USW-T-00-15 NOTICE OF FILING OF STATEMENT OF GENERALLY AVAILABLE TERMS NOTICE OF MODIFIED PROCEDURE ORDER NO. 28412 YOU ARE HEREBY NOTIFIED that on June 10, 2000, U S WEST Communications, Inc. (U S WEST) filed a Statement of Generally Available Terms (SGAT) as described by Section 252(f) of the Telecommunications Act of 1996, 47 U.S.C. ( 252(f). An SGAT provides the terms and conditions an incumbent telephone company generally offers to other companies that seek interconnection with the incumbent company. U S WEST’s SGAT provides terms and conditions for interconnection, access to unbundled network elements, ancillary services, and resale of U S WEST’s telcommunications services. YOU ARE FURTHER NOTIFIED that the terms and conditions of an SGAT must comply with the interconnection terms set forth in Section 251 and the pricing standards of Section 252(d) of the Telecommunications Act. Pursuant to Section 252(f)(2), the Commission is required to review the SGAT and ensure that it complies with the interconnection requirements and pricing standards of the Telecommunications Act. YOU ARE FURTHER NOTIFIED that pursuant to 47 U.S.C. ( 252(f)(3), the Commission is required to complete its review of U S WEST’s statement within 60 days or permit such statement to take effect. However, permitting the SGAT to take effect at the end of 60 days does not preclude the Commission from continuing to review the statement or from approving or disapproving it at a later date. See 47 U.S.C. 252(f)(4). The Commission will consider not issuing an Order approving or disapproving the SGAT within 60 days, and instead may permit it to take effect pursuant to Section 252(f)(3). YOU ARE FURTHER NOTIFIED that the Application together with supporting workpapers, testimonies and exhibits, have been filed with the Commission and are available for public inspection during regular business hours at the Commission offices. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission’s jurisdiction under Title 61 of the Idaho Code and that the Commission may enter any final Order consistent with its authority under Title 61. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission’s Rules of Procedure, IDAPA 31.01.01.000 et seq. YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter and will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Idaho Public Utilities Commission’s Rules of Procedure, IDAPA 31.01.01.201 through -.204. YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this Application may file a written comment in support or opposition with the Commission within thirty (30) days from the date of this Notice. Reply comments must be filed within fifteen (15) days from receipt of written comments. The comment must contain a statement of reasons supporting the comment. Persons desiring a hearing must specifically request a hearing in their written comments.
