Tariffs 1.1 Reference to Other Tariffs and Rules Whenever reference is made in this tariff to other tariffs of the Telephone Company, the reference is made to the tariffs in force. Whenever reference is made in the tariff to Rules, the Rules in reference are established by the Federal Communications Commission or the Idaho Public Utilities Commission Rules and Regulations regarding customer service and the Idaho Administrative Procedures Act (I.D.A.P.A.), Section 31. The Idaho Public Utilities Commission has jurisdiction over disputes that cannot be satisfactorily resolved between the Company and the end-user customer. Idaho Public Utilities Commission PO Box 83720 Boise, ID 83720-0074 1-800-432-0369 1.2 Application of Tariff (A) This tariff contains regulations, rates and charges applicable to the provision of Local Exchange Service as indicated on a Section by Section basis provided by TETON TELECOM, to end users residing within the exchange boundaries of TETON TELECOM, as indicated on the Exhibit 19.1 Area Exchange Map following. (B) The provision of Local Exchange Service by the Telephone Company as set forth in this tariff does not constitute a joint undertaking with the end user or customer for the furnishing of any service. General Regulations 2.1 Undertaking of the Telephone Company 2.1.1 Scope (A) The Telephone Company does not undertake to transmit messages under this tariff. (B) The Telephone Company shall be responsible only for the installation, operation and maintenance of the services it provides. (C) The Telephone Company will, for maintenance purposes, test its services only to the extent necessary to detect and/or clear troubles. (D) Services are provided 24 hours daily, seven (7) days per week, except as set forth in other applicable sections of this tariff. (E) The Telephone Company does not warrant that its facilities and services meet standards other than those set forth in this tariff, or those as required by State or Federal Law. 2.1.2 Limitations (A) The end user may not assign or transfer the use of services provided under this tariff; however, where there is no interruption of use or relocation of the services, such assignment or transfer may be made to: (1) another end user, whether an individual, partnership, association or corporation, provided the assignee or transferee assumes, in writing, all outstanding indebtedness for such services, and the unexpired portion of the minimum period and the termination liability applicable to such services, subject to notification of the Telephone Company if any; or (2) a court-appointed receiver, trustee or other person acting pursuant to law in bankruptcy, receivership, reorganization, insolvency, liquidation or other similar proceedings, provided the assignee or transferee assumes the unexpired portion of minimum period and the termination liability applicable to such services, if any. General Regulations 2.1 Undertaking of the Telephone Company (Cont'd) 2.1.2 Limitations (Cont'd) (3) In all cases of assignment or transfer, the written acknowledgment of the Telephone Company is required prior to such assignment or transfer which acknowledgment shall be made within 15 days from the receipt of notification. All regulations and conditions contained in this tariff shall apply to such assignee or transferee. The assignment or transfer of services does not relieve or discharge the assignor or transferror from remaining jointly or severably liable with the assignee or transferee for all long distance toll existing prior to the time of the assignment or transfer, unless other specific arrangements have been made. (B) The installation and restoration of services shall be provided on a first-come first-served basis. The restoration of services shall be in accordance with Part 64, Subpart D, Appendix A, of the Federal Communications Commission's Rules and Regulations, which specifies the priority system for service restorable activities. 2.1.3 Liability (A) The Telephone Company's liability, if any, for its willful misconduct is not limited by this tariff. With respect to any other claim or suit, by an end user or by any others, for damages associated with the installation, provision, termination, maintenance, repair or restoration of service, and subject to the provisions of (B) through (G) following, the Telephone Company's liability, if any, shall not exceed an amount equal to the proportionate charge for the service for the period during which the service was affected. This liability for damages shall be in addition to any amounts that may otherwise be due the end user under this tariff as a Credit Allowance for a Service Interruption. General Regulations 2.1 Undertaking of the Telephone Company (Cont'd) 2.1.3 Liability (Cont'd) (B) The Telephone Company shall not be liable for any act or omission of any other carrier or customer providing a portion of a service, nor shall the Telephone Company for its own act or omission hold liable any other carrier or customer providing a portion of a service. (C) The Telephone Company is not liable for damages to the end user's premises directly resulting from the installation and removal of telephone equipment and associated telephone wiring. (D) The Telephone Company shall be indemnified, defended and held harmless by the end user against any claim, loss or damage arising from the end user's use of services offered under this tariff, involving: (1) claims for libel, slander, invasion of privacy, or infringement of copyright arising from the end user's own communications; (2) claims for patent infringement arising from the end user's acts combining or using the service furnished by the Telephone Company in connection with facilities or equipment furnished by the end user or customer, or; (3) all other claims arising out of any act or omission of the end user in the course of using services provided pursuant to this tariff. (E) The Telephone Company does not guarantee or make any warranty with respect to its services when used in an explosive atmosphere, electrical substation or switching station. The Telephone Company shall be indemnified, defended and held harmless by the end user or customer from any and all claims by any person relating to such end user's use of services so provided. General Regulations 2.1 Undertaking of the Telephone Company (Cont'd) 2.1.3 Liability (Cont'd) (F) No license under patents (other than the limited license to use) is granted by the Telephone Company or shall be implied or arise by estoppel, with respect to any service offered under this tariff. (G) The Telephone Company's failure to provide or maintain services under this tariff shall be excused by labor difficulties, governmental orders, civil commotions, criminal actions taken against the Telephone Company, acts of God and other circumstances beyond the Telephone Company's reasonable control, subject to the Credit Allowance for Service Interruption as set forth in 2.4.4 following. (H) The included tariff language does not constitute a determination by the Commission that a limitation of the liability imposed by the Company should be upheld in a court of law. Acceptance for filing by the Commission recognizes that it is a court’s responsibility to adjudicate negligence and consequential damage claims. It is also the court’s responsibility to determine the validity of the exculpatory cause. 2.1.4 Provision of Services The Telephone Company, to the extent that such services are or can be made available with reasonable effort, and after provision has been made for the Telephone Company's telephone exchange services, the Company will provide to the end user upon reasonable notice services offered in other applicable sections of this tariff at rates and charges specified therein. 2.1.5 Installation and Termination of Services The services provided under this tariff will; (A) include any entrance cable or drop wiring and wire or intrabuilding cable to that point where provision is made for termination of the Telephone Company's outside distribution network facilities at a suitable location inside an end user- designated premises and; (B) be installed by the Telephone Company to such point of termination. Such point will not exceed 50' inside of a building or structure, in accordance with the National Electric Safety Code (NESC). General Regulations 2.1 Undertaking of the Telephone Company (Cont'd) 2.1.6 Maintenance of Services The services provided under this tariff shall be maintained by the Telephone Company. The end user or others may not rearrange, move, disconnect, remove or attempt to repair any facilities provided by the Telephone Company, other than by connection or disconnection to any interface means used, except with the written consent of the Telephone Company. 2.1.7 Changes and Substitutions Except as provided for, equipment and systems subject to FCC Part 68 Regulations at 47 C.F.R. Section 68, the Telephone Company, may, where such action is reasonably required in the operation of its business: (A) Substitute, change or rearrange any facilities used in providing service under this tariff, including but not limited to, (1) substitution of different metallic facilities, (2) substitution of carrier or derived facilities for metallic facilities used to provide other than metallic facilities, (3) substitution of metallic facilities for carrier or derived facilities used to provide other than metallic facilities, and (4) or Fiber Optic Cable. (B) Change minimum protection criteria, change operating or maintenance characteristics of facilities or change operations or procedures of the Telephone Company. The Telephone Company shall not be responsible if any such substitution, change or rearrangement renders any end user furnished services obsolete or requires modification or alteration thereof or otherwise affects their use or performance. If such substitution, change or rearrangement materially affects the operating characteristics of the facility, the Telephone Company will provide reasonable notification to the end user in writing. Reasonable time will be allowed for any redesign and implementation required by the change in operating characteristics. (B) The Telephone Company will not discontinue service on any, Saturday, Sunday or legal holiday recognized by the State of Idaho, or after 12:00 noon on any Friday or any business day before any legal holiday, or at any time when the Telephone Company's business offices are not open for business, or from December 24 through January 2, inclusive. No specific advance notification period is applicable to all service activities. 2.1.11 Provision and Ownership of Telephone Numbers The Telephone Company reserves the reasonable right to assign, designate or change telephone numbers, any other call number designations associated with Exchange Services, or the Telephone Company serving central office prefixes associated with such numbers, when necessary in the conduct of its business. Should it become necessary to make a change in such number(s), the Telephone Company will furnish, to the end user, 30 days notice and explanation of the reason(s) for such change(s). Should a number change become necessary, the Company will provide number referral service (where available) free of charge for a period of six (6) months. 2.1.12 Provision and Ownership of Telephone Directories The Telephone Company reserves the right of ownership of the telephone directories provided to end users as an aid to the use of telephone service. The Telephone Company will furnish to its end users, without charge, one directory per line as a part of the local service charge. The Telephone Company will make available to the customer a method by which the directory can be disposed of, without cost to the customer. 2.1.13 Provision for Services to Disabled or Handicapped Persons (ADA) The Telephone Company will make provisions for and comply with the communications provisions of the Americans with Disabilities Act of 1990 (ADA). During such period of temporary discontinuance, credit allowance for service interruptions as set forth in 2.4.4 following is not applicable. 2.2.2 Unlawful Use The service provided under this tariff shall not be used for an unlawful purpose. Service will not be furnished if any law enforcement agency, acting within its jurisdiction, advises that such service is being used or will be used in violation of law, and secures proper legal orders to deny such service. (C) In such instances when termination occurs, as in 2.2.2(A) preceding, the Telephone Company shall be indemnified, defended and held harmless by the end user against any claim, loss or damage arising from the Telephone Company's actions in terminating such service. (D) The Telephone Company will comply with any call trace requests that are requested and performed in accordance with County, State and Federal law, and are properly requested by either a court order or completed form as shown in the Trap & Trace Procedures. (C) The use of ADAD(s) that do not automatically disengage the called party's line when the called party hangs up its receiver are prohibited, except for their use in security and alarm systems or other systems in which the called party has previously agreed to the ADAD's call and has consented to its line being engaged in this manner. (D) ADAD(s) are prohibited from making unsolicited calls before 9:00 a.m. or after 9:00 p.m. (E) ADAD(s) are prohibited from calling public safety numbers such as police, fire and emergency services. General Regulations 2.2 Use (Cont’d) 2.2.5 Business Service An end user being provided Local Exchange Service in the Company’s service area, where the Customer’s use of the telecommunications services is primarily of a business, professional, institutional or other occupational nature or where the service or any part of the service is provided at a business location. Under these circumstances, the service provided is classified as business service and business rates will apply. Business rates will apply to institutions such as churches, schools, hospitals, health care centers, non-profit groups and governmental bodies. The fact that business is conducted at a customer’s residence, but the telephone is not used for the purpose of enticing individuals to call the residential telephone number or another telephone number in order to obtain a service or product, will not cause a customer’s service to be classified or reclassified as a business service unless the residential telephone number is advertised by the customer in a Telephone Directory. For purposes of this definition, the customer shall include the end user, any member of the end user’s household or any person residing at the end user’s service address. (1) In the event the Customer advertises his/her residential telephone number in a business directory such as “Yellow Pages” or a similar directory, the Company will notify the Customer of its intent to reclassify the Customer’s service as business service based on that advertisement. If the Customer demonstrates that he/she was unaware that such an advertisement would be viewed by the Company as a basis to reclassify residential service to business service, the Company will permit the Customer to continue receiving residential service at the residential rates, but the Company will assign the Customer a new telephone number with no connection charges on a one-time basis, with no availability of call forwarding from the disconnected number. A service order and line connection charge will apply. If the customer chooses to advertise his/her new telephone number, his/her account will be charged business rates. (3) A business customer may choose to keep his/her current telephone number. If so, the following conditions must be met: (A) At the time a customer requests a change in status, Teton Telecom will take the account out of his/her business name and list his/ her account under the customer name. A service order charge applies at this time. When the next telephone directory, in which the advertisement appeared, is published and there is no listing for the business name, the account rate will be changed from business to residential service. No service order charge will apply at this time. It is the responsibility of the customer to notify the Telephone Company when the new directory is printed without the customer’s listing. 2.3 Obligations of the End User or Customer 2.3.1 Application for Service (A) As a condition of requesting local service, an end user will be required to provide a properly executed application for service. This application for service can be completed via telephone, facsimile, mail, or by coming to the local business office. (B) The Company may from time to time request end users that do not have applications for service on file to complete said application so as to maintain current and accurate customer information. Such damages will be the actual cost of the materials and the actual hours required for repair of the damage multiplied by the appropriate labor rate. Nothing in the foregoing provision shall be interpreted to hold one end user liable for another end user's actions. The Telephone Company will, upon reimbursement for damages, cooperate with the end user in prosecuting a claim against the person causing such damage and the end user shall be surrogated to the right of recovery by the Telephone Company for the damages to the extent of such payment. 2.3.3 Ownership of Facilities Facilities utilized by the Telephone Company to provide service under the provisions of this tariff shall remain the property of the Telephone Company. Such facilities shall be returned to the Telephone Company by the end user, whenever requested, within a reasonable period following the request in as good condition as reasonable wear will permit. 2.3.4 Equipment Space and Power The end user shall furnish or arrange to have furnished to the Telephone Company, at no charge, equipment space and electrical power required by the Telephone Company to provide services under this tariff at the points of termination of such services. The selection of ac or dc power shall be mutually agreed to by the end user and the Telephone Company. No credit will be allowed for any interruptions involved during such tests and adjustments. 2.3.6 Claims and Demands for Damages (A) With respect to claims of patent infringement made by third persons, the end user shall defend, indemnify, protect and save harmless the Telephone Company, its employees, or agents from and against all claims arising out of the combining with, or use in connection with, the services provided under this tariff, any circuit, apparatus, system or method provided by the end user. (B) The end user shall defend, indemnify and save harmless the Telephone Company, its employees or agents from and against any suits, claims, losses or damages, including punitive damages, attorney fees and court costs by third persons arising out of the construction, installation, operation, maintenance or removal of the end user's circuits, facilities or equipment connected to the Telephone Company's facilities. (C) The end user shall defend, indemnify and save harmless the Telephone Company, its employees or agents from and against any suits, claims, losses or damages, including punitive damages, attorney fees and court costs by the end user or third parties arising out of any act or omission of the end user in the course of using services provided under this tariff. 2.3.7 Subdivisions (A) Where builders or developers subdivide property into five (5) or more lots for the purpose of selling either residential or business lots, such builder or developer shall be required to do the following before the Telephone Company will provide telephone service in the subdivision: (1) Provide the Telephone Company with a complete plot plan of present and future divisions of the development area. (2) The Pre-Development fee which reimburses the Telephone Company for the cost of the engineering services required to design the proposed telephone plant in the development area. General Regulations 2.4 Payment Arrangements and Credit Allowances 2.4.1 Payment of Rates, Charges and Deposits (A) The Telephone Company may, in order to safeguard its interests, request a deposit or written guarantee. The company complies with deposit requirements as established by Idaho law. Such deposit or written guarantor will be held by the Telephone Company until a residential customer establishes and maintains good credit. For a business customer, they must maintain good credit and not be delinquent more than once in the previous twelve (12) month period. Such end user will be required to sign the Guarantee for Payment of Telephone Service and will receive a Receipt of Deposit. No such deposit will be required of an end user who can provide a letter of credit from a previous telephone company, or who is a successor of this company and has established good credit and has no history of disconnect for non- pay. Such deposit will be the actual or estimated rates and charges for the services ordered (both local and toll) for the average two (2) month period within the last twelve (12) month period as set forth in Section 17.1. The fact that a deposit has been made in no way relieves the end user from complying with the Telephone Company's regulations as to the prompt payment of bills. At such time as the provision of service to the end user is terminated, the amount of the deposit will be credited to the end user's account and any credit balance which may remain will be refunded. Such a deposit will be refunded or credited to the account when the end user has established credit or, in any event, after the end user has established a six (6) month active service and has a prompt payment record (no disconnect for non-pay) at any time prior to the termination of the provision of the service to the end user. In case of a cash deposit, for the period the deposit is held by the Telephone Company, the end user will receive interest at a rate set forth in I.D.A.P.A. 31.41.01 on annual basis. The interest rate will be applied as simple interest from the date the end user deposit is received by the Telephone Company to and including the date such deposit is credited to the end user's account or the date the deposit is refunded by the Telephone Company. The bill day (i.e., the billing date of a bill for an end user for Local Exchange Service under this tariff), the period of service each bill covers and the payment date will be as follows: (1) The Telephone Company will establish a bill day each month for the end user account. The bill will cover non- usage sensitive service charges, per month charges for the ensuing billing period for which the bill is rendered, any known unbilled non-usage sensitive charges for prior periods and unbilled usage charges (toll) for the period after the last bill day through the current bill day. Any known unbilled usage charges for prior periods if applicable, and any known unbilled adjustments will be applied to this bill. When a service is discontinued prior to the expiration of the minimum period, charges are applicable, whether the service is used or not, as follows: (A) When a service with a one (1) month minimum period is discontinued prior to the expiration of the minimum period, a one (1) month charge will apply at the rate level in effect at the time service is discontinued. An interruption period starts when inoperative service is reported to the Telephone Company, and ends when the service is operative. For purposes of administering the following regulations a major fraction shall mean more than half of the incremental credit period using the unit of time in which the service interruption is measured. (B) When a Credit Allowance Applies In case of an interruption to any service, allowance for the period of interruption, if not due to the negligence of the end user, shall be as follows: The company will credit a customer’s account by the amount equal to the monthly rate for one month of basic exchange service (Local Exchange Service) if the customer reports an out-of-service condition which has deteriorated service to the extent that the customer cannot make local calls or cannot receive local calls or cannot use the service for voice grade communications because of cross talk, static, or other transmission problems, and service is not restored (1) within sixteen hours after the report of the outage in the customer notifies the Telephone Company that the service outage creates an emergency for the customer; or (2) within 24 hours after the report of the outage if no emergency exists, except that outages reported between noon on Saturday, and 6:00 p.m. on the following Sunday must be restored within 48 hours or by 6:00 p.m. on the following Monday, whichever is sooner. (6) Interruptions of service when the end user has released that service to the Telephone company for maintenance purposes, to make rearrangements, or for the implementation of an order for a change in the service during the time that was negotiated with the end user prior to the release of that service. Thereafter, a credit allowance as sent forth in (B) preceding applies. (7) Periods when the end user elects not to release the service for testing and or repair and continues to use it on an impaired basis. (D) Use of an Alternative Service Provided by the Telephone Company Should the end user elect to use an alternative service provided by the Telephone Company during the period that a service is interrupted, the end user must pay the tariffed rates and charges. In no case will the credit allowance exceed the monthly rate for the service surrendered in any one (1) monthly billing period. 2.4.5 Re-establishment of Service Following Fire, Flood or Other Occurrence (A) Non-recurring Charges Do Not Apply Exchange Order, Line Connection and Installation Charges do not apply for the re-establishment of service following a fire, flood or other occurrence attributed to an Act of God provided that: (1) The service is of the same type as was provided prior to the fire, flood or other occurrence. (2) The service is for the same end user. (3) The service is at the same general location on the same premises. (4) The re-establishment of service begins within 60 days after Telephone Company service is available. (The 60 day period may be extended a reasonable period if the renovation of the original location on the premises affected is not practical within the allotted time period). Airline Mileage: The shortest distance between two (2) locations. Applicant: The residential or business end user making application to the Company for Local Exchange Service, or other services as are defined herein. Authorized User: A person, firm or corporation (other than the end user) on whose premises a Local Exchange Service is located and who may communicate over such service in accordance with the terms of this tariff. Automatic Dialing and Announcement Device: A device which dials telephone numbers it has been programmed to dial and plays a recorded message when a call is answered. There are two (2) types of automatic dialing and announcement devices: those used for solicitation calls and those used for non-solicitation calls. Business Day: The term "Business Day" denotes the time of day that the Telephone Company is open for business. Generally, Monday through Friday. Business End User: An end user being provided Local Exchange Service in the Company’s service area, where the Customer’s use of the telecommunications services is primarily of a business, professional, institutional or other occupational nature or where the service or any part of the service is provided at a business location or listed in the yellow pages. Class of Service: A description of Local Exchange Service furnished an end user which denotes such characteristics as nature of use - residence or business - (public, semi-public or private). Commission: The term "Commission" denotes the Idaho Public Utilities Commission. Common Line: The term "Common Line" denotes a line (business, residence, or pay telephone line or other facility) terminated on a central office switch. Customer: The term "Customer(s)" denotes any individual, partnership, association, joint-stock company, trust, corporation, or governmental entity, other entity, or organization which subscribes to the services offered under the Company's interstate or intrastate exchange tariff, including both Inter-exchange Carriers (ICs) and End Users. End Office Switch: The term "End Office Switch" denotes a local Telephone Company switching system where Telephone Exchange Service and user station loops are terminated for purposes of interconnection to trunks and other end user station loops. End User: The term "End User" means any subscriber of a Local Exchange Service that does make such service available to others, directly or indirectly for the purpose of reselling interstate, intrastate or local exchange services. Entrance Facilities: Facilities extending from the point of entrance on private property to the premises on which service is furnished. Exchange: The term "Exchange" denotes a unit, established by the Telephone Company for the administration of communications service in a specified area which usually embraces a city, town or village and its environs. It consists of one or more central offices together with the associated facilities used in furnishing communications service within that area. Exchange Area(s): The territory served by an exchange. Exchange Line: The circuit with one termination at the Central Office and the other termination at the protector of the end user's designated premises. Extension Line: A circuit connecting a primary exchange line which ends at one protector to an extension exchange line which ends at an extension protector, both serving the same end user and utilizing the same telephone number. Extension lines may be provided as premises extensions or as off premises extensions as defined herein. Facilities: All the plant and equipment of the Company owned, operated, licensed, used, controlled, furnished or supplied for or by the Company, including any construction work in progress allowed by the Commission. Flat Rate Service: Local exchange service furnished at a fixed monthly charge. First-Come First-Served: First-come first-served shall be based upon the received time and date stamped by the Telephone Company on complete and accurate end user orders which allow the Telephone Company to initiate its ordering process. Inaccurate or incomplete end user orders shall not be deemed to have been received until such time as the end user corrects such inaccuracies and/or omissions. The end user shall not be penalized for any delay in the Telephone Company review process beyond 24 hours of receipt. Once having been advised of the errors and/or omissions, any delay in correction on the part of the end user shall be added to the received time and date. The Telephone Company will make every effort to accommodate a requested modification when it is able to do so with the normal business hours. If the end user requested service date is more than 30 calendar days after the original service date, the order will be canceled by the Telephone Company and reissued. If the Telephone Company determines it can accommodate the end user's request without delaying service dates for orders of other end users, a new service date may be established. An order change charge as set forth in Section 17.2(A)(2) following will apply to all service date changes of 30 days or less. (B) Change Charge - Partial Cancellation Any decrease in the number of ordered Exchange Services will be treated as a partial cancellation and the order change charges as set forth in Section 17.2(A)(2) following will apply. (2) When an end user cancels an Exchange Order for the installation of service, a Cancellation Charge will apply as follows: (a) Installation of Local Exchange Service is considered to have started when the Telephone Company incurs any cost in connection therewith or in preparation thereof which would not otherwise have been incurred. (b) Where the end user cancels an Exchange Order prior to the start of installation of facilities, no charges shall apply. (c) Where installation of facilities has been started prior to the cancellation, the charges shall be the greater of 1) the costs incurred in such installation (including the non-recoverable cost of equipment and material ordered, provided or used, plus the non-recoverable cost of installation and removal including the costs of engineering, labor, supervision, transportation, rights-of-way and other associated costs), less the estimated net salvage as determined by the Telephone Company; or 2) the charge for the minimum period for the Local Exchange Service involved. If the Telephone Company determines that the service can be provided on the requested date and that additional labor cost or extraordinary costs are required to meet the requested service date, the end user will be notified and will be provided with an estimate of actual cost, not to exceed 10 percent over estimated charges. The Telephone Company reserves the right to charge end users for additional directories covering their primary directory area and for directories covering other than their primary directory area. (B) Additional listings, where the listings appear in the directory, will automatically be included in each directory issue unless notice to the contrary is received from the end user. (C) Non-Listed telephone service will be furnished, at the end user's request, providing for the omission or deletion of the end user's telephone listing from the telephone directory. In such case, and in case of an error in or omission of the name listing of an end user, the correct listing and number shall be available through directory assistance. 8.4 Limitations (A) All listings must conform to the Telephone Company's specifications with respect to its directories. (B) Additional listings are available only in the names of authorized users of the end user's service. (C) Business additional listings are not permitted in connection with residential service. (D) The contract period for additional listings, where the listing appears in the directory, is the annual directory period. (See also 8.3 (A) above.) (E) The Telephone Company shall not be liable for damage claimed on account of errors in or omissions from its directories; nor from the result of the publications of such errors in the directory; nor will the Telephone Company be a party to controversies arising between the end users or others as a result of listings published in its directories. (F) The Telephone Company assumes no liability for an error or omission in the alphabetical section of the telephone directory. The only action taken in this case would be the cancellation of the charges and refunding of any charges already paid, for the directory advertising in question. (I) The Telephone Company will not be liable for failure or refusal to complete a call to a non-published telephone service. (J) The Telephone Company will try to prevent the disclosure of the number of a non-published telephone service, but will not be liable should such number be divulged inadvertently. (K) When an end user with non-published telephone service places a call over a 911 service to a public safety answering point, and the public safety answering point attendant places such call on called party hold, and such call is represented to the Telephone Company to be of an emergency nature, the Telephone Company will release, upon request by such public safety attendant, the name and address of the calling party. 8.5 Obligations of the End User In addition to the obligations set forth in Section 2.3 preceding, the end user is responsible to properly notify the Telephone Company of his/her desire to cancel supplementary directory listing service. 8.6 Payment Arrangements and Credit Allowances (A) Minimum Periods The minimum period for supplemental directory listings is one (1) year (the annual directory year). Premises Extension Service requires the Telephone Company to put two or more protectors on a single Local Exchange Service. 9.2 Undertaking of the Telephone Company (A) The Telephone Company will provide Premises Extension Service on an end user's premises or off-premises service to another premises of the same end user. (B) The Telephone Company will provide Line Extension Service from the Telephone Company's side of the protector (Telephone Company termination) or the pedestal serving the protector. 9.3 Limitations (A) Premises Extension Service can only be provided in conjunction with Local Exchange Service. (B) Under no circumstances will the company provide Premises Extension Service to combine the services of two (2) or more end users unless each of the end users have and continue to maintain Local Exchange Service. (C) Premises Extension Service will only be provided within the Local Exchange. (D) Premises Extension Service will not be provided by the Telephone Company from the end user's side of the protector (Telephone Company termination). Optional Services Optional Services are provided by the Telephone Company to enhance the utility of Local Exchange Service to the end user on a per line basis where available. 10.1 General Description Optional Services are provided in conjunction with Local Exchange Service and includes the following: 10.2 Definitions (A) Abbreviated Dialing - an arrangement which provides for the calling of a telecommunications network telephone number by dialing an abbreviated code. (B) Anonymous Call Rejection - allow subscribers, with or without caller identification services (caller ID), to reject calls from which calling number display information has been intentionally blocked. Only calls for which the information has been blocked are rejected. Rejected calls are sent to a local Telephone Company announcement. (C) Automatic Recall - enables a subscriber to call the last person who called them. This applies whether to call was answered or unanswered. (D) Call Forwarding - an arrangement whereby incoming calls may be transferred to another telephone number by signaling a prefix code and the telephone number of the service to which calls are to be transferred. Calls forwarded outside the local or extended area service calling area by this feature are subject to long distance message charges. These calls are also subject to transmission limitations. There are several forms of Call Forward available to the end user such as forwarding from the end users home, forwarding from the central office and forwarding from another number. (E) Caller ID - will enable the customer to preview the calling number on incoming calls via a customer owned display device. Each customer will also have the ability to suppress or block their directory number from being sent on a per call basis. This service may provide long distance as well as local preview. The called party will receive a “private” message instead of the calling party’s telephone number. Per Line Blocking may be ordered from the company at rates specified in Section 20.11. Per Call Blocking can be activated by the calling party on a per call basis at no charge to the calling party. (G) Customer-Originated Trace - allows subscribers to initiate a trace on the last incoming call by dialing an activation code. The call is traced automatically, and the printout of the originating number and the time the call was made is forwarded to a predetermined Telephone Company location, not to the subscriber. The subscriber then contacts the law enforcement agencies to determine further action. (H) Call Waiting - an arrangement whereby a customer who is using an exchange line arranged for call waiting is alerted, by means of a tone signal, when another caller is trying to reach that line. The customer, by flashing the switchhook, is able to have alternative conversation between parties. (I) Cancel Call Waiting - an option that allows a subscriber to prevent, on a per-call basis, any incoming calls from Call Waiting on his/her line. Incoming calls to the station receive busy treatment. This feature ensures that Call Waiting indication tones will not interrupt important calls or disrupt data transmission. This feature can be activated prior to placing a call or after a talking connection has been established (for the latter, Three Way Calling must also be assigned to the line). Optional Services 10.2 Definitions (Cont’d) (J) Distinctive Ring - an arrangement which allows more than one (1) directory number to terminate on the same line. Each directory number, when dialed, has its own distinctive ring and can be distinguished from the main number assigned to that line. Sometimes referred to as "teen service" because it allows teenagers or others in the home to have a separate directory number of their own in the same household. The charge for distinctive ring includes an additional listing in the directory for the distinctive ring directory number and a corresponding name. Teen service cannot be used as an additional number for business purposes or in lieu of ordering a second business line. (K) Distinctive Ring/Call Waiting - is an incoming call management feature that allows subscribers to create a list of callers of high priority. Any incoming calls on this list are indicated by a distinctive ringing pattern or a distinctive Call Waiting tone, if applicable. Incoming calls from telephone numbers which are not on the list, or which cannot be identified, are given standard ringing treatment. (L) Distinctive Ring/Call Forward Mode - distinguishes whether to forward the secondary number along with the primary number. (M) Last Number Redial - enables the subscriber to have the system redial the last number called from his/her station. This will apply regardless of whether the original call was answered, unanswered or encountered a busy tone. The system will monitor the calling and called lines and will attempt to connect the call for up to 30 minutes. The activation of this feature can be canceled by the customer when desired. If the calling party’s number is blocked, it will not be revealed by this feature. (N) Number Referral Service - an arrangement which allows for interception of a disconnected directory number, with a digital voice recording telling the intercepted party the new directory number that has replaced the disconnected number. Optional Services 10.2 Definitions (Cont’d) (O) Three-Way Calling - an arrangement which permits an existing call to be held and a second call to be established and added to the connection for conferencing. Conference calls made with this service are subject to transmission limitations and applicable toll charges. (P) Selective Call Acceptance - allows subscriber to define a list of calling directory numbers that will be accepted. Any calling numbers not on the list are routed to announcements and rejected. The calling party not on the acceptance list receives an announcement stating that the call is not presently being accepted by the called party. Subscribers can review and change the list of accepted directory number as desired. (Q) Selective Call Forward - allows subscribers to have pre-selected telephone numbers, which have been added to a Selective Call Forward Screening List, forwarded to a designated remote telephone number when they call the end user. Any incoming calls from telephone numbers which are not on the end users Select Forward List will not be forwarded. (R) Selective Call Rejection - allows subscribers to define a list of calling numbers to be screened. Any calling numbers on this list are automatically routed to announcements and rejected. All other calls are treated normally. The calling party on the rejection list receives an announcement stating the call is not presently being accepted by the called party. (S) Toll Denial - an arrangement which permits the end user to dial local service area calls but does not permit the origination of long distance calls. In addition, this arrangement denies the user access to "ZERO" (Operator) dialing. Access to 911 is provided with this feature. (T) Toll Restriction - an arrangement which permits the end user to dial local service area calls. In addition, this arrangement permits the use of a calling card from the end user phone. Optional Services 10.2 Definitions (Cont’d) (U) Trunk Hunting - an arrangement which allows for the selection of the end user's next available line when the line associated with the called number of the end user is busy. (V) Warm Line - is an automatic line feature which allows the subscriber a specific amount of time to dial a number before it automatically dials a predesignated number. This allows the residential subscriber to use the telephone normally but to go to a designated number simply by staying off hook. (W) Telemarketer Block - gets telemarketers off the line with a recorded message that tells marketers to stop calling and ends the call. (X) Do Not Disturb - allows users of this service to block incoming calls from ringing during a specified period of time. If the user desires, they can provide a four-digit Override Code to specific callers (i.e. family members) to allow them to connect. (Y) Wake Up Service - provides a wake up announcement system for hotels, motels and residential subscribers. It allows the user to schedule up to 2 wake up calls at any time within the next 24 hours. 10.3 Undertaking of the Telephone Company Subject to Commission notice, the Telephone Company may provide certain Optional Features in package offerings at reduced rates. Promotional Offering may be available at times. These promotional offerings may be available without installation charges. 10.4 Limitations (A) Optional Services are available only in those exchanges where the central office equipment is available to provide such services. (B) The acceptance of long distance collect call messages is not restricted by the use of Toll Restriction. (C) Optional Services are only available on single party service. Paystation Service 11.1 General Description Paystation Service provides telephone service to a customer-leased or owned paystation with or without coin collecting devices. A Paystation line permits providers of such services to provide pay telephone services to the public. 11.2 Definitions Coin Supervision - Provides signaling capability from the central office for paystations that do not have signaling capability within the telephone. This signaling capability provides operators and/or operator systems coin control where such facilities are available. Customer - For the purposes of this tariff, the customer is the Paystation Service Provider. Network Interface Device - A company-provided jack or its equivalent. It is the point of connection between the Company owned wiring and wiring owned by the customer. For the purposes of this tariff, the network interface device will be installed at a location mutually agreed upon by the customer and the Company. Originating Line Screening (OLS) - Enables operator service providers to determine whether there are billing restrictions on the exchange line from which a call originates. OLS service delivers codes on operator assisted calls to identify calls originating from privately owned paystation, inmate locations, and hotels/motels, etc. Rates for this service are found in the appropriate intrastate tariff (Section 17.8), when facilities and service are available. Paystation Line - A basic coin transmission dial tone line. It is a line side connection from the local exchange switch to the point of demarcation at the customer premises. Selective Class of Call Screening - Enables the customer to restrict outgoing operator-handled calls, placed over the Company’s network, from the service point to only those calls which are charged to a called telephone, a third number or a calling card. Selective Class of Call Screening will be provided at the customer’s option, where such facilities are available. Paystation Service 11.3 Undertaking of the Telephone Company (A) Paystation Service will be considered a Paystation Line service for the purpose of applying the terms, rates and conditions found elsewhere in this tariff. (B) Only one paystation instrument may be connected to each Paystation Line. Extensions are not permitted. (C) Requests to Directory Assistance Service originated from paystations will be charged the applicable rate of the Directory Assistance Service Provider. (D) Directory listings may be provided under the regulations that govern the furnishing of listings for business customers. (E) Coin-free operator and emergency 911 access must be available from all paystations. (F) One directory will be distributed to the customer without charge for each paystation line. (G) The Company reserves the right to disconnect service when the customer does not comply with the F.C.C. and state rules and regulations related to paystation service and equipment. (H) The Multiline Business Subscriber Line Charge found in the interstate tariff, is applicable to all paystation lines. 11.4 Obligations of the End User (A) The end user shall be responsible for the installation, operation and maintenance of any paystation instrument used in connection with this service. (B) The end user is responsible for the provision of booths, shelves, directories and all other ancillary equipment. Construction Charges Construction charges for line extension consist of additions to plant beyond existing leads, and do not include additions to plant where total costs are under $1,600.00. Construction charges for line extensions are applied to subscriber applicants with abnormally long extension requirements to prevent unreasonable burdening the general body of existing subscribers. All line extensions will be owned by the Company. 12.1 General Description (A) Construction charges for line extensions as set forth in this section apply in connection with all types of service when established by means of an extension to the Company's plant consisting of buried or overhead construction, including extensions by means of poles, or other methods, if determined feasible by the Company, to be owned by the Company, or jointly with others and by means of contacts or contact space on poles of others. The Company shall determine the type of construction to be used. (B) The word "cost" when used in this section, means the "installed plant cost" consisting of labor, materials, equipment hire, rental or use of Company owned equipment, and/or contract services such as road pushes, road crossings, dry road boring, backhoe use or trenching, engineering and any other overhead expense associated with the construction. The "cost" will include any fee or charge exacted by any municipality, county, state or federal government or private party for street crossings, right-of-ways, use of roads, land or facilities. 12.2 Undertaking of the Telephone Company - Single Applicants (A) The locations for construction of line extensions are determined by the Telephone Company and the distances (including drop wire) are measured along the route so selected. (B) Construction to serve two (2) or more customers, whether on public right- of-way or private easements, may be used for serving subscribers in general. Construction Charges 12.2 Undertaking of the Telephone Company - Single Applicants (Cont’d) (C) The total extension to plant (along public roads or on private property) to be furnished without charge (Aid-to-Construction provided by the Telephone Company) shall not exceed $1,600 per application. Where the total extension exceeds $1,600, the applicant will reimburse the Company the total amount exceeding $1,600 prior to construction. (D) Line extension charges assessed to applicants will be based on the Rules as set forth herein and approved by the Idaho Public Utilities Commission. In case of disagreement or dispute regarding the application of these rules, or in circumstances where the application of these rules appear impracticable or unjust to either party, the utility, applicant, or applicants may refer the matter to the Idaho Public Utilities Commission for ruling. (E) When construction is required to serve a new applicant, a survey is made of all prospective subscribers who might be served from the new construction or an extension thereof, and who might benefit by being included in the project. Construction allowances are made only for those prospective subscribers making a written application for service. (F) All applicants are grouped in a single project when there is not more than one-half (½) mile of construction between successive applicants. Separate projects are established whenever the construction between any two (2) successive applicants exceeds one-half (½) mile. Two or more projects are combined, however, whenever this results in lower charges (or no increase in charges) for all of the applicants involved. (G) The Company will provide the applicant, at any premises, only a single line extension and drop wire allowance regardless of the number of services ordered at that premises. 12.3 Undertaking of the Telephone Company - Group Applicants (A) Applicants ordering service at more than one premises are treated as separate applicants at each premises for purposes of this schedule; however, a single applicant may only receive construction allowance for one of those premises. Construction Charges 12.3 Undertaking of the Telephone Company - Group Applicants (Cont’d) (B) For the purpose of determining project charges, the collective construction allowance for the group is subtracted from the overall Line Extension costs required for service. The total project cost is then divided equally among all applicants. Exceptions: (1) No applicant is required to pay a higher charge than he would if the project were established for him alone. Any difference between this charge and the average charge for the group is absorbed by the Company. (2) Charges for extensions to plant on private property, including drop wire, are assumed by applicants on whose property such extensions are made and these charges are not included in the overall charges for the project. (C) When a new applicant can be served from a completed project, within three (3) years from the date service was initially established for such project, the charges for the entire project are recomputed to include the new applicant. The new applicant pays a prorated amount of the line extension charge based on the number of months (a fraction of a month is counted as a full month) remaining in the original three (3) year term. The time is computed from the date service is established for the new applicant. (D) Where additional construction is required for an applicant to be served for a project less than three (3) years old, the cost of the project is computed as above if such recomputation does not increase the charges to those customers served from the existing project. Otherwise, a new project will be established. (E) When a project is recomputed as described above, existing subscribers will be refunded a prorated amount of the difference between the original charges and the recomputed charges, based on the remainder of the three (3) year term. Recomputation of the charges, due to the addition of new applicants, is made on the assumption that there have been no disconnects. Construction Charges 12.4 Undertaking of the Telephone Company - Subsequent Applicants (A) When construction on private property is subsequently treated as being on public roads, or where a private road is dedicated to the public use, within three (3) years of completion of the original project, the line extension charges shall be recomputed and refunds made to the initial applicants where applicable. (B) When one (1) or more subscribers on a project disconnect within the three (3) year term, no refund is made of the line extension charge to the disconnected subscribers. Charges to remaining subscribers are not affected by disconnects. (C) When a subscriber disconnects service or moves off the project and service is established for a new applicant at the same location, any adjustment in charges is a matter for negotiation between the original subscriber and the new applicant. (D) Where a subscriber is disconnected for any reason, and subsequently re- applies for service from the same premises or another premises on the same project, the subscriber will not be required to pay any additional line extension charges in addition to his/her total original obligation. 12.5 Limitations - Real Estate Subdivision (A) Line extensions into real estate subdivisions will be made by the company provided ninety percent (90%) of the estimated total cost of such extension is advanced to the Company by the subdivider. Upon completion of construction of the feeder and distribution plant facilities, transfer of ownership of such facilities to the Telephone Company must be made. The Telephone Company will refund back to the developer the amount so advanced when fifty percent (50%) of the estimated total telephone services or lots are connected within the subdivision during a period of five (5) years from the date of agreement. Change of ownership for a lot which previously subscribed to telephone service would not constitute a new end user. Construction Charges 12.5 Limitations - Real Estate Subdivision (Cont’d) Customers that have subscribed to vacation service do not qualify for inclusion in the refund. The Telephone Company will not refund to the developer amounts in excess of the total construction costs which the developer paid for the installation of the facilities, including the initial engineering costs. At the end of the five (5) year period, the balance not refunded shall be considered Contributions in Aid to Construction. The subdivider shall notify the Company, in writing, when the fifty percent (50%) occupancy has been attained. Final evaluation will be made by the Company. (B) Line extensions and/or additions to provide service to an applicant engaged in temporary or speculative business will be made on the condition that applicant pays to the Company the total cost of the construction and removal of the line necessary in furnishing the service, less the salvage value of the material used. (C) If a subscriber maintains for thirty-six (36) consecutive months, a service installation which was originally established on a temporary or speculative basis, and if his/her business or operation, at the end of that time, has proven its permanency to the satisfaction of the Company, there will be refunded to the subscriber an amount equal to the difference between the payment made and the normal line extension charge which would have been applicable at the time the subscriber's service was installed. (D) In no event shall service installation be classed as temporary or speculative for more than five (5) years. Refund provisions apply at the end of not more than five (5) years. Construction Charges 12.5 Limitations - Real Estate Subdivision (Cont’d) (E) Arrangements on an individual case basis, other than provided for in this section, may be made in the following cases, subject to prior authorization of the Idaho Public Utilities Commission: (1) Where the applicant requests a particular type of construction or a specific route for extensions to meet the applicant's special requirements and where the construction or route so requested differs from the normal standards of the Company and is not required by law. (2) Line extensions involving underground crossing of railroads, highway or power lines, submarine cable, or along river crossings. (3) Where construction is required to provide service on a seasonal basis, or to meet other unusual conditions. (4) Any other line extension and/or additions involving unusual or disproportionately large construction expenditures as compared to the usual line extension. 12.6 Mobile Home Parks A developer who prepares a tract of land for the purpose of parking mobile homes, needs to sign the Trailer Park Agreement for Underground Distribution System, and the mobile home developer is required to provide a trailer stake or pedestal post at the back side, between every two (2) mobile home parking lots for the purpose of attaching the protector on the trailer stake or pedestal post outside of the mobile home. In no case will telephone service be provided when the protector is attached to the mobile homes. 12.7 Obligations of the End User (A) When a charge is applicable for construction on either a public road or private property, the end user may undertake, where in the opinion of the Telephone Company it is practical for him/her to do so, such trenching in whole or in part, in lieu of the partial construction charges IDAHO PUBLIC UTILITIES COMMISSION Approved Effective Sept. 23, 2005 Sept. 29, 2005 Jean D. In all cases of construction the end user, may provide the trenching which is subject to the approval of the Telephone Company. An appropriate hourly engineering charge applies for the Telephone Company's supervision of the project. The demarcation point shall generally be the building or premises receiving service. (B) The estimated cost of the line extensions are payable in advance. In the event of overcharge, refunds to applicants will reflect the difference between the estimated cost and the actual cost of the line extension. In the event of undercharge, the Company shall bill the applicant for an amount not to exceed ten percent (10%) above the estimated extension costs. Any adjustments between the estimated costs advanced by the applicant and the reasonable actual cost shall be made within ninety (90) days after completion of the extension. 12.8 Payment Arrangements and Credit Allowances (A) Payment for Construction Charges is due in full at the estimated price prior to the start of construction. 12.9 Rate Regulations (A) Extensions and additions to plant necessary to provide telephone service within $1,600 along existing exchange telephone circuits of this utility, are provided at no charge. Special Service Arrangements Special Service Arrangements are provided in this tariff to accommodate the special requests of local service customers for telephone service not provided for in other places of this tariff. 13.1 General Description Special Service Arrangements are those telephone services provided to local service end users to meet the specialized needs of the local service customer where such needs cannot be provided by other provisions of this tariff. 13.2 Undertaking of the Telephone Company (A) The Telephone Company will provide the end user with a written estimate of the cost of a special service arrangement, or a written notice that such special service arrangement cannot be provided by the Telephone Company and the reason that it cannot be provided. (B) Whenever the special service arrangement includes use of tariffed services, the tariffed services will be included at the tariffed rates. 13.3 Limitations (A) The Company does not hold itself out to provide all the special arrangements that a customer may request. However, the Company will make a reasonable effort to provide the services requested. (B) Special service arrangements will only be provided in accordance with the Contract to Provide Special Service Arrangements. (C) Special service arrangements provided under this tariff for regulated equipment and services only. Deregulated customer premises equipment and other services are not offered by the telephone company under this tariff. 13.4 Obligations of the End User (A) The end user is obligated to perform the terms of the Contract to Provide Special Service Arrangements, in addition to the obligations of the end user as are set forth in Section 2.3 preceding. Engineering and Labor Services In this section, normally scheduled working hours are an employee's scheduled work period on any given business day, which totals eight (8) hours. 14.1 Engineering Services 14.1.1 Normal Engineering Services Normal Engineering Services are provided when: (A) An end user orders service which requires the end user to pay Contributions in Aid to Construction and the Telephone Company is required to design the facilities for the end user. (B) A developer pays a pre-development fee and submits the required plot plan of present and future divisions of the subdivision and the Telephone Company designs the proposed layout of the telephone plant in the development area. (C) An end user constructs his/her own facilities and Telephone Company personnel inspect the installed facilities to determine if they meet the specifications of the Telephone Company prior to the provision of telephone service. 14.1.2 Additional Engineering Services Additional Engineering Services are provided when: (A) The end user or developer requests additional technical information after the Telephone Company has already provided the proposed layout of the telephone plant and provided the specification requirements. (B) Engineering time is spent by the Telephone Company to engineer an end user's or developer's request for a construction project that is customized (other than usual). 14.1.3 Charges for Normal and Additional Engineering The charges for Normal and Additional Engineering are the current Teton Telecom labor rates. (B) Labor is utilized to construct telephone facilities for a developer in a subdivision or mobile home park during normal business hours. 14.2.2 Additional Labor Services Additional labor is that labor requested by the end user on a given service and agreed to by the Telephone Company. The Telephone Company will notify the end user that additional labor charges apply before any additional labor is undertaken. Additional labor charges apply when: (A) Installation of service is provided by the Telephone Company outside of the normally scheduled working hours. (B) Repair work is performed to repair damaged facilities caused either accidentally or intentionally by the customers, and either the end user or the Telephone Company determines that repair must be made outside of the normally scheduled working hours. 14.2.3 Normal and Additional Labor Charges The charges for Normal and Additional Labor are the current Teton Telecom labor rate. (C) The Telephone Company will not charge for Directory Assistance Service from hospital telephones or from residential telephones where the end user has been affirmed, in writing, as unable to use a Telephone Company provided directory because of visual or physical handicap. (D) The Telephone Company will not charge for Directory Assistance Service for newly assigned telephone numbers that have not been included in the annual telephone directory until such time as they are included in the annual telephone directory listings. (E) Credit card billing will be acceptable for Directory Assistance Charges. The call must be placed through a Directory Assistance Operator. (F) The Telephone Company will charge for Directory Assistance Service from any Paystation. 15.3 Limitations A maximum of two (2) requested telephone numbers is allowed per call. 15.4 Obligations of the End User The obligations of the end user are as set forth in Section 2.3 preceding. Vacation Service 16.1 General Description Vacation Service provides for the maintenance of the same telephone number on a year-to-year basis for end users that subscribe to telephone service during at least six (6) months of the year, but return every year. This service allows for the publication of the telephone number in the telephone directory, but does not allow for special notations. Vacation Service will be allowed for only six (6) months of any given year. 16.2 Undertaking of the Telephone Company The Telephone Company will suspend the telephone number of the end user in the central office when the end user requests the line be suspended and hold its use for a period of six (6) months, at which time the Company will automatically reconnect the service. The end user may request service reconnection any time prior to the six (6) month maximum time limitation. 16.3 Limitations Vacation Service does not eliminate the Exchange Order Charge upon the reconnection of service. Customer will be responsible to pay one-half (½ ) of the Federal and State surcharges. 16.4 Obligations of the End User In addition to the obligations of the end user are as set forth in 2.3 preceding the following provisions apply: (A) The end user is required to notify the Telephone Company of their request for vacation service. 16.5 Payment Arrangements and Credit Allowances The payment arrangements and credit allowances as set forth in 2.4 preceding apply, except as follows: (A) The minimum period for application of a credit is one (1) month. 16.6 Rate Regulations Vacation Service will be provided at the rates set forth in Section 17.11 following. Telephone Service Assistance Assistance to qualifying low-income subscribers for the provision of telephone service is available through joint Federal and State Programs that make funds available to qualifying individuals for local residential service. The State Program is called the Idaho Telephone Service Assistance Program (ITSAP) and provides a $2.50 per month credit to qualifying subscribers. The Federal Program, called Lifeline, provides a monthly credit to be applied to qualified subscriber bills. 18.1 Idaho Telephone Service Assistance Program (ITSAP) (A) The program is administered by the Idaho Department of Health and Welfare in accordance with Idaho Code Section 56-901. (B) Telecommunication Carriers providing basic local exchange service shall provide assistance in the form of a monthly discount to eligible subscribers of basic local exchange service of $2.50. (C) In no case will the discount exceed the rate charged for the grade of basic local exchange service subscribed to by such eligible individual subscriber. (D) ITSAP will only be used to provide for a single basic local service at the principal residence of the eligible subscriber. A residence shall consist of that portion of a building occupied by a single family or individuals functioning as one domestic unit. (E) Eligibility i. To be eligible, the applicant must be head of a household. ii. Eligible Households are those whose income is at or below 135% of the Federal Poverty Guidelines. iii. Households may apply at any Idaho Department of Health and Welfare office or at their local community action partnership office. iv. Credit is effective beginning on the date of Health and Welfare’s approval of Subscriber’s status (Decision Date).
