USW-T-99-15 NOTICE OF APPLICATION NOTICE OF RIGHT TO INTERVENE YOU ARE HEREBY NOTIFIED that on July 23, 1999, U S WEST Communications, Inc. filed an Application for deregulation of basic local exchange rates in its Burley, Idaho exchange. U S WEST is the provider of basic local service in the Burley exchange, which includes the communities of Burley, Declo and Heyburn. U S WEST’s services in the Burley exchange are subject to regulation by the Commission under Title 61 and 62, Idaho Code. YOU ARE FURTHER NOTIFIED that U S WEST seeks deregulation of its basic local exchange service in the Burley exchange pursuant to Idaho Code § 62-622(3). That section provides for the Commission to cease regulating basic local exchange rates in a local exchange calling area upon a showing by the incumbent telephone corporation that effective competition exists for basic service throughout the local calling area. U S WEST’s Application asserts that actual competition exists in the Burley exchange from a facilities-based competitor for both residential and small business local exchange customers. The Application further asserts that competition exists through functionally equivalent, competitively priced local exchange services reasonably available to both residential and small business customers. The Application further states that if U S WEST is granted the relief it requests, it will be able to more effectively compete with the facilities-based carrier and the wireless providers operating in the Burley exchange. YOU ARE FURTHER NOTIFIED that the Application together with supporting workpapers, testimonies and exhibits, have been filed with the Commission and are available for public inspection during regular business hours at the Commission offices. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission’s jurisdiction under Title 61 of the Idaho Code and that the Commission may enter any final Order consistent with its authority under Title 61. YOU ARE FURTHER NOTIFIED that persons desiring to intervene in this matter for the purpose of presenting evidence or cross-examining witnesses at hearing must file a Petition to Intervene with the Commission pursuant to this Commission’s Rules of Procedure 72 and 73, IDAPA 31.01.01.072 and -.073. Persons intending to participate at the hearing must file a Petition to Intervene on or before August 16, 1999. Persons desiring to present their views without parties’ rights of participation and cross-examination are not required to intervene and may present their comments without prior notification to the Commission or the parties. YOU ARE FURTHER NOTIFIED that all proceedings and hearings will be conducted pursuant to the Rules of Procedure adopted by the Idaho Public Utilities Commission. IDAPA 31.01.01.000 et seq.
