FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY ORDER NO. 29379 CASE NO. UTI-OO- In Case No. UTI-00-1 the Commission granted Universal Telecom, Inc. a Certificate of Public Convenience and Necessity (CPCN) subject to the posting of a $50 000 surety bond. Order No. 28481. Universal never posted this bond and as a result was not given a CPCN. On October 31 2003 , Universal Telecom filed a letter with the Commission stating that the Company no longer plans to operate or provide competitive local telecommunications exchange services in the State of Idaho. Based on the foregoing, the Company has requested that the Commission withdraw its tariffs on file at the Commission. In addition, the Company had its Certificate of Authority to transact business in the State of Idaho as a foreign corporation administratively revoked by the Secretary of State s Office on September 4, 2002. Based on this record the Commission grants the Company s request. Accordingly, its price list(s) and/or tariff(s) shall be removed from the Commission active files. Furthermore, because Universal Telecom failed to meet a condition set by the Commission to receive its CPCN and no longer is authorized to do business in this State, any authority previously given by the Commission to the Company in Order No. 28481 , Case No. UTI-00- is revoked. ORDER IT IS HEREBY ORDERED that any authority previously given to Universal Telecom, Inc. in final Order No. 28481 , Case No. UTI-00-, is revoked. IT IS FURTHER ORDERED that Universal Telecom, Inc s price list(s) and/or tariff(s) shall be removed from the Commission s active files. THIS IS A FINAL ORDER. Any person interested in this Order (or in issues finally decided by this Order) or in interlocutory Orders previously issued in this Case No. UTI-00- may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or interlocutory Orders previously issued in this ORDER NO. 29379 case. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code 99 61-626 and 62-619.
