USW-T-99-16 BRIEFING SCHEDULE NOTICE OF HEARING ORDER NO. 28198 BACKGROUND On November 1, 1999, at the prehearing conference, the parties proposed the following procedural schedule for consideration of this matter: 1. On or before November 2, 1999, Electric Lightwave, Inc. (ELI) will file a Motion to Amend its Complaint. 2. On or before November 22, 1999, U S WEST Communications, Inc. (U S WEST) will file an amended Answer to the Amended Complaint if U S WEST has not already opposed the Motion to Amend. 3. On or before January 3, 2000, all parties will file simultaneous opening testimony. 4. On or before January 31, 2000, all parties will file simultaneous reply testimony. The parties further agreed to respond to all discovery within fourteen (14) days. NOTICE OF PROCEDURAL SCHEDULE AND HEARING YOU ARE HEREBY NOTIFIED that persons desiring to intervene in this matter for the purpose of presenting evidence or cross-examining witnesses at hearing must file a Petition to Intervene with the Commission pursuant to this Commissions Rules of Procedure 72 and 73, IDAPA 31.01.01.072 and -.073. Persons intending to participate at the hearing must file a Petition to Intervene on or before November 30, 1999. Persons desiring to present their views without parties’ rights of participation and cross-examination are not required to intervene and may present their comments without prior notification to the Commission or the parties. YOU ARE HEREBY NOTIFIED that the Commission will convene the hearing in this case on TUESDAY, FEBRUARY 29, 2000 AT 9:30 A.M. AT THE OFFICES OF THE IDAHO PUBLIC UTILITIES COMMISSION, 472 WEST WASHINGTON STREET, BOISE, IDAHO. The purpose of this hearing will be to take the evidence and argument of the parties, Staff and intervenors, if any. YOU ARE FURTHER NOTIFIED that the Commission has adopted the following schedule in this case: 1. On or before November 2, 1999, Electric Lightwave, Inc. (ELI) will file a Motion to Amend its Complaint. 2. On or before November 22, 1999, U S WEST Communications, Inc. (U S WEST) will file an amended Answer to the Amended Complaint if U S WEST has not already opposed the Motion to Amend. 3. On or before January 3, 2000, all parties will file simultaneous opening testimony. 4. On or before January 31, 2000, all parties will file simultaneous reply testimony. YOU ARE FURTHER NOTIFIED that all parties wishing to participate in the hearing by telephone may submit a written request to the Commission Secretary, Idaho Public Utilities Commission, PO Box 83720, Boise, Idaho 83720-0074, no later than two working days prior to the date set for the hearing. Parties making such a request will be informally notified prior to the hearing whether their request has been granted by the Commission. YOU ARE FURTHER NOTIFIED that all hearings and pre-hearing conferences in this matter will be held in facilities meeting the accessibility requirements of the Americans with Disabilities Act. Persons needing the help of a sign language interpreter or other assistance of the kind that the Commission is obligated to provide under the Americans with Disabilities Act in order to participate in or to understand the testimony and argument at a public hearing may ask the Commission to provide a sign language interpreter or other assistance at the hearing. YOU ARE FURTHER NOTIFIED that the Commission has jurisdiction over this matter pursuant to Title 61 of the Idaho Code. O R D E R IT IS HEREBY ORDERED that the prepared testimony, exhibits, motions and responses of all parties be served upon all other parties of record in accordance with the schedule set out above.
