3 BY MR. MILLER:
4 Q. At page 10 of your testimony, you
5 recommended that the customer payments contemplated
6 by the Company should be incorporated in the tariffs
7 so that they became I guess public and enforceable;
8 that is, is it your understanding that the Company
9 has committed to, within a reasonable period of time
10 after approval, of filing such tariff?
11 A. Yes.
12 Q. So that satisfies your recommendation
13 in that regard?
14 A. Yes, it does.
15 Q. With respect to some of the customer
16 service standards, you had suggested the possibility
17 of different kind of votes or response or reply by
18 the Company than those proposed. The Company has
19 proposed in Mr. Moir's rebuttal testimony filing a
20 report with the Company not later than 2002 that
21 would detail the Company's experience with
22 implementing the standards and providing a forum for
23 discussion of improvements to the standards based on
24 experience to-date.
25 I want just to be sure that from your

1 point of view, it would be appropriate to have
2 discussions about different time intervals at that
3 time after some experience had been gained and allow
4 the Company's proposal to be implemented now as
5 proposed. Do you understand that? What would your
6 thoughts be on that?
7 A. Yeah, I recognized that the Company
8 was a bit uncomfortable with its -- its commitments
9 and that it has not fully explored what the current
10 range of performance might be, and so was not really
11 willing to tighten up those performance standards
12 any further than it already committed to.
13 And I am comfortable as an alternative
14 with allowing the Company to have some experience,
15 on the -- on the recognition that they will come in
16 and talk further about where we could -- we would
17 appropriately set those performance levels in the
18 future.
19 Q. All right. And as part of the Order
20 hopefully approving the transaction, would it be
21 your suggestion that the Commission attach a
22 condition requiring the filing of such a report?
23 A. Yes.
24 Q. Great. Just one other area:
25 On page 16, you had a recommendation

1 along similar lines; that is, the response and the
2 time for responding to billing inquiries.
3 And on page 4 of Mr. Moir's rebuttal,
4 he proposes to clarify that commitment by saying
5 that PacifiCorp/ScottishPower will answer most
6 questions on bills at the time of the initial phone
7 call from the customer. For billing questions that
8 need more investigation, PacifiCorp/ScottishPower
9 will investigate and respond to the inquiry as soon
10 as possible. If PacifiCorp has not investigated and
11 responded to the customer within 15 days, we will
12 automatically pay the customer $50.
13 Do you recall that testimony?
14 A. Yes.
15 Q. From your point of view, is that an
16 acceptable clarification to the suggestion you had
17 on page 16?
18 A. Yes.
19 MR. MILLER: No further questions.
20 COMMISSIONER HANSEN: Okay. Let's see
21 if we have any questions from the Commissioners.
22 I have none. I do thank you.
23 MR. PURDY: I have no redirect.

2 MR. PURDY: Yes, it does.
3 COMMISSIONER HANSEN: Okay. Well, it
4 looks like we have finished -- just about finished
5 this technical hearing.
6 I think one matter of business is
7 we've had some exhibits that have been submitted and
8 we've given numbers to and identified them at the
9 time and they haven't been yet put in as part of the
10 record. So without any objections, those exhibits
11 that have been numbered and not yet been part of the
12 record will be part of the record if there is no
13 objections. Being none, so ordered.
14 MR. PURDY: Mr. Chairman, I would just
15 move that all exhibits identified be admitted into
16 the record.
17 COMMISSIONER HANSEN: Okay, and that
18 way all will be identified if there's no objection.
19 So ordered.

22 COMMISSIONER HANSEN: We'll now --
23 this pretty much completes our technical hearing of
24 this case. I would ask if any parties have any
25 final comments they want to make.

1 I think we discussed earlier that
2 briefs would be in order with the Commission.
3 Anyone that want -- any parties that want to file a
4 brief may do so, and I think we set the limit of
5 21 days. So within 21 days, if anyone cares to file
6 a brief with the Commission --
7 MR. MILLER: Could we just look at a
8 calendar to see when 21 days would be?
9 COMMISSIONER HANSEN: We want to at
10 least give you till sometime in August.
11 MR. MILLER: I wonder if I could just
12 make a suggestion for the Commission's
13 consideration:
14 It's my understanding that it would
15 probably be two weeks before we get transcripts,
16 more or less, correct, which would basically leave
17 six days for the preparation -- six or seven days
18 for the preparation of the transcript -- or,
19 preparation of the brief. I wonder what the
20 Commission's attitude would be toward having the
21 briefs due, say, on the 13th of August.
22 COMMISSIONER SMITH: Is that a
23 Friday?
24 MR. MILLER: Friday.
25 COMMISSIONER HANSEN: Commission has

1 no problem with setting that at the 13th then. 13th
2 of August would be the date.
3 MR. MILLER: It would be our
4 understanding that there would just be one filing of
5 simultaneous briefs; wouldn't have any need for
6 further replies and counterreplies.
7 COMMISSIONER HANSEN: That is correct.
8 MR. MILLER: Very good.
9 COMMISSIONER HANSEN: Okay. Is there
10 any -- yes, Mr. Nye.
11 MR. NYE: I just want to renew the
12 Motion that I think is under advisement at the
13 conclusion of the presentation of the evidence: The
14 Motion to dismiss, or in the alternative, to
15 postpone. I just do that for the record without
16 further arguments, just making a note of that.
17 COMMISSIONER HANSEN: That will be
18 made a note of in the record.
19 Okay, is there any other business that
20 anyone wants to bring forth before we adjourn the
21 technical hearing?
22 We will recess -- in fact, we will
23 recess the hearing until July the 27th at seven p.m.
24 in Rexburg for a public hearing, and then we'll have
25 a hearing on the 28th in Pocatello, a public

3 that Mr. Ward wanted the option to make oral as
4 opposed to writing a brief.

6 Mr. Ward's statement why he was explaining why he
7 wanted an oral. Is that correct?
8 MR. WARD: Thank you, Mr. Chairman.
9 That's all I wanted.
10 COMMISSIONER HANSEN: I think we have
11 that.
