USW-T-99-24 NOTICE OF HEARING On March 29, 2001, the Commission issued Order No. 28683 that appointed a hearing examiner “to hear and decide the remaining issue in this case.” Our Hearing Examiner is authorized to schedule proceedings, conduct status conferences, take evidence, administer oaths, enter rulings on objections and motions, and issue a proposed Order containing findings of fact. On May 16, 2001, the Hearing Examiner conducted a conference call to establish a procedural schedule. PROCEDURAL SCHEDULE AND NOTICE OF HEARING During the conference call the parties discussed the need to file summaries of their testimony and the necessity for a hearing, and the manner that this matter may be presented to the hearing officer so that a recommendation can be made to the Commission. Based upon the agreement of the parties, the Hearing Examiner issues the schedule outlined below. Date Action July 6, 2001 July 20, 2001 July 24-25, 2001 The Petitioners shall file a summary of their testimony and exhibits with the Commission and provide copies to the hearing officer and the Respondent. The Respondent shall file a summary of its testimony and exhibits with the Commission and provide copies to the hearing officer and the Petitioners. Evidentiary hearing dates for this case to be presented to the hearing officer in Boise, Idaho at the Idaho Public Utilities Commission’s Hearing Room at 9:30 a.m. All summaries of testimony and exhibits shall be served no later than the close of business on the deadlines outlined above. YOU ARE FURTHER NOTIFIED that the prepared testimony and exhibits must be served upon the Commission and all other parties as set out in the schedule above. The prepared testimony summaries and exhibits must conform to the requirements of Rules 266 and 267 of the Commission’s Rules of Procedure, IDAPA 31.01.01.266-267. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission’s jurisdiction under Titles 61 and 62 of the Idaho Code and that the Commission may enter any final Order consistent with its authority. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission’s Rules of Procedure, IDAPA 31.01.01.000 et seq. IT IS THEREFORE ORDERED that this matter be set for hearing as outlined above. The parties shall comply with the schedule.
