negotiations with Verizon. YOU ARE FURTHER NOTIFIED that Yolo proposes to offer CLEC servIces through the use of one or more switches which it proposes to purchase and facilities through the resale of other Qwest, Verizon, or CLEC local services such as local transport and termination. Other than the installation and provisioning of one or more switches in office buildings, V 010 does not at this time propose any "outside" construction such as the installation of fiber optic cable either underground or on existing utility poles. Yolo s CLEC services will include both voice and data communications services. NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 29400 YOU ARE FURTHER NOTIFIED that Yolo plans to initially offer its CLEC services to carrier and business customers in select Idaho locations, although the Company initial marketing efforts will be focused on the carrier market. However, V 010 requests statewide authority so that it may rapidly respond to new and changing market conditions and the need for CLEC services in other parts of the state. YOU ARE FURTHER NOTIFIED that Yolo s Application states that prior to offering services as a certificated telecommunications provider, V 010 will submit a signed copy of an escrow account with a bonded escrow agent or a security bond. The Application states that the escrow or bond shall be sufficient to meet customer deposit refunds in case of company default. YOU ARE FURTHER NOTIFIED that the Application states that Yolo has reviewed all of the Commission rules and agrees to comply with them or make a request for waiver of those rules believed to be inapplicable. NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter and will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Idaho Public Utilities Commission s Rules of Procedure, IDAPA 31.01.01.201 through .204. YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this Application may file a written comment in support or opposition with the Commission within twenty-one (21) days from the service date of this Notice. The comment must contain a statement of reasons supporting the comment. Persons desiring a hearing must specifically request a hearing in their written comments. YOU ARE FURTHER NOTIFIED that if no written comments or protests are received within the time limit set, the Commission will consider this matter on its merits and enter its Order without a formal hearing. If written comments are received within the time limit set, the Commission will consider them and, in its discretion, may set the same for formal hearing. YOU ARE FURTHER NOTIFIED that the Application together with supporting workpapers, testimonies and exhibits, have been filed with the Commission and are available for public inspection during regular business hours at the Commission offices. The Application and Amendment are also available on the Commission s Web site at www.puc.state.id.under the File Room" icon. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission s jurisdiction under Titles 61 and 62 of the Idaho Code and that the Commission may enter any final Order consistent with its authority under the Idaho Code. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission s Rules of Procedure, IDAP A 31.01.01.000 et seq. ORDER IT IS HEREBY ORDERED that the Application of V 010 Communications of Idaho Inc. for a Certificate of Public Convenience and Necessity be processed by Modified Procedure IDAPA 31.01.01.201-204. Persons interested in submitting written comments in this matter should do so no later than 21 days from the service date of this Order.
