Local Exchange Services Original Page 6 SECTION 1.0 - DEFINITIONS For the purpose of fu tariff, the following defiiùtions wil apply: Access Line - An arrangement which connects the Customer's location to a carrier's switchig center or point of presence. Account Codes - Optional, Customer-defied digits that alow the Customer to identi the individual user, department or client associated with a call. Account Codes appear on the Customer bil. Advance Payment - Par or al of a payment required before the start of service. Authonzed User - A person, fum, corporation, or any other entity authorized by the Customer to communcate utiing the Company's service. Business - A class of service provided to individuals engaged in business, firms, partnerships, corporations, agencies, shops, works, tenats of office buidings, and individuals practicing a profession or operatig a business who have no offices other than their residences and where the use of the service is primary or substatialy of a business, professional or occupationa nature. Commssion - Idaho Public Utities Commsion. Company or Carier - Unite Private Networks, L.L.c., uness otherwise clearly indicated by the context Customer - The person, fum, corporation or other entity which orders, cancels, amends or uses service and is responsible for payment of charges and complice with the Company's taif. Local Exchange Services Original Page 7 SECTION 1.0 - DEFINITIONS (CONTINUED) DID Trunk - A form of local switched access that provides the abilty for an outside party to call an internal extension directly without the intervention of the Company operator. Dial Pulse (or "DP") - The pulse ty employed by rota di station sets. Dual Tone Multi-Frequency (or "DTMF") - The pule tye employed by tone dial station sets. End User - Any person, fim, corporation, partnership or other entity which uses the services of the Company under the provisions and regutions of fu taf. The End User is responsible for payment unless the charges for the services utid are accepted and paid for by another Customer. End Office - With respect to each NP A-NX code prefi assigned to the Company, the location of the Company's "end offce" for purposes of fu tari shal be the point of interconnection associated with that NP A-NXX code in the Local Exchange Routig Guide ("LERG"), issued by Bellcore. Hearg Impaired - Those persons with communcation impairments, including those hearing impaired, deaf, deaf/blid, and speeh impaired persons who have an impairment that prevents them from communcatig over the telephone without the aid of a telecommuncations device for the deaf. Hunting - Routes a call to an idle station lie in a prearranged group when the caled station lie is busy. In-Only - A service attibute that restricts outward dia access and routes incomig cal to a designated anwer point !XC or Interexchange Carer - A long distace telecommuncations services provider. Tariff F.c.c. NO.4. LEC - Local Exchange Company Minimum Point of Presence (tlMPOptl) - The mai telephone closet in the Customer's building. Monthly Recuring Charges - The monthy charges to the Customer for services, facilties and equipment, which contiue for tlie agreed upon duration of the service. Multi-Frequency or (tlMFtl) - An inter-machie pulse tye used for signalg betwee telephone switches, or between telephone switches and PBX/key systems. Non-Recuring Charge (tlNRCtl) - The intil charge, usually assessed on a one-tie basis, to intite and establih servce. Other Telephone Company - An Exchange Telephone Company, other than the Company. PBX - Private Branch Exchange Premises - A buidig or buidigs on contiguous property. Recung Charges - The monthy charges to the Customer for servces, facilties and equipment which contiue for the agreed upon duration of the service. The Company and Customer may mutually agree on a substitute Service Commencement Date. Servce Order - The written request for services executed by the Customer and the Company in the format devised by the Company. The signg of an Order by the Customer and acceptace by the Company intites the respective obligations of the parties as set forth therein and pursuant to th tariff, but the duration of the service is calculated from the Service Commencement Date. Telecommuncations Company or Provider - Used thoughout th tarif to mean Unite Private Networks, L.L.c. uness clearly indicate otherwise by the text. TBD - To Be Determined. Two Way - A service attibute that includes outward dial capabilties for outbound call and can also be used to carry inbound cal to a central point for furtler processing. Usage Based Charges - Charges for miutes or messages traversing over local exchange facilties. The Company is responsible under this tarif only for the services and facilties provided . hereunder, and it assumes no responsibilty for any service provided by any other entity that purchases access to the Company network in order to origiate or termate its own services, or to communcate with its own Customers. 2.1.2 Shortage of Equipment or Facilities (A) The Company reserves the right to lit or to allocate the use of exitig facilties, or of additional facilties offered by the Company, when necessary because of lack of facities, or due to some other cause beyond the Company's control. (B) The funihig of servce under th taiff is subject to the avaiabilty on a contiuig basis of al the necessar facities and is lited to the capacity of the Company's facilties as well as facilties the Company may obta from other carriers to fuh servce from tie to tie as requied at the sole dicretion of the Company. For the purpose of computig charges in th tarif, a month is considered to have th (30) days. (B) Customers may be required to enter into writt servce orders which shal conta or reference a specifc desciption of the servce ordered, the rates to be charged, the duration of the services, and the terms and conditions in th tarif. Customers wi also be requied to execute any other docuents as may be reasonably requested by the Company. (q Except as otherwise stated in the ta, at the expiration of the intial term specifed in each Service Order, or in any extension thereof, service shal contiue on a month to montli basis at the then curent rate uness termited by either party upon proper notice. Any termiation shal not relieve the Customer of its obligation to pay any charges incurred under the service order and th tarif prior to termiation. The rights and obligations which by their natue extend beyond the termiation of the term of the service order shal surive such termition. (D) Service may be termated upon wrttn notice to the Customer if: (1) the Customer is using the servce in violation of th ta; or (2) the Customer is using the service in violation of the law. (F) Any Other Telephone Company may not interfere with the right of any person or entity to obta service diecty from the Company. No person or entity shal be required to make any payment, incur any penalty, moneta or otherwe, or purchase any services in order to have the right to obtain service diectly from the Company. (G) Reserved for future us. (H) The Company hereby reserves its rights to establih servce packages specifc to a particular Customer. L.L.~,TIIFj~ F.S.C.c~ .! .~ Local Exchange SeivIces Original Page 13 SECTION 2.0 - RULES AND REGULATIONS (CONT'D) 2.1 Undertaking of the Company, (Cont'd.) 2.1.4 Limitations on Liabilty (A) The liabilty of the Company for damages arising out of the furnihing of its Service, including but not lited to mitaes, omisions, interruption, delay, or errors, or other defects, representations, or use of these services or damages arising out of the failure to furnih the service, whether caused by acts or omission, shal be liited to the extension of allowances for interruption as set forth in 2.7. The extension of such allowances for interruption shall be the sole remedy of the Customer and the sole liabilty of the Company. The Company wi not be liable for any direct, indirect, incidental, special, consequential, lost profits, exemplary or punitive damages to Customer as a result of any Company service, equipment or facilties, or the acts or omissions or negligence of the Company's employees or agents. (B) The Company's liabilty for wil misconduct, if establihed as a result of judicial or admitrative proceedings, is not liited by th tariff. The Company's liabilty, if any, with regard to delayed intallation of Company facilties or commencement of service, shall not exceed $1,000. With respect to any other claim or suit, by a Customer or by any others, for damage associated with the ordering (including the reservation of any specifc number for use with a service), intallation (including delays thereof), provision, termination, maintenance, repai, interruption of restoration of any service or facilties offered under this tariff, and subject to the provisions of Section 2.7, the Company's liabilty, if any, shall be lited as provided herein. (C) The Company shall not be liable for any delay or failure of performance or equipment due to causes beyond its control, includig but not lited to: acts of God, fire, flood, explosion or other catastrophes; and law, order, regulation, direction, action or request of the United States government or of any other government, including state and local governments having or claimg jurisdiction over the Company, or of any department, agency, commision, bureau, corporation or other intrmentality of anyone or more of these federal, state, or local governments, or of any miltary authority; preemption of existig service in complince with national emergencies; inurrections; riots; wars; unavailabilty of rights-of-way or materials, or strikes, lockouts, work stoppages, or other labor difficulties. (D) The Company shall not be liable for (a) any act or omission of any entity furnishing the Company or the Company's Customers facilties or equipment used for or with the services the Company offers; or (b) for the acts or omisions of common carriers or warehousemen. Except in 31.41.01 Rule 501, 502, and 503 of the IDAP A. (E) The Company shall not be liable for any damages or losses due to the fault ofnegligence of the Customer or due to the failure or malfnction of Customer- provided equipment or facilties. (F) The Customer shall indemn and hold the Company harmless from any and all loss, claims, demands, suits, or other action, or any liabilty whatsoever, whether suffered, made, intituted, or asserted by any other party or person(s), and for any loss, damage, or destruction of any property whether owned by the Customer or others, caused or claimed to have been caused diectly or indirectly by the intallation, operation; failure to operate, maintenance, removal, condition, location, or use of intallation provided by the Company. The Company reserves the right to require each Customer to sign an agreement acknowledgig acceptance of the provisions of this section as a condition precedent to such intallations. (G) The Company shal not be liable for any defacement of or damage to Customer premises resultig from the fuhig of services or equipment on such premies or the intallation or removal thereof, unless such defacement or damage is caused by gross negligence or wil misconduct of the Company's agents or employees. No agents or employees of other participatig carriers shal be deemed to be agents or employees of the Company. (H) Notwithstanding the Customer's obligations, the Company shall be indemned, defended, and held harmless by the Customer or by others authorizd by it to use the service againt any clai, loss of damage arising from Customer's use of services furnhed under this tariff, including: claim for libel, slander, invasion of privacy or inringement of copyright arising from the material, data, inormation, or other content tranmitted via the Company's service; and patent inringement claim arising from combing or connectig the servce offered by the Company with apparatus and systems of the Customer or others. All other claims arising out of any act or omision of the Customer or others, in connection with any service provided by the Company pursuant to th tarif. (I) The entie liabilty of the Company for any claim, loss, damage or expense from any cause whatsoever shall in no event exceed sums actually paid to the Company by Customer for the specifc services giving rise to the claim, and no such action or preceding againt the Company shall be commenced more than one year after the service is rendered. (J The Company makes no warranties or representations, express or implied, including warranties of merchantabilty or fitness for a particular use, except those expressly set forth herein. (K) The Company shall not be liable for any act or omission of any other company or compaiúes furnishing a portion of the service, or for damages associated with service, channels, or equipment which it does not furnih, or for damages which result from the operation of Customer-provided systems, equipment, facilties or services which are interconnected with Company services. Except in 31.41.01 Rule 501, 502, and 503 of the IDAP A. (L) The Company does not guarantee nor make any warranty with respect to service intallations at locations at which there is present an atmosphere that is explosive, prone to fie, dangerous or otherwise unuitable for such intallations. The Customer shall indemn and hold the Company harmless from any and all loss, claims, demands, suits or other action, or any liabilty whatsoever, whether suffered, made, intituted or asserted by the Customer or by any other party, for any personal injury to, or death of, any person or persons, or for any loss, damage or destrction of any property, whether owned by the Customer or others, caused or claimed to have been caused, directly or indirectly, by the intalation, operation, failure to operate, maintenance, removal, presence, condition, locations or use of service fuhed by the Company at such locations. (M) Witl respect to Emergency Number 911 Service: (a) Thi service is offered solely as an aid in handing assistance call in connection with fie, police and other emergencies. The Company is not responsible for any losses, clai, demands, suits or any liabilty whatsoever, whether suffered, made, intituted or asserted by tle Customer or by any other party or person for any personal injury to or death of any person or persons, and for any loss, damage or destruction of any property, whetler owned by the Customer or otlers, caused or claimed to have been caused by: (1) mistakes, omissions, interruptions, delays, errors or other defects in tleprovision of this service, or (2) intallation, operation, failure to operate, maintenance, removaL, presence, condition, location or use of any equipment and facilties furnihing this service. (b) The Company is not responsible for any iningement or invasion of the right of privacy of any person or persons, caused or claimed to have been caused, directly or indirectly, by the installation, operation, failure to operate, maintenance, removal, presence, condition, occasion or use of emergency 911 service features and the equipment associated tlerewitl, or by any services furnihed by the Company including, but not liited to, the identication of tle telephone number, address or name associated with the telephone used by the party or parties accessing emergency 911 service, and which arise out of the negligence or other wrongf act of the Company, tle Customer, its users, agencies or municipalities, or the employees or agents of anyone of tlem. (N) The Company's liabilty arising from errors or omissions in Directory Listigs, otler tlan charged listig, shall be lited to the amount of actual impairment of tle Customer's service and in no event shall exceed one-half the amount of tle fied monthy charges applicable to exchange service affected during tle period covered by the directory in which the error Qr omission occurs. In cases of charged Directory Listigs, the liabilty of the Company shall be lited to an amount not exceeding tle amount of charges for the charged litigs involved during the period covered by the directory in which tle error or omission occurs. Generaly, such activities are not speciic to an individual Customer but afect may Customers' services. No specifc advance notication period is applicable to al servce activities. The Company wi work cooperatively witl the Customer to determie the reasonable notication requirements. With some emergency or unplaed service-afectig conditions, such as an outage resultig from cable damage, notication to the Customer may not be possible. The Customer may not nor may the Customer permit others to rearrange, disconnect, remove, attempt to repair, or otherwe interfere with any of the facilties or equipment intalled by the Company, except upon the writtn consent of the Company. (B) The Company may substitute, change or rearrange any equipment or facilty at any tie and from tie to tie, but shal not thereby alter the techncal parameters of the service provided by the Customer. (C) Equipment the Company provides or intall at the Customer Premies for use in connection with the services the Company offers shal not be used for any purpose other than that for which the equipment is provided. (D) Except as otherwe indicated, Customer provided station equipment at the Customer's premies for use in connection with the service shal be so constrcted, maintaed and operated as to work satifactorily with the facilties of the Company. (E) The Company shall not be responsible for the intaation, operation, or mainteance of any Customer provided communcations equipment. Where such equipment is connected to the facilties fuhed pursuant to th tari, theresponsibilty of the Company shal be lited to the furnihig of facilties offered under th ta and to the maitenance and operation of such facilties. Subject to th responsibilty, the Company shal not be responsible for: (1) the though tranmision of signals by Customer provided equipment or for the qualty of, or defects in, such tranmision; or (2) the reception of sign by Customer-provided equipment; or (3) network control signalg where such signalig is performed by Customer- provided network control signalg equipment. In such cases, charges based on cost of the actual labor, mateia, or other costs incured by or charged to the Company wi apply. If intaation is staed durg reguar business hours but, at the Customer's request, extends beyond regur business hours into tie periods includig, but not lited to, weekends, holidays, and/ or night hours, additional charges may apply. 2.1.8 Special Construction Subject to the agreement of the Company and to al of the regulations contained in th taif, special constrction or facilties may be undertaken on a reasonable efforts basis at the request of the Customer. Special construction is construction undertaken: (A) where facilties are not presetly avaiable, and there is no other requiement for the facilties so constrcted; (B) of a type other than that which the Company would normally uti in the funihig of its servces; (C) over a route otler than that which the Company would normaly utie in the furnihig of its services; (D) in a quantity greater than that which the company would normaly constrct; (E) on an expedited basis; (F) on a temporar basis unti perment facilties are available; (G) involving abnormal costs; or (H) in advance of its normal constrction. Customer shal be relieved of all obligations to make payments for charges relatig to any blocked Service and shall indemn the Company for any clai, judgment or libilty resultig from such blockage. 2.2.4 A Customer, joint user, or authorizd usr may not assign, or tranfer in any maner, the servce or any rights associated with the servce without tle wrtten consent of the Company. The Company wil permit a Customer to tranfer its exitig service to another entity if the existig Customer has paid all charges owed to the Company for regulated communcations servces. Such a tranfer wi be treated as a diconnection of exitig servce and intaation of new service, and non-recuring intaation charges as stated in th taif wi apply. Any and al costs associted with the obtag and maintaing the rights-of-way described herein, including the costs of altering the strctue to permit intaation of the Company provided facilties, shall be borne entiely by, or may be charged by the Company, to the Customer. The Customer may be requied to intall and maintain Companyfacilties and equipment with a hazardous area if, in the Company's opinon, injury or damage to the Company employees or property might result from intallation or maitenace by the Company. The Customer shal be responsible for identiing, monitoring, removing and diposing of any hazdous material (e.g., friable asbestos) prior to any constrction or intaation work; (F) complyig with al laws and reguations applicable to, and obtag all consents, approvals, licenses and permts as may be requied with respect to, the location of Company facilties and equipment in an Customer premies or the rights-of-way for which Customer is responsible under Setion 2.3.1(D); and grantig or obtag permision for Company agents or employees to enter the premies of the Customer at any tie for the purose of intallg, inpectig, maitag, repairg, or upon termition of service as stated herein, removing the facilties or equipment of the Company; (G) not creatig or alowig to be placed any lien or other encumbrances on the Company's equipment or facilties; and (H) makig Company facilties and equipment avaible periodicaly for maitenance purposes at a tie agreeable to both the Company and the Customer. (B) To the extent caused by any negligent or intentional act of the Customer as described in (A), precedig, the Customer shall indemn, defend and hold harmless the Company from and againt al cla, actions, damages, liabilties, costs and expenses, includig reasonable attorneys' fees, for (1) any loss, destruction or damage to property of any thd party, and (2) any liabilty incurred by the Company to any thd par pursuant to th or any other tariff of the Company, or otherwe, for any interrption of, interference to, or other defect in any service provided by the Company to such tllld party. (q The Customer shal not assert any clai agait any other Customer or user of the Company's services for damages resultig in whole or in party from or arising in connection with the fuhig of service under th ta includig but not lited to mitaes, omisions, interruptions, delays, errors or other defects or mirepresentations, whether or not such other Customer or user contributed in any way to the occurence of the damages, uness such damages were caused solely by the negligent to intentional act or omision of the other Customer or user and not by any act or omision of the Company. The Company's services are designted primarily for the tranmision of voice-grade telephonic signals, except as otherwise stated in th tari. A user may tranmit any form of signal that is compatible with the Company's equipment, but the Company does not guarantee that its services wil be suitable for puroses other than voice-grade telephonic communcation except as specifcally stated in th taif. 2.4.2 Station Equipment (A) Termal equipment of the user's premies and the electric power consumed by such equipment shal be provided by and maitaed at the expense of the user. The user is responsible for the provision of wiing or cable to connect its termal equipment to the Company MPP. (B) The Customer is responsible for ensuring that Customer-provided equipment connected to Company equipment and facilties is compatible with such equipment and facilties. The magntude and character of the voltages and curents impressed on Company-provided equipment and wiing by connection, operation, or maitenance of such equipment and wig shal be such as not to caus damage to the Company-provided equipment and wiing or injur to the Company's employees or to other persons. Any additional protetive equipment requied to prevent such damage or injur shal be provided by the Company at the Customer's expense, subject to prior Customer approval of the equipment expee. In order to quali for Local Traffic Exchange the cal must (a) be origited by an end user of a company that is authorized by the Commsion to provide local exchange service; (b) origiate and termiate within a local callg area of the Company. (B) Any special interface equipment necessaiy to achieve compatibilty between the facilties and equipment of the Company used for fuhing Communcations Servces and the chanels, facilties, or equipment of others shall be provided at the Customer's expense. (C) Communcations Services may be connected to the services or facilties of other communications carriers only when authorized by, and in accordance with, the terms and conditions of the taifs of the other communcations carriers which are applicable to such connections. (D) Facilties funihed under th ta may be connected to Customer provided termial equipment in accordance with the proviions of th taif. Al such termal equipment shal be regitered by the Federal Communcations Commsion pursuant to Part 68 of Title 47, Code of Federal Reguations; and al user-provided wiing shal be intaed and maitaed in complice with those regutions. The Company wil noti the Customer promptly if there is any need for further corrective action. With ten days of receiving th notice, the Customer must tae th corrective action and noti the Company of the action taken. If the Customer fail to do th, the Company may tae whatever additional action is deemed necessary, including the suspension of service, to protect its facilties, equipment and personnel from harm. (C) If harm to the Company's network, personnel or services is iment, the Company reserves the right to shut down Customer's service imediately, will no prior notice requied. The Customer is responsible for the payment of federal excise taxes, state and local sales and use taes and simar taxes imposed by governmental jurisdictions, all of which shall be separately designated on the Company's invoices. Any taxes imposed by a local jurisdiction (e.g., county and muncipal) wil only be recovered from those Customers residing in the afected jurisdictions. 2.6.2 Billng and Collection of Charges The Customer is responsible for payment of all charges incurred by the Customer or other users for services and facilties furnhed to the Customer by the Company. (A) Non-recing charges are due and payable with thty (30) days afr the date the invoice is mailed to the Customer by the Company. (B) The Company shall present invoices for recurrig charges monthy to the Customer, in advance of the month in which service is provided, and recurring charges shal be due and payable with thty (30) days afer the date the invoice is maed to the Customer by the Company. When bilg is based upon Customer usage, usage charges wi be biled monthy for the precedig bilg period. (C) When servce does not begi on the first day of the bilg period, or end of the last day of the bilg period, the charge for the fraction of the month in which service was furnihed wi be calcuated on a pro rata basis. (D) Bilg of the Customer by the Company wi begi on the Service Commencement Date, which is tlie day on which the Company noties the Customer that the service or facilty is avaiable for use, except that the Service Commencement Date may be postponed by mutual agreement of the parties, or if the service or facilty does not conform to stadards set fort in th tariff or the Service Order. Bilg accrues fuough and includes the day that the service, circuit, arrangement or component is dicontiued. (E) If any porton of the payment is not received by tlie Company witlli 30 days of receipt of th bil, or if any portion of the payment is received by the Company in fuds which are not imediately availble upon presentment, then a late payment charge of 1.5% per month shal be due to the Company. A late payment charge is not applicable to subsequent rebilg of any amount to which a late payment charge has already ben applied. Late payment charges are to be applied without dicrimation. (F) the Customer should noti the Company of any diputed items on an invoice with sixty (60) days of receipt of the invoice. If the Customer and the Company are unble to resolve the dipute to their mutual satifaction, the Customer may fie a complait with the Commsion in accordance with the Commsion's rues and procedure. The address of the Commsion is as follows: Idao Public Utilities Commssion 472 West Washigton Street Boise, Idaho 83702 The date of the dispute shal be the date the Company receives sufficient documentation to enable it to investigate the dispute. The date of the resolution is the date the Company completes its investigation and notiies the Customer of the disposition of the dipute. (G) If servce is diconnected by the Company (in accordance with Section 2.6.3followig) and later re-intaed, re-intation of servce wi be subject to all applicable intaation charges. If servce is suspended by the Company (in accordance with Setion 2.6.3 followig) and later restored, restoration of service wi be subject to the rates in Setion 4.3. Customers wil be provided ten (10) days written notice prior to discontiuance uness otherwise indicated. Notice wi be provided via First Class U.S. Mail. Upon the Company's dicontiuance of service to the Customer under Section 2.6.3(A) or 2.6.3(B), the Company, in addition to al other remedies tht may be available to the Company at law or in equity or under any other provision of th taiff, may declare al futue monthy and other charges which would have been payable by the Customer during the remainder of the term for which such servces would have otherwise been provided to the Customer to be imediately due and payable. (A) Upon nonpayment of any amounts owing to the Company, the Company maydiscontiue or suspend servce without incuring any liabilty. Company wil comply with the Telephone Customer Relations Rule. (B) Upon violation of any of the other material terms or conditions for furnhig service the Company may, diontiue or suspend servce without incurring any libilty if such violation contiues during that period. (C) Upon condemntion of any material portion of the facities used by the Company to provide servce to a Customer or if a casualty renders al or any material portion of such facilties inoperable beyond feasible repai, the Company, by notice to the Customer, may dicontiue or suspend servce without incurig any liabilty. (D) Upon the Customer's inolvency, assignent for the benefit of creditors, fig forbanruptc or reorganation, or failg to dicharge an involunta petition with the tie permttd by law, the Company may imediately dicontiue or suspend service without incurig any liabilty. (E) Upon any governenta prohibition or governental requied alteration of the servces to be provided or any violation of an applicable law or reguation, the Company may imeditely diontiue servce without incurig any liabilty. Original Page 34 SECTION 2.0 - RULES AND REGULATIONS, (CONTINUED) 2.6 Payment Arrangements, (Continued) 2.6.6 Changes in Servces Requested If the Customer makes or requests material changes in circuit engieering, equipment specifications, servce parameters, premies locations, or otherwe materialy modies any provision of the application for service, the Customer's intallation fee shall be adjusted accordigly. 2.6.7 Bad Check Charge A service charge of $20.00 wil be assessed for all checks retued by a ban or other fiancial intitution for: Inufcient or uncollected fuds, closed account, apparent tampering, mising signture or endorsement, or any other inufciency or dicrepancy necessitatig return of the intrment at the dicretion of the drawee ban or other fiancial intitution. 2.7 Allowances for Interrptions in Servce 2.7.1 General Credit for Interruptions: When the use of service or facilties furnihed by the Company is interrupted due to any cause other than the negligence or wil act of the Customer, or the operation or failure of the facilties or equipment provided by the Customer, pursuant to IDAPA 31.41.01 Riles 502 and 503 subject to interruption wil be allowed for the service and facilties rendered useless and inoperative by reason of the interruption, whenever said interruption contiues for a period of 24 hours or more from the tie the interruption is reported to or known to exist by the Company, except as otherwise specifed in the Company's tariffs. If the Customer reports a service, facilty or circut to be inoperative but declies to release it for testig and repai, it is considered to be impaired, but not interrupted. For calculatig credit allowances, every month is considered to have 30 days. A credit allowance is applied pursuant to IDAP A 31.41.01 Rules 502 and 503 based on the rates specified hereunder for Local Lie or Local Tru Service and is dependent upon the length of the interruption. Only those facilties on the interrupted portion of the circuit wil receive a credit. Credit alowances for service outages that exceed 24 hours in duration wi be rounded up at the next whole 24 hours. The signal is an analog signal at the DSO leveL. 5.8 Reserved for Futue Use 5.9 Direct Inward Dialing (DID) Servce Direct Inward Dialig ("DID") permts cal incomig to a PBX system or other Customer Premies Equipment to be routed to a specifc station without the assistace of an attendant. DID call arerouted diectly to the station associated with the called number. DID service as offered by the Company provides the necessary trun, telephone numbers, and out-puling of digits to enables DID service at a Customet s location. When active, call from private numbers wil be routed to a special anouncement then termiated. The feature may be tued on or off by the end-user by dialg the appropriate featue control code. Anonymous Ca Rejection is offered as a stad-alone feature or as an add-on to Caller IDDeluxe. (R) Calling Number Delivery Blockig: Prevents the delivery, diplay and anouncement of the end-user's Directory Number and Direcory Name on all cal dialed from an exchange servce equipped with th option. When active, the end-user's telephone name and number wi not appear on the caled partys Caler ID CPE or be dislosed in another way. The feature is availble on a per cal or per lie basis. With per cal Calg Number Delivery Blockig, it is necessary for the end-user to dial an activation code prior to placing the cal. With the per lie version of the featue, al call are placed with the end-user's number blocked. Per lie end-users must dial an activation code prior to utiation. (S) Message Waiting Indication: Provides the end-user with an audible (stutter dial tone)or viual (lamp or other CPE display) indication that messages are waitig to be retrieved.
