V & H Coordinates: Geographic points which define theoriginating and terminating points of call mathematical terms so that the airline mileage of the call may be determined. Call mileage is used for the purpose of rating calls. Travel Card Call: A service whereby the Customer or Authorized User dials all of the digits necessary to route and bill a call placed from a location other thanhis/her residence. PREP AID CALLING CARD ACCOUNT CODE - A number assigned to each account which is dialed by the customer or authorized user upon access to the Company s service. An account code identifies the caller and validates the caller s authorization to use the services provided. PREP AID CALLING CARD AVAILABLE BALANCE - The current balance expressed in dollars contained within the customer s account. The available balance may be used to place calls via the Company s network until exhausted. The available balance decreases on a real- time basis as calls are placed and usage occurs. PREP AID CALLING CARD ACCOUNT - An account which is not associated with a Local Exchange Carrier business or residential access line. A prepaid calling card account is established for a customer with an initial prepaid balance from 'which charges for service provide by Company are deducted on a real time basis. PREP AID CALLING CARD - A card issued by the Company which provides the customer or authorized user with a prepaid calling card account, an account code and instructions for accessing the Company s network. PREP AID CALLING CARD CALL - A service whereby the customer or authorized user dials all of the digits necessary to place a call and have call charges deducted from the Customer s prepaid calling card account. Service is accessed via a AI-800-A or other access code dialing sequence. PREP AID CALLING CARD INITIAL ACCOUNT BALANCE - The available balance of a customer s account upon issuance of an account code and before any depletion for call activity. Boise, Idaho SECTION 2 - RULES & REGULATIONS Undertakinq of Company Company undertakes to provide only those designated services as are furnished under the terms and subj ectto the conditions and customer paYment of the applicable rates of this tariff for communications originating and terminating within the State of Idaho. Carrier is resale common carrier providing telecommunications service to subscribers for directvoice communication with stations of any domestictelephone system wi thin the State of Idaho. Service is available 24 hours per day, 7 days per week. The carrier will provide an appropriate credit to a customer billed for a call of short duration when customer identifies that the call was not complete. Area of Service Touch Communications offers services throughout the State of Idaho. Touch provides services statewide from the locations where its customers are situated. Carrier reservesthe right not to provide service to or from alocation where the necessary facilities equipment are not available. Carrier reserves the right to discontinue or limitthe use of service upon written notice, whennecessitated by conditions beyond its control, or when the subscriber is using the service in violation of the provisions of this tariff or in violation of the tariffs of the network carriers, or in violation of the law. The billing date is printed on the bill and the date rendered shall be the mailing date. The subscriber is responsible for payment of all regulated charges for services furnished to the subscriber. Failureto receive bills or notices which have been properly placed in the United States mail shall not prevent such bills from becoming delinquent nor relieve customer of his obligations for payment thereof. An account shall become delinquent if full payment has not been received within thirty days after rendition of such bill. Carrier does not require any deposits. Billing will be payable upon receipt of bill. Late payment penalty will be charged on any amount unpaid after thirty (30) days , at a rate of 1.5% per month. The customer or user of carrier provided services is responsible for payment of all charges for services and equipment furnished to the customer for transmission ofcalls via the company regardless of intentional negligent, or fraudulent use. In particular, and without limitation to the foregoing, the customer or user is responsible for any and all costs incurred as the result of: a. Any and all use of the services provided by company, including calls which the customer did individually authorize. the not b. Any and all calls placed to a toll free service number provided to the customer by the carrier. c. Any and all calls placed using a carrier providedtravel/calling card or authorization number including calls which the customer did not individually authorize. Non-recurring charges are payable when the service for which they are specified have been performed. Recurring charges which are fixed in amount and not dependent on usage are billed in advance. Usage charges are stated as a function of , and vary with,use (e.g., per connection time). Usage charges are billed in arrears. The Company may deal with customers whose accounts show very small balances by withholding the issuance of an invoice until the amount due fromthe customer reaches a level which, in The Company I s sole discretion, is deemed large enoughto justify initiating the billing and collection process or The Company may invoice low usagecustomer every other month unless a customer invoiced in such a manner requests monthly billing. Returned Check Charqe The subscriber will be assessed a $20.00 handling charge for each instance of the subscriber I s checkfor paYment of service being returned to theCarrier by the bank after being dishonored.Carrier shall not , however disconnect service for nonpaYment of a dishonored check charge. Such billings shall allocate these taxes, fees or other charges amongthe subscribers uniformly on the basis of eachsubscriber I s charges for the type of service made subj ect to such tax, fee or charge. Cancellation by Customer The subscriber may have service discontinued upon written notice to the Carrier. The Carrier shall hold the Subscriber responsible for paYment of all bills for service furnished until the cancellation date specified by the Subscriber or until the date that the written cancellation notice is received or until the service is disconnected, whichever islater. I f the customer orders service requiring specialfacilities dedicated to the customer'use and then cancels his order before the service begins a charge will be made to the customer for the non-recoverable portions of expenditures liabilities incurred expressly on behalf of the customer by carrier and not fully reimbursed by installation and monthly charge. If , based on theorder, any construction has either begun or been completed, but no service provided the non-recoverable cost of such construction shall be borne by the customer. Cancellation of Service by Carrier for Non-Payment Service continues to be provided until canceled by theSubscriber, in writing, or until discontinued by the Carrieras set forth below. The Carrier may render bills subsequent to the termination of service for changes incurred beforetermination. The carrier, upon five (5) days written notification to the subscriber may discontinue service for delinquent accounts without incurringany liability. The subscriber I s account isconsidered delinquent if , 30 days after renditionof bill , the carrier has not received full payment for service rendered hereunder. Company's Past Due notice shall be posted first inthe United States mail addressed to thecustomer I s last known address and will state the date of the notice and the date on or after which the service may be terminated for non-payment. Company I Past Due Notice will list a toll- free800 number (1-800-286-8241) for Customer Support for information regarding any deferred billing orother procedures which the Company may offer or for working out some mutually agreeable solution to avoid termination of the customer I s service. The liability of the Carrier for damages arising out of mistakes, omissions, interruptions, delayserrors, or defects in transmission occurring in the course of furnishing service and not caused by the negligence of the subscriber , commences upon activation of the service and in no event exceedsan amount equivalent to the proportionate charge to the subscriber for the period of service duringwhich such mistakes, omissions, interruptions, delays, errors or defects in transmission occur. For the purpose of computing this amount, a month is considered to have thirty (30) days. Carrier shall not be liable for any claim or loss, expense, or damage, including indirect , specialor consequential damage) for any interruption delay, error omission, or other defect in any service, facility or transmission , if caused by an Act of God , fire, war , civil disturbance, or act of Government. Carrier shall not be liable for , and shall befully indemnified and held harmless by the customer against any claim or loss, expense ordamage including indirect, special consequential damage, (i) for defamation, invasionof privacy, unauthorized use of any trademarktrade name or service mark, proprietary creative right, or any other injury to any person property or entity arising from the material , data information or content revealed to, transmitted,processed, handled or used by Carrier under customer; or (ii) for any act or omission of the customer; or (iii) no agent or employee of any other carrier shall be deemed to be an agent or employee of the carrier. The included tariff language does not constitute a determination by the Commission that a limitationof liability imposed by the Company should be upheld in a court of law. Acceptance for filingby the Commission recognizes that it is a court I s responsibility to adjudicate negligence andconsequential damage claims. It is also thecourt I s responsibility to determine the validity of the exculpatory clause. The carrier shall not be liable for any claim, loss or refund as a result of loss theft, or fraudulent use of account codes, authorization codes or access numbers issued with the companies debit or travel/calling card services. The carrier shall not be liable for any claim, N loss or refund as a result of subscriber receiving unwanted or unauthorized calls via carrier provided toll free number. The company shall not be liable for any claims, loss or refund as a result of any unauthorized use and/or any unauthorized person placing toll callsvia telephone numbers presubscribed to the company, casual calling, or any other type ofcall. The carrier shall not be liable for any claim loss or refund on any unused balance remaining on a debit account after the expiration date assigned to each debit account. Boise, Idaho SECTION 3 - DESCRIPTION OF SERVICES Timinq of Calls Usage The customer I s long distance usage charge is based on the actual usage. Usage begins when the called party picks up the receiver. When the called party picks up is determined by hardware answer supervision in whichthe local telephone company sends a signal to the switch or the software utilizes audio tone detection. A call is terminated and the charges end when either party hangs up. Time Periods The customer I long distance usage charge is based on the day and time the originating party makes the call. Distance Sensitivity The Company I s charges are based on the airline distance between Rate Centers located wi thin the State of Idaho. Calculation of Distance Usage charges for all mileage sensitive products are based on the airline distance between rate centersassociated with originating and terminating points ofcall. The airline mileage between rate centers is determined by applying the formula below to the vertical and horizontal coordinates associated with the rate centersinvolved.
