Re: Microserv v. U S WEST Communications, IPUC Case No. USW-T-99-20
Dear Counsel:
In reviewing the case file in this matter, I see that U S WEST Communications has filed an Answer to the complaint and submitted discovery requests to Microserve Computer. After the filing of an Answer, the Commission usually convenes a prehearing status conference to discuss the scheduling of the case and other preliminary matters.
The Commission has asked me to inquire whether the parties believe this matter should be set for an evidentiary hearing or does the case lend itself to the submission of stipulated facts and legal arguments? The scheduling of a case normally involves the parties establishing deadlines for discovery, setting dates for the submission of the prefiled testimony, and setting hearing dates (if applicable). I encourage Counsels for U S WEST and Microserv to discuss these questions and advise me if you are able to reach agreement on the processing and scheduling of this case. If you would like to jointly discuss this matter with me, I will be happy to set up a conference call at your convenience. Please be advised that the Commission Staff will not participate as a party in this matter.
