SECTION 1.0 - DEFINmONS
For the purpose of th tarif, the followig defitions wi apply:
Access Line - An arangement which connects the Customer's location to a caret s switchig center or
point of presence.
Account Codes - Optional, Customer-defied digits that alow the Customer to identi the individual user,
department or client associated with a cal. Account Codes appear on the Customer bil.
Advance Payment - Par or all of a payment requied before the stat of service.
Authorized User - A person, fim, corporation, or any other entity authorid by the Customer to
communcate utiing the Company's service.
Business - A class of servce provided to individual engaged in business, fi, partnerships, corporations,
agencies, shops, works, tenats of offce buidigs, and individual practicig a profession or operatig a
business who have no offces other than their residences and where the use of the service is priary or
substatialy of a business, professional or occupational nature.
Commission - Idaho Public Utities Commsion.
Company or Carer - Velocty The Greatet Phone Company Ever, Inc., uness otherwe clearly indicate
by the context.
Customer - The person, fim, corporation or other entity which orders, cancels, amends or us servce and is
responsible for payment of charges and complice with the Company's ta.
Deposit - Refers to a cash or equivalent of cash sety held as a guarante for payment of the charges.

SECTION 1.0 - DEFINITIONS (CONTINUED)
DID Tru - A form of local switced access that provides the abilty for an outside par to call an intern
extension directly without the intervention of the Company operator.
Dial Pulse (or "DP") - The pule tye employed by rotary di station sets.
Dual Tone Multi-Frequency (or "DTMF") - The pul tye employed by tone dia station sets.
End User - Any person, fi, corporation, parership or other entity which uses the servces of the
Company under the provisions and regulations of th ta. The End User is responsible for payment
uness the charges for the services utied are accepted and paid for by another Customer.
End Ofice - With respet to each NP A-NXX code prefi assigned to the Company, the location of the
Company's "end offce" for purposes of th tari shal be the point of interconnecon associate with that
NP A-NXX code in the Local Exchange Routig Guide ("LERG"), issued by Bellcore.
Hearng Impaied - Those persons with communcation impaiments, includig those hearing impaired,
deaf, deaf/blid, and speeh impaied persons who have an impaiment that prevents them from
communcatig over the telephone without the aid of a telecommuncations device for the deaf.
Hunting - Route a cal to an idle station lie in a prearranged group when the caled station lie is busy.
In-Only - A servce attibute that restrcts outward dia access and routes incomig cal to a designted
anwer point.
IXC or Interexchange Carer - A long ditace telecommuncations servces provider.

LATA - A Local Access and Tranport Area establihed pursuant to the Modifcation of Final Judgement
entered by the United States District Cour for the Distrct of Columbia in Civil Action No. 82-0192; or any
other geographic area designted as a LATA in the National Exchge Carer Assocation, Inc. Tarif F.c.c.
No.4.
LEC - Local Exchange Company
Miimum Point of Presence ("MPOP") - The mai telephone closet in the Customer's building.
Monthly Recurng Charges - The monthy charges to the Customer for services, facilties and equipment,
which contiue for the agreed upon duration of the service.
Multi-Frequency or ("MF") - An inter-machie pulse tye usd for signalig between telephone switces, or
between telephone switches and PBX/key systems.
Non-Recurng Charge ("NRC") - The intial charge, usually assessed on a one-tie basis, to intiate and
establih servce.
Other Telephone Company - An Exchange Telephone Company, other than the Company.
PBX - Private Branch Exchange
Premises - A buidig or buildigs on contiguous propert.
Recurng Charges - The monthy charges to the Customer for services, facilties and equipment which
contiue for the agreed upon duration of the servce.
Residence or Residential - A class of servce fuhed to a Customer at a place of dwellg where the actual
or obvious use is for domestic puroses.

Servce Commencement Date - The fist day followig the date on which the Company noties the
Customer that the requested service is avaiable for use, uness extended by the Customer's refual to accept
service which does not conform to stadards set forth in the Servce Order and th taif, in which case the
Service Commencement Date is the date of the Customer's acceptace. The Company and Customer may
mutualy agree on a substitute Service Commencement Date.
Servce Order - The wrttn request for services exected by the Customer and the Company in the format
devised by the Company. The signg of an Order by the Customer and acceptace by the Company
intites the respective obligations of the parties as set fort therein and pursuant to th tarif, but the
duration of the service is calculated from the Servce Commencement Date.
Telecommunications Company or Provider - Used thoughout th ta to mean Velocity The Greatest
Phone Company Ever, Inc. uness clearly indicated otherwe by the text.
TBD - To Be Determied.
Two Way - A service attibute that includes outward dial capabilties for outbound cal and can also be
used to carry inbound cal to a central point for futher processing.
Usage Based Charges - Charges for miutes or messages traversing over local exchange facilties.
User or End User - A Customer, Joint User, or any other person authorid by a Customer to use service
provider under th tariff.

SECTION 2.0 - RULES AND REGULATIONS
2.1 Undertakng of the Company
2.1.1 Scope
The Company undertaes to fuh communcations service pursuant to the terms of th
taif in connection with one-way and/or two-way inormation tranmision origitig
from points with the State of Idaho, and termiatig with a local callg area as defied
herein.
The Company is responsible under th ta only for the servces and facilties provided
hereunder, and it assumes no responsibilty for any servce provided by any other entity
that purchases access to the Company network in order to origiate or termate its own
servces, or to communcate with its own Customers.
2.1.2 Shortage of Equipment or Facilities
(A) The Company reserves the right to lit or to alocate the use of exitig facilties,
or of additional facilties offered by the Company, when necessary beause of lack
of facilties, or due to some other cause beyond the Company's control.
(B) The fuhig of servce under th taif is subject to the availabilty on a
contiuing basis of al the necessary facilties and is lited to the capacity of the
Company's facilties as well as facilties the Company may obta from other
cariers to fuh service from tie to tie as requied at the sole dicretion of the
Company.

2.1 Undertaking of the Company, (Contd.)
2.1.3 Term and Conditions
(A) Service is provided on the basis of a mium period of at least one month, 24hours per day. For the purpose of computig charges in th tarif, a month is
considered to have thty (30) days.
(B) Customers may be required to enter into writtn servce orders which shal conta
or reference a specifc desription of the servce ordered, the rate to be charged, the
duration of the servces, and the terms and conditions in th taif. Customers wi
alo be required to execte any other documents as may be reasonably requested
by the Company.
(C) Except as otherwe stated in the ta, at the expiration of the intial term speced
in each Service Order, or in any extension thereof, service shal contiue on a month
to month basis at the then current rates uness termated by either par upon
proper notice. Any termation shal not relieve the Customer of its obligation to
pay any charges incued under the service order and th tari prior to
termiation. The rights and obligations which by their nature extend beyond the
termition of the term of the service order shal survve such termation.
(D) Service may be termiated upon written notice to the Customer if:
(1) the Customer is using the servce in violation of th ta; or
(2) the Customer is using the servce in violation of the law.
(E) Th tarif shal be interpreted and governed by the laws of the State of Idaho
without regard for its choice of laws provision.

(F) Any Oter Telephone Company may not interfere with the right of any person or
entity to obta service diectly from the Company. No person or entity sha be
requied to make any payment, incu any penalty, moneta or otherwe, or
purchase any servces in order to have the right to obta service direcy from the
Company.
(G) Reserved for futue use.
(H) The Company hereby reserves its rights to establih servce packages specifc to a
particulr Customer. These contracts mayor may not be assocted with volume
and/ or term discounts.

2.1 Undertakig of the Company, (Contd.)
2.1.4 Limtations on Liabilty
(A) The liabilty of the Company for damages arising out of the furnhig of its
Service, including but not liited to mistakes, omisions, interruption, delay, or
errors, or other defects, representations, or use of these services or damages
arising out of the failure to furnh the service, whether caused by acts or
omision, shall be lited to the extension of allowances for interruption as set
forth in 2.7. The extension of such allowances for interruption shall be the sole
remedy of the Customer and the sole liabilty of the Company. The Company
wil not be liable for any direct, indirect, incidental, special, consequential, lost
profits, exemplary or puntive damages to Customer as a result of any Company
service, equipment or facilties, or the acts or omissions or negligence of the
Company's employees or agents.
(B) The Company's liabilty for will misconduct, if establihed as a result of
judicial or admintrative proceedings, is not lited by this tarif. The
Company's liabilty, if any, with regard to delayed intallation of Company
facilties or commencement of service, shall not exceed $1,000. With respect to
any other claim or suit, by a Customer or by any others, for damage associated
with the ordering (including the reservation of any specifc number for use with a
service), intaation (including delays thereof), provision, termination,
maintenance, repai, interruption of restoration of any service or facilties offered
under th tari, and subject to the provisions of Setion 2.7, the Company's
liabilty, if any, shall be lited as provided herein.
(C) The Company shall not be liable for any delay or failure of performance or
equipment due to causes beyond its control, including but not lited to: acts of
God, fire, flood, explosion or other catastrophes; and law, order, regulation,
direction, action or request of the United States government or of any other
government, including state and local governents having or claimg
jurisdiction over the Company, or of any department, agency, commission,
bureau, corporation or other intrmentality of anyone or more of these federal,
state, or local governents, or of any mitary authority; preemption of existig
service in compliance with national emergencies; inurrections; riots; wars;
unavailabilty of rights-of-way or materials, or strikes, lockouts, work stoppages,
or other labor dificulties.

(D) The Company shall not be liable for (a) any act or omission of any entity
furnhig the Company or the Company's Customers facilties or equipment
used for or with the services the Company offers; or (b) for the acts or omisions
of common carriers or warehousemen. Except in 31.41.01 Rule 501, 502, and 503
oftheIDAPA.
(E) The Company shall not be liable for any damages or losses due to the fault ofnegligence of the Customer or due to the failure or malfction of Customer-
provided equipment or facilties.
(F) The Customer shall indemn and hold the Company harmless from any and all
loss, claim, demands, suits, or other action, or any liabilty whatsoever, whether
sufered, made, intituted, or asserted by any other party or person(s), and for
any loss, damage, or destrction of any property whether owned by the
Customer or others, caused or claimed to have been caused directly or indirectly
by the intallation, operation; failure to operate, maintenance, removal, condition,
location, or use of intallation provided by the Company. The Company reserves
the right to require each Customer to sign an agreement acknowledgig
acceptance of the provisions of th section as a condition precedent to such
intallations.
(G) The Company shal not be liable for any defacement of or damage to Customer
premies resultig from the fuhing of servces or equipment on such premies
or the intallation or removal thereof, uness such defacement or damage is
caused by gross negligence or wil miconduct of the Company's agents or
employees. No agents or employees of other participatig carriers shall be
deemed to be agents or employees of the Company.
(H) Notwithtadig the Customer's obligations, the Company shall be indemned,
defended, and held harmless by the Customer or by others authorized by it to
use the service againt any claim, loss of damage arising from Customer's use of
services furnhed under th tariff, including: claim for libel, slander, invasion
of privacy or iningement of copyright arising from the material, data,
inormation, or other content tranmitted via the Company's service; and patent
iningement claim arising from combing or connectig the service offered by
the Company with apparatus and systems of the Customer or others. All other
claims arising out of any act or omision of the Customer or others, in connection
with any service provided by the Company pursuant to th tariff.

(I) The entie liabilty of the Company for any claim, loss, damage or expense fromany cause whatsoever shall in no event exceed sums actually paid to the
Company by Customer for the specifc services giving rise to the claim, and no
such action or preceding againt the Company shall be commenced more than
one year after the servce is rendered.
0) The Company makes no warranties or representations, express or implied,
including warranties of merchantabilty or fitness for a particular use, except
those expressly set forth herein.
(K) The Company shall not be liable for any act or omission of any other company or
companes furnihig a porton of the service, or for damages associated with
service, channels, or equipment which it does not furnih, or for damages which
result from the operation of Customer-provided systems, equipment, facilties or
services which are interconnected with Company services. Except in 31.41.01
Rule 501, 502, and 503 of the IDAP A.
(L) The Company does not guarantee nor make any warranty with respect to service
intallations at locations at which there is present an atmosphere that is
explosive, prone to fie, dangerous or otherwise unsuitable for such intallations.
The Customer shall indemn and hold the Company harmless from any and all
loss, clai, demands, suits or other action, or any liabilty whatsoever, whether
suffered, made, intituted or asserted by the Customer or by any other party, for
any personal injur to, or death of, any person or persons, or for any loss,
damage or destrction of any property, whether owned by the Customer or
others, caused or claimed to have been caused, directly or indirectly, by the
intallation, operation, failure to operate, maintenance, removal, presence,
condition, locations or use of service furnhed by the Company at such locations.

(M) With respect to Emergency Number 911 Service:
(a) This service is offered solely as an aid in handing assistace call in
connection with fie, police and other emergencies. The Company is not
responsible for any losses, claim, demands, suits or any liabilty whatsoever,
whether sufered, made, intituted or asserted by the Customer or by any
other party or person for any personal injury to or death of any person or
persons, and for any loss, damage or destrction of any property, whether
owned by the Customer or others, caused or claimed to have been caused by:
(1) mitakes, omisions, interruptions, delays, errors or other defects in the
provision of th service, or (2) intaation, operation, failure to operate,
maintenance, removal, presence, condition, location or use of any equipment
and facilties furnhing this service.
(b) The Company is not responsible for any inringement or invasion of the right
of privacy of any person or persons, caused or claimed to have been caused,
directly or indirectly, by the intallation, operation, faiure to operate,
maintenance, removal, presence, condition, occasion or use of emergency 911
service features and the equipment associated therewith, or by any services
fuhed by the Company including, but not lited to, the identication of
the telephone number, address or name associated with the telephone used
by the party or parties accessing emergency 911 service, and which arise out
of the negligence or other wrongfl act of the Company, the Customer, its
users, agencies or municipalities, or the employees or agents of anyone of
them.
(N) The Company's liabilty arising from errors or omisions in Directory Listigs,
other than charged litig, shall be lited to the amount of actual impairment of
the Customer's service and in no event shall exceed one-half the amount of the
fixed monthy charges applicable to exchange service affected during the period
covered by the directory in which the error or omission occurs. In cases of
charged Directory Listigs, the liabilty of the Company shall be lited to an
amount not exceeding the amount of charges for the charged litigs involved
during the period covered by the directory in which the error or omision occurs.

(0) When a Customer with a non-publihed telephone number, as defied herein,
places a call to the Emergency 911 Service, the Company wil release the name
and address of the callg party, where such inormation can be determied, to
the appropriate local governenta authority responsible for the Emergency 911
Service, upon request of such governental authority. By subscribing to service
under this tarif Customer acknowledges and agrees with the release of
inormation as described above.
(P) The included tariff language does not constitute a determination by the
Commsion that a liitation of liabilty imposed by the Company should be
upheld in a court of law. Acceptace for fig by the Commission recognes
that it is a court s responsibilty to adjudicate negligence and consequential
damage clai. It is alo the court s responsibilty to determie the validity of
the exculpatory clause.
2.1.5 Notication of Servce-Afecting Actvities
The Company wi provide the Customer reasonable notication of servce-afectig
activities that may occu in normal operation of its business. Such activities may include,
but are not lited to, equipment or facilties additions, removal or rearangements and
routie preventative maitenace. Generaly, such activities are not specifc to an
individual Customer but afect many Customers' services. No specifc advance notication
period is applicable to al servce activities. The Company wi work cooperatively with the
Customer to determie the reasonable notication requiements. With some emergency or
unplaned servce-afectig conditions, such as an outage resultig from cable damage,
notication to the Customer may not be possible.

2.1.6 Provision of Equipment and Facilities
(A) The Company shal use reasonable efforts to maitain only the facilties and
equipment that it fuhes to the Customer. The Customer may not nor may theCustomer permt others to rearange, diconnect, remove, attmpt to repai, or
otherwe interfere with any of the facilties or equipment intaed by the
Company, except upon the writtn consent of the Company.
(B) The Company may substitute, change or rearange any equipment or facilty at any
tie and from tie to tie, but shal not thereby alter the tecal parameters of
the service provided by the Customer.
(C) Equipment the Company provides or intall at the Customer Premies for us in
connection with the services the Company offers shal not be used for any purpose
other than that for which the equipment is provided.
(D) Except as otherwe indicated, Customer provided station equipment at the
Customer's premies for use in connection with the service shal be so constrcted,
maitaed and operated as to work satifactoriy with the facilties of the
Company.
(E) The Company shal not be responsible for the intation, operation, or
maitenance of any Customer provided communcations equipment Where such
equipment is connected to the facilties fuhed pursuant to th taif, the
responsibilty of the Company shal be lited to the furnhig of facilties offered
under th ta and to the maintenace and operation of such facilties. Subject to
th responsibilty, the Company shal not be responsible for:
(1) the though tranmision of sign by Customer provided equipment or
for the quality of, or defects in, such tranmision; or
(2) the reception of sign by Customer-provided equipment; or
(3) network control signlig where such signalg is performed by Customer-
provided network control signg equipment.

2.1.7 Non-Routine Installation
At the Customer's request, intaation and/or maitenace may be performed outside the
Company's reguar business hours or in hazardous locations. In such cas, charges basd
on cost of the actual labor, material, or other costs incured by or charged to the Company
wi apply. If intalltion is started during regu business hours but, at the Customer's
request, extends beyond regula business hours into tie periods includig, but not lited
to, weekends, holidays, and/ or night hours, additional charges may apply.
2.1.8 Special Constrction
Subject to the agreement of the Company and to al of the reguations contained in th
taif, special constrction or facilties may be undertaken on a reasonable efforts basis at the
request of the Customer. Speial constrcton is constrction underten:
(A) where facilties are not presently avaible, and there is no other requiement for the
facilties so constrcted;
(B) of a tye other than that which the Company would normaly uti in thefuhig of its servces;
(C) over a route other than that which the Company would normaly uti in thefuhig of its servces;
(D) in a quantity greater than that which the company would normaly constrct;
(E) on an expedited basis;
(F) on a temporar basis unti permanent facilties are avaiable;
(G) involvig abnormal costs; or
(H) in advance of its normal constrction.

2.2 Prohibited Uses
2.2.1 The servces the Company offers shal not be used for any unawf purose or for any use
as to which the Customer has not obtaed all requied governenta approval,
authoriations, licenses, consents and permits.
2.2.2 The Company may requie applicants for servce who intend to use the Company's
offerigs for resale and/ or for shared use to fie a letter with the Company confmig that
their use of the Company's offerings complies with relevant laws and the Idaho
Commsion's reguations, policies, orders, and decisions.
2.2.3 The Company may block any signal being tranmittd over its Network by Customers
which cause interference to the Company or other users. Customer shall be relieved of al
obligations to make payments for charges relatig to any blocked Servce and shal
indemn the Company for any clai, judgment or liabilty resultig from such blockage.
2.2.4 A Customer, joint usr, or authorid user may not assign, or tranfer in any maner, the
service or any rights associated with the servce without the wrttn consnt of the
Company. The Company wi permit a Customer to tranfer its existig service to another
entity if the existig Customer has paid al charges owed to the Company for regulated
communcations services. Such a tranfer wi be treated as a diconnection of exitig
service and intallation of new servce, and non-recrig intation charges as stated in
th tarif wi apply.

The Customer shall be responsible for:
(A) the payment of al applicable charges pursuant to th ta;
(B) damage to or loss of the Company's facilties or equipment causd by the acts or
omisions of the Customer; or the noncomplice by the Customer, with these
regulations; or by fie or theft or other casualty on the Customer Premies, uness
caused by the negligence or wil mionduct of the employee or agents of the
Company;
(C) providing at no charge, as speifed from tie to tie by the Company, any needed
equipment, space and power to operate Company facilties and equipmentintaed on the premis of the Customer, and the level of heatig and air
conditionig necessar to maita the proper operatig environment on such
premies;
(D) obtag, maintag, and otherw havig fu responsibilty for all rights-of-way and conduit necessar for intation of fiber optic cable and associated
equipment used to provide Communcations Servces to the Customer from the
cable buildig entrance or property lie to the location of the equipment space
described in Setion 2.3.1(C). Any and all costs associated with the obtag and
maintag the rightsof-way described herein, including the costs of alterig the
strctue to permt intallation of the Company provided facilties, shal be borne
entiely by, or may be charged by the Company, to the Customer. The Company
may require the Customer to demonstrate its complice with th section prior to
acceptig an order for service.

equipment. The Customer may be requied to inta and maita Companyfacilties and equipment with a hazardous area if, in the Company's opinon,
injur or damage to the Company employees or propert might result from
intaation or maitenace by the Company. The Customer shal be responsible
for identig, monitorig, removing and diposing of any hazdous material
(e.g., frable asbestos) prior to any constrction or intaation work;
(F) complyig with all laws and reguations applicable to, and obtaing al consents,
approvals, licenses and permits as may be requied with respe to, the location of
Company facities and equipment in an Customer premies or the rightsof-way
for which Customer is responsible under Section 2.3.1(D); and grantig or obtag
permision for Company agents or employees to enter the premies of the
Customer at any tie for the purose of intag, inpectig, maitag,
repaiing, or upon termiation of servce as stated herein, removing the facilties or
equipment of the Company;
(G) not creatig or allowig to be placed any liens or other encumbrances on the
Company's equipment or facilties; and
(H) makg Company facilties and equipment avaible periodically for maitenace
puroses at a tie agreeable to both the Company and the Customer. No
alowance wi be made for the period durg which service is interrpted for such
purposes.

(B) To the extent caused by any negligent or intentional act of the Customer as
described in (A), preceding, the Customer shal indemn, defend and hold
harmless the Company from and againt all clai, actions, damages, libilties,
costs and expenses, including reasonable attorneys' fee, for (1) any loss,
destrction or damage to property of any thd par, and (2) any libilty incued
by the Company to any thd party pursuant to th or any other ta of the
Company, or otherwe, for any interrption of, interference to, or other defect in
any service provided by the Company to such thd party.
(C) The Customer sha not assert any cla againt any other Customer or user of the
Company's servces for damages resultig in whole or in party from or arising in
connection with the furnhig of service under th tari including but not lited
to mitakes, omisions, interrptions, delays, errors or other defects or
mirepresentations, whether or not such other Customer or user contrbuted in any
way to the occuence of the damages, uness such damages were causd solely by
the negligent to intentional act or omision of the other Customer or user and not
by any act or omision of the Company. Nothg in th tari is intended either to
lit or to expand Customer's right to assert any clai agait thd parties for
damages of any nature other than those described in the precedig sentence.

2.4 Customer Equipment and Channels
2.4.1 General
A user may tranmit or receive inormation or sign via the facilties of the Company. The
Company's services are designated priary for the tranmision of voice-grade telephonic
signls, except as otherwe stated in th ta. A user may tranmit any form of signal that
is compatible with the Company's equipment, but the Company does not guarante that its
servces wi be suitable for purposes other than voice-grade telephonic communcation
except as specifcally stated in th ta.
2.4.2 Station Equipment
(A) Terml equipment of the user's premi and the electrc power consumed by
such equipment shall be provided by and maitaed at the expense of the user.
The user is responsible for the provision of wiing or cable to connect its termal
equipment to the Company MPOP.
(B) The Customer is responsible for ensurig that Customer-provided equipment
connected to Company equipment and facilties is compatible with such equipment
and facilties. The magntude and character of the voltages and currents impressed
on Company-provided equipment and wig by connection, operation, or
maintenace of such equipment and wig shall be such as not to cause damage to
the Company-provided equipment and wiing or injury to the Company's
employees or to other persons. Any additional protetive equipment requied to
prevent such damage or injury shall be provided by the Company at the
Customer's expense, subject to prior Customer approval of the equipment expense.

2.4.3 Interconnecon of Facilties
(A) Local Trafc Exchange provides the abilty for another local exchange provider to termate
local trafc on the Company's network. In order to quali for Loal Trafc Exchange the
call must (a) be origited by an end user of a company that is authorid by the
Commsion to provide local exchange service; (b) origiate and termte with a local
calg area of the Company.
(B) Any special interface equipment necessar to achieve compatibilty between the faciltiesand equipment of the Company. used for fuhig Communcations Services and the
chanels, facilties, or equipment of others shal be provided at the Customer's expnse.
(C) Communcations Services may be connecd to the servces or facilties of other
communcations carers only when authorized by, and in accordance with, the terms and
conditions of the tarifs of the other communcations carers which are applicable to such
connections.
(D) Facities fuhed under th ta may be connected to Customer provided termial
equipment in accordance with the provisions of th tari. Al such termil equipment
shal be regitered by the Federal Communcations Commsion pursuant to Part 68 of Title
47, Code of Federal Reguations; and all user-provided wiing shall be intalled and
maintaed in compliance with those reguations.

2.4.4 Inspections
(A) Upon suitable notication to the Customer, and at a reasonable tie, the Company
may make such tests and inpections as may be necessar to determe that the
Customer is complyig with the requirements set fort in Setion 2.4.2(B) for the
intation, operation, and maitenance of Customer-provided facilties,
equipment, and wig in the connection of Customer-provided facities and
equipment to Company-owned facilties and equipment.
(B) If the protetive requirements for Customer-provided equipment are not being
complied with, the Company may tae such action as it deems necessary to protet
its facilties, equipment, and personneL. The Company wi noti the Customer
promptly if there is any need for fuer corrective action. With ten days of
receiving th notice, the Customer must tae th corrective action and noti the
Company of the action taen. If the Customer fail to do th, the Company may
take whatever additional action is deemed necessary, includig the suspension of
servce, to protet its facilties, equipment and personnel from harm.
(q If harm to the Company's network, personnel or servces is iment, the
Company reserves the right to shut down Customer's servce imediately, with no
prior notice requied.

2.6 Payment Arangements
2.6.1 Payment for Servces
The Customer is responsible for the payment of all charges for facilties and servces
furnhed by the Company to the Customer.
The Customer is responsible for the payment of federal excise taxes, state and local sales
and use taes and simar taxes imposed by governental jurdictions, al of which shal be
separately designated on the Company's invoices. Any taxes imposed by a local jurisdiction
(e.g., county and muncipal) wi only be recovered from those Customers residing in the
afected jurdictions.
2.6.2 Billng and Collection of Charges
The Customer is responsible for payment of al charges incued by the Customer or other
users for services and facilties fuhed to the Customer by the Company.
(A) Non-recrring charges are due and payable with th (30) days afer the date
the invoice is maied to the Customer by the Company.
(B) The Company shal present invoices for recrrg chrges monthy to the
Customer, in advance of the month in which service is provided, and recring
charges shal be due and payable with th (30) days afr the date the invoice is
maied to the Customer by the Company. When bilg is based upon Customer
usage, usage charges wi be biled monthy for the preceding bilg period.
(q When service does not begi on the fist day of the bilg period, or end of the last
day of the bilg period, the charge for the fraction of the month in which servce
was fuhed wi be calculated on a pro rata basis. For th purpose, every month
is considered to have thty (30) days.

(D) Bilg of the Customer by the Company wi begi on the Service Commencement
Date, which is the day on which the Company noties the Customer that the
servce or facilty is avaiable for use, except that the Service Commencement Date
may be postponed by mutual agreement of the parties, or if the servce or facilty
does not conform to stadards set fort in th ta or the Servce Order. Bilg
accrues though and includes the day that the servce, circut, arangement or
component is dicontiued.
(E) If any porton of the payment is not received by the Company with 30 days of
receipt of th bil, or if any portion of the payment is received by the Company in
fuds which are not imediately available upon presentment, then a late payment
charge of 1.5% per month shall be due to the Company. A late payment charge is
not applicable to subsequent rebilg of any amount to which a late payment
charge has aleady ben applied. Late payment charges are to be applied withoutdicrition.
(F) the Customer should noti the Company of any diputed items on an invoice
with sixty (60) days of receipt of the invoice. If the Customer and the Company
are unable to resolve the dipute to their mutual satifacton, the Customer may fie

Upon the Company's dicontiuance of servce to the Customer under Setion 2.6.3(A) or
2.6.3(B), the Company, in addition to all other remedies that may be avaiable to the
Company at law or in equity or under any other provision of th ta, may declare all
future monthy and other charges which would have ben payable by the Customer durg
the remainder of the term for which such services would have otherw ben provided to
the Customer to be imediately due and payable.
(A) Upon nonpayment of any amounts owig to the Company, the Company may

comply with the Telephone Customer Relations Rule.

(E) Upon any governenta prohibition or governenta requied alteration of the
services to be provided or any violation of an applicable law or regution, the

2.6.4 Notice to Company for Cancellation of Servce
Customers desirg to termate service shal provide the Company thty (30) days notice
of desire to termte servce. If special constrction is involved, the requied notice shal be

2.6.5 Cancellation of Application for Servce
(A) Where the Company permits the Customer to cancel an application for service prior
to the sta of servce or prior to any special constrcton, no charges wi be imposed
except for those specifed below.
(B) Where, prior to cancelltion by the Customer, the Company incus any expenes in
intag the servce or in preparing to inta the servce that it otherwe would not
have incured, a charge equal to the costs the Company incued, less net salvage,
shal apply, but in no case shal th charge exceed the sum of the charge for the
mium period of servces ordered, includig intation charges, and al charges
others levy againt the Company that would have been chargeable to the Customer
had service begu.
(C) Where the Company incus any expense in connection with specia constrction, orwhere special arangements of facilties or equipment have begu, beore the
Company receives a cancellation notice, a charge equal to the costs incured, less net
salvage, may apply. In such cases, the charge wi be basd on such elements as the
cost of the equipment, facilties, and materi, the cost of intaation, engieerig,
labor, and supervision, general and admtrative expense, other dibursements,
depreciation, maintenance, taxes, provision for retu on investment, and any other
costs associated with the specia constrction or arrangements.
(D) The specal charges described in 2.6.5(A) though 2.6.5(C) wi be calculated and
applied on a case-by-case basis.

2.6.6 Changes in Servces Requested
If the Customer makes or requests material changes in circut engieerig, equipment
specifcations, service parameters, premies locations, or otherwe materialy modies any
proviion of the application for servce, the Customer's intaation fee shal be adjusted
accordingly.
2.6.7 Bad Check Charge
A service charge of $20.00 wi be assesed for al checks returned by a ban or other
fiancial intitution for: Inufcient or uncollected fuds, closed account, apparent
tampering, mising signatue or endorsement, or any other inufciency or dicrepancy
necessitatig retu of the intrent at the dicretion of the drawee ban or other fiancial
intitution.
2.7 Allowances for Interrptions in Servce
2.7.1 General
Credit for Interruptions: When the use of service or facilties furnihed by the Company is
interrupted due to any cause other than the negligence or wil act of the Customer, or
the operation or failure of the facilties or equipment provided by the Customer, pursuant
to IDAPA 31.41.01 Rules 502 and 503 subject to interruption wi be allowed for the
service and facilties rendered useless and inoperative by reason of the interruption,
whenever said interruption contiues for a period of 24 hours or more from the tie the
interrption is reported to or known to exist by the Company, except as otherwe
specifed in the Company's taris. If the Customer reports a service, facilty or circuit to
be inoperative but declies to release it for testig and repair, it is considered to be
impaired, but not interrupted.
For calculatig credit allowances, every month is considered to have 30 days. A credit
allowance is applied pursuant to IDAPA 31.41.01 Rules 502 and 503 based on the rates
specified hereunder for Local Line or Local Tru Service and is dependent upon the
lengt of the interruption. Ony those facilties on the interrupted porton of the circuit
wi receive a credit. Credit allowances for service outages that exceed 24 hours in
duration wi be rounded up at the next whole 24 hours.

(C) If the Customer reports a service, facilty or cicut to be interrupted but declies to

the Company, the service, facilty or circut is considered to be impaied but not
interrupted. No credit allowances wi be made for a service, facilty or circuit
considered by the Company to be impaired.
(D) The Customer shal be responsible for the payment of service charges as set fort
herein for visits by the Companý s agents or employees to the premies of the
Customer when the service dicuty or trouble report results from the use of
equipment or facilties provided by any part other than the Company, including but
not lited to the Customer.
2.7.2 Limitations of Alowances
No credit allowance wi be made for any interrption in service:
(A) interruptions due to the negligence of, or noncompliance with the provisions of th
tariff by, the Customer, Authorized User, Joint-User, or other common carrier
providing service connected to the service of Company;
(B) interrptions due to the negligence of any person other than the Company
including, but not lited to, the Customer connected to the Company's facilties;
(C) interruptions due to the failure or malfnction of non-Company equipment;
(D) interruptions of service during any period in which the Company is not given fu
and free access to its facilties and equipment for the purpose of investigatig and
correctig interruptions;

(E) interruptions of service during a period in which the Customer contiues to use the
service on an impaied basis;
(F) interruptions of service during any period when the Customer has released service
to the Company for maintenance purposes or for implementation of a Customer
order for a change in service arrangements;
(G) interrption of service due to circumstaces or causes beyond the control of the
Company.
2.7.3 Use of Another Mean of Communcations
If the Customer elects to use another mean of communcations durg the period of
interrption, the Customer must pay the charges for the alternative service usd.
2.8 Cancellation of Servcelerration Liabilty
If a Customer cancels a servce order or termate services before the completion of the term for any
reason other th a servce interrption (as defied in Setion 2.7.1) or where the Company breaches
the terms in the servce contract, Customer may be requested by the Company to pay to Company
termition liabilty charges, which are defied below. These charges shal beome due and owig
as of the effective date of the cancelltion or termition and be payable with the period set forth
in Setion 2.6.2.
2.8.1 Termination Liabilty
Customer's termtion liabilty for cancellation of service shall be equal to:
(A) all unpaid non-recurrg charges reasonably expended by Company to establih
service to Customer, plus;
(B) any diconnection, early cancellation or termition charges reasonably incured and
paid to thd pares by Company on behalf of Customer, plus;
(C) all recg charges speifed in the applicable Service Order for the balance of the
then cuent term disounted at the prie rate anounced in the Wall Street Journal on
the thd business day followig the date of cancelltion;
(D) mius a reasonable alowance for costs avoided by the Company as a direct result of
Customer's cancelltion.

2.9 Transfers and Assignments
Neither the Company nor the Customer may assign or tranfer its rights or duties in connection with
the services and facilties provided by the Company without the wrttn consnt of the other party,
except tht the Company may assign its rights an duties to a) any subsidiary, parent company or
afate of the Company; b) pursuant to any sale or tranfer of substatialy al the assets of the
Company; or c) pursuant to any fiancing, merger or reorgantion of the Company.
2.10 Flexible Pricing
Notice to Customers of rate changes shall be made in accordance with Idaho Code 62-606. Where
there are no regulations, notication wil be made in a manner appropriate to the circumstaces
involved. A Customer can request that the Company disconnect service that is provided under
the Flexible Pricing due to a price increase. The customer wil be credited for the diference
between the new price and the old price retroactive to the effective date of the price increase if the
customer noties the Company of its desire to disconnect service with 20 days of receiving
notiication of the price increase.

5.3.1 Distace between two points is measured as airlie distace between the rate centers of the
origiatig and termiatig telephone lies. The rate center is a set of geographic
coordinates, as referenced in Local Exchange Routig Guide issued by Bellcore, associated
with each NP A-NX combintion (where NP A is the area code and NX is the fist thee
digits of a seven-digit telephone number). Where there is not telephone number assocted
with an access lie on the Companýs network (such as a dedicated 800 or WATS access
lie), the Company wi apply the rate center of the Customers main bilg telephone
number.
5.3.2 The airlie distace between any two rate centers is determed as follows:
Step 1: Obta the "V" (vertical) and "H" (horionta) coordiates for each Rate Center
from the above-referenced Bellcore docuent.
Step 2: Computer the dierence between he "V" coordinate of the two rate centers; and
the dierence between the two "H" coordinates.
Step 3: Square each diference obtaed in step (b) above.
Step 4: Add the square of the "V" diference and the square of the "H" dierence
obtaed in step C) above.
Step 5: Divide the sum of the squares by 10. Round to the next higher whole number if
any fraction is obtained.
Step 6: Obta the square root of the whole number result obtaed above. Round to the
next higher whole number if any fracton is obtaed. Th is the airlie mieage.

The Stadard Residence Line provides a Customer with a single, analog, voice-grade telephonic
communcations chanel, which can be usd to place or receive one cal at a tie. Stadard
Residence Lines are provided for the connection of Customer-provided wig and single station
sets or facsime machies.
5.6 Standard Business Line
The Stadard Business Line provides a Customer with a single, analog, voice-grade telephonic
communcations chanel, which can be used to place or receive one call at a tie. Stadard
Business Lines are provided for the connection of Customer-provided wiing and single station sets
or facsime machies. An optiona per lie Huntig feature is available for multi-lie Customers
which routes a cal to an idle station lie in a prearanged group when the caled station lie is busy.
5.7 PBX Tru Servce
Basic PBX Tru Service provides a Customer with a single, voice-grade telephonic communcations
chanel, which can be used to place or receive one cal at a tie. Basic Tru are provided for
connection of Customer-provided private branch exchanges (pBX) to the public switched
telecommuncations network. Each Basic PBX Tru is provided with touch-tone signalg and may
be confgued into a hunt group at no additional charge with other Company-provided Basic PBX
Tru. The signal is an analog signal at the DSO leveL.
5.8 Reserved for Futue Use
5.9 Direct Inward Dialing (DID) Servce
Direct Inward Diag ("DID") permts cal incomig to a PBX system or other Customer Premies
Equipment to be routed to a speifc station without the assistace of an attndant. DID cal are
routed directly to the station associated with the called number. DID servce as offered by the
Company provides the necessar tr, telephone numbers, and out-pulsing of digits to enables
DID servce at a Customer s location. DID service requies specia PBX softare and hardware not
provided by the Company. Such hardware and softare is the responsibilty of the Customer.

5.11.1 Featues Descriptions
(A) Flexible Cal Forwarding: Provides end-user control for cal forwarding capabilties via
dial-accessed voice prompt menus. Customers may forward call to a priar local or
long distace. The end-user may speif a secondary location for routig of go
unanwered at the forward-to location or reach a busy signal. Th secondar location
may be another telephone number, pager or voice messagig servce. Oter capabilties
included with th featue include:
Sped Forwarding;
Priority Screenig;
Rig Control; and
Timed Forwarding.
It is the responsibilty of the Customer to subscribe to the telephone number, pager or
voice messagig servce used as the seondar location.
(B) Cal Forwarding Don't Anwer: Permts the forwardig of incomig cal when theend-user s lie remai unanwered afr a pre-designated rigig interval. The
rigig interval before forwarding and the forward-to number are fied by the service
order. However, the end-user has the abilty to tu the featue on or off at hi/her
discretion.
(C) Cal Forwarding Busy Line: Permits the forwardig of incomig call when the end-
users lie is busy. The forwarded number is fied by the end-usr service order.

number cal received from up to six end-user pre-selected telephone numbers
programed into the featues screenig lit. The end-user controls when the featue is

featue's screenig lit.
(E) Call Forwarding Varable: Permits the end-user to automaticaly forward (tranfer) alincomig cal to another telephone number, and to restore it to normal operation at
their dicretion. The end-user must dia an activation code from hi/her exchange lie
along with the forward-to number in order to tum the featue on. A separate code is
died by the end-user to deactivate the featue.
(F) Call Forwardig Varable, Remote Access: Permits the end-user to automaticalyforward (tranfer) al incomig cal to another telephone number, and to restore it to

connection. When the thd par anwers, a two-way conversation can be held before
addig the origi par for a theeway conference. The end-user intitig the
conference controls the cal and may disconnec the thd par to reestablih the
origial connection or establih a connecon to a dierent thd party. The featue may
be used on both outgoing and incomig cal.
(H) Multiple Directory Number Distinctive Ringing: Th featue alows an end user to
determe the source of an incomig cal from a distictive ring. The end user may
have up to two additiona numbers assigned to a single lie (i.e. Distictive Rigig -
First Number and Distictive Rigig - Seond Number). The designted priar
number wi receive a normal ringig pattrn; other numbers wi receive distictive
ringig pattrn. The pattrn is based on the telephone number that the calg party
dials.

number or termitig number, and the tie and date are generated for every call to
the speced telephone number can then be identied.
(0) Call Block: Alows the end-usr to automatically block incomig call from up to six
end-usr pre-selected telephone numbers programmed into the featue's screenig lit
Callers whose numbers have ben blocked wi hear a recorded message statig that
their call has been blocked. The end-usr controls when the featue is active, and can

Customer is alerted with a distictve ringig pattrn when the busy number is free.
When the Customer anwers the rig, the cal is then completed. The calg pars
number wi not be delivered or anounced to the call recipient under any
circutaces.
(Q) Anonymous Call Rejection: Permits the end-user to automaticaly reject incomig callwhen the cal origiate from a telephone number which has blocked delivery of its
calg number (see Callg Number Delivery Blockig). When active, cal from
private numbers wi be routed to a special anouncement then termted. The feature
may be turned on or off by the end-user by diag the appropriate featue control code.
Anonymous Cal Rejection is offered as a stad-alone featue or as an add-on to Caer
IDDeluxe.
(R) Caling Number Delivery Blocking: Prevents the delivery, diplay and anouncement
of the end-users Directory Number and Direcory Name on al cal dialed from an
exchange servce equipped with th option. When active, the end-user s telephone
name and number wi not appear on the caled pars Caer ID CPE or be dislosed in
another way. The featue is avaiable on a per cal or per lie basis. With per cal
Calg Number Delivery Blockig, it is necessar for the end-user to dia an activation
code prior to placing the cal. With the per lie version of the featue, al cal are
placed with the end-user s number blocked. Per lie end-usrs must di an activation
code prior to utiation.
(S) Message Waiting Indication: Provides the end-usr with an audible (stuttr dia tone)or viual (lamp or other CPE diplay) indication that messages are waitig, to be
retreved. Message Waitig Indication can only be actvatedj deactivated by a voice
mailbox or other voice messagig service provided by the Company or thd par. It is
the responsibilty of the Customer to subscribe to a compatible voice messagig service.
Visual Message Waitig Indication requies speiad CPE not provided by the

For each Customer of Company-provided Exchange Service(s), the Company shal arange for the

domit Local Exchange Carer in the area at no additional charge. At a Customer s option, the
Company wi arange for additional litigs for an additional chage.
5.12.1 Non-Published Servce
Th optional servce provides for suppression of prited and recorded diectory litigs. A
Customer s name and number do not appear in prited directories or Directory Assistace
Bureau records.
5.12.2 Non-Listed Servce
Th optional servce provides for suppression of printed directory litigs only. Pares
may sti obta the Customer s number by callg the Diecory Assistace Bureau.
5.13 Directory Assistance
Provides for identication of telephone directory numbers, via an operator or automated platform.
Customers are provided with a maximum of 2 litigs per each call to Directory Assistace.
5.14 Miscellaneous Servces
5.14.1 Presubscrption Servces
Th servce provides for the Presubscription of local exchange lies provided by the
Company to the intraLATA and interLATA long ditace carrieres) selected by the
Customer.
5.14.2 Pay Per Cal Blockiglnblocking
Th service provides the option of blockig, or subsequent unblockig, al 900 and 976 call
on a per lie basis. The Company wi provide for per-lie blockig where the Company's
switchig facilties permt.

The rates, terms and conditions set forth in the section are applicable where the Company provides
specifed local exchange services to Customers though resale of local exchange services.
All rate set forth in th Setion are subject to change and may be changed by the Company
pursuant to notice requirements establihed by the Idaho Commsion. The rates, term and
conditions set forth in th Setion are applicable as of the effective date hereof and wi not apply to
any Customer whose services may have been provisioned though resale of's local exchange

Local exchange service lies and tr are provided on a single par (individual) basis only. No
multi-party lies are provided. Servce is avaiable on a flat rate, measured rate or message rate
basis dependig on the servce pla selected by the Customer. Not all service pla wi be avaible
in all areas.
Recurring charges for Stadard Business Local Exchange Service are biled monthy in advance.
Usage charges, if applicable are biled in arrears. Usage charges may apply for cal placed from the
Customers lie. No usage charges wi apply to cal received by the Customer. Non-recurring
charges for intaation or rearrangement of service are biled on the next month's bil imediately
followig work performed by the Company.

PBX Tru service provides a Customer with a single, voice-grade telephonic communcations
chanel which can be used to place one cal at a tie. Tru are provided for connection of
Customer-provided private branch exchanges (PBX) or other station equipment to the public
switched telecommuncations network.
PBX Tru are available to Business Customers as Inward, Outward or Two-Way combintion
tr where services and facilties permt.
Each PBX Tru is provided with Touchtone signg at no additional charge. An optiona per

Direct Inward Dialg ("DID") permits call incomig to a PBX system or other Customer Premis
Equipment to be routed to a specc station without the assistace of an attndant. DID cal are

Company provides the necessary tr, telephone numbers, and out-puling of digits to enable
DID servce at a Customer s location. DID service requies special PBX softare and hardware not

9.1 ISDN PRI Servce with Unlimited Local Callng
ISDN PRI offers an array of value-added featues, such as callg number identication and call-
by-eall selection that enhance productivity. ISDN PRI is configured with 23 64 Kbps bi-directional
B (Bearer) chanels and one 64 Kbps D (Data) chaneL. Unique to ISDN PRI is its abilty to
designate the D chanel to handle all of the signalig and call control requiements and leave the
remaing 23 B chanels free for any mix of circuit-switched voice and data.
Each of these products is offered under a 12, 24 or 36 month term agreement. Rates include

Th service provides a tr side DSI electrical interface from the customer s digital PBX system
to a digital port on a local Company switch for the origiation and termination of call. Trafc to
and from the digital PBX can be received or dialed directly from any PBX station without the
need for an attendant.
These digital trun deliver a high-speed DSI (Tl) connection between your PBX and the
Company network. There are up to 24 chanels on one facilty, each of which can be used to place
or receive call. This multi-chanel capabilty dramatically reduces the need for additional PBX
circuit cards.

ISDN BRI (Basic Rate Interface) uses standard "twisted pair" cables and is nearly thee ties
faster than a 56K dial up lie. ISDN PRI (Primary Rate Interface) uses a 1.54 Mbps digital
tranport facilty (Tl). Both services provide the superior clarity of digita transmission, a high-
speed data interface and sufcient bandwidth capacity to fulf your current and future
communcation needs.
ISDN BRI consists of two 64 Kbps B (Bearer) chanels and one 16 Kbps D (Data) chaneL. Each B

11.1 Carer Presubscription
11.1.1 General
SECTION 11.0 - MISCELLANEOUS SERVICES
Carrier Presubscription is a procedure whereby a Customer designates to the Company
the carrier which the Customer wihes to be the carrier of choice for intraLAT A and
interLATA toll call, Such call are automatically diected to the designated carrier,
without the need to use carrier access codes or additional dialg to direct the cal to the
designated carrier. Presubscription does not prevent a Customer who has presubscribed
to an IntraLATA or InterLATA toll carrier from using carrier access codes or additional
dialig to direct call to an alternative long distance carrier on a per call basis.
11.1.2 Presubscription Options - Customers may select the same carrier or separate carriers for
intraLAT A and interLAT A long distace. The following options for long ditance

A new Customer wi be asked to select intraLATA and interLATA toll cariers at the tie
the Customer places an order to establih local exchange servce with the Company. The
Company wi process the Customer s order for servce. Al new Customers intial requests
for intraLATA toll service presubscription shal be provided free of charge.
If a new Customer is unable to make selection at the tie the new Customer places an order
to establih local exchange service, the Company wi read a random litig of al avaiable
intraLATA and interLATA carriers to aid the Customer in selection. If selection is sti not
possible, the Company wi inorm the Customer that hej she wi be given 90 calendar days

9D-day period wi not be assessed a servce charge for the intial Customer request.
Customers of record may intite an intraLATA or interLATA presubscription chge at
any tie, subject to the charges specifed in 11.1.5 below. If a Customer of record inquires
of the Company of the carriers avaible for toll presubscription, the Company wi read a
random litig of all avaiable intraLAT A carers to aid the Customer in selection.

SECTION 13.0 - PROMOTIONAL OFFRINGS I CONTRACT & ICB
13.1 Promotional Oferings
The Company, upon notication to Commision, may make promotional offerings to its service
which may include waiving or reducing the applicable charges for the promoted service. The
promotional offerings may be lited as to the duration, the date and ties of the offering and
the locations where the offerings are made.
13.2 Contract Rates j Individual Case Basis (ICB) Arangements
Competitive pricing arrangements at negotiated rates may be furnhed on an individual case
basis (ICB) in response to request by customers to Velocity, for proposals or for competitive bids.
Service offered under this tariff provision wil be provided to the Customer pursuant to contract.
Unless otherwise specified, the regulations for such arrangements are in addition to the
applicable regulations and prices in other sections of th tarif. Specialied rates or charges wil
be made available to simarly situated Customers on a non-discrimatory basis. Company wil
provide the Commission with copies of any ICB contractual arrangements.
