VCI-O4- ELIGIBLE TELECOMMUNICATIONS CARRIER PROVIDING SERVICE TO NOTICE OF APPLICATION CUSTOMERS UNDER THE IDAHO TELECOMMUNICATIONS SERVICE NOTICE OF MODIFIED ASSISTANCE PROGRAM.PROCEDURE ORDER NO. 29652 YOU ARE HEREBY NOTIFIED that on September 13 , 2003, VCI Company filed a Petition for designation as an eligible telecommunications carrier (ETC). VCI holds a certificate as a competitive telecommunications provider in the State of Idaho. VCI provides wireline services primarily through the leasing of unbundled network elements (UNE-P) from Qwest Corporation. vcrs Application for designation as an ETC states that it will provide service throughout Qwest's territory to Idaho residents qualifying for the Idaho Telecommunications Service Assistance Program (ITSAP). YOU ARE FURTHER NOTIFIED that vcrs Petition states that it provides the services required to be eligible for ETC designation, except that VCI does not provide toll limitation for qualifying low-income consumers. According to the Petition, Qwest which provides vcrs UNE-P services, cannot provide the technological capability for toll limitation service. Accordingly, VCI requests an exemption from the requirement that it provide toll limitation to qualifying low-income customers until such time as Qwest can provide it as part the UNE-P products Qwest leases to VCI. vcrs Petition states that it currently is an ETC in the states of Washington, Oregon and Wyoming and that it complies with all FCC rules, including federal high-cost support regulation. YOU ARE FURTHER NOTIFIED that the Application, together with supporting workpapers, testimonies and exhibits, has been filed with the Commission and is available for public inspection during regular business hours at the Commission offices. NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 29652 YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission s jurisdiction under Title 61 of the Idaho Code and that the Commission may enter any final order consistent with its authority under Title 61. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission s Rules of Procedure, IDAPA 31.01.01.000 et seq. YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter and will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Idaho Public Utilities Commission s Rules of Procedure, IDAP A 31.01.01.201 through -204. YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this Application may file a written comment in support or opposition with the Commission within twenty-one (21) days from the service date of this Notice. The comment must contain a statement of reasons supporting the comment. Persons desiring a hearing must specifically request a hearing in their written comments. YOU ARE FURTHER NOTIFIED that the Application in Case No. YCI- T -04-1 can be reviewed at the Commission s office and at the principal office of VCI Company during regular business hours ORDER IT IS HEREBY ORDERED that the Application of VCI Company be processed by Modified Procedure IDAPA 31.01.01.201-204. Persons interested in submitting written comments in this matter must do so no later than 21 days from the service date of this Order.
