HomeMy WebLinkAbout20070205final_order_no_30238.pdfOffice of the Secretary Service Date February 5 , 2007 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF THE APPLICATION OF TEL CENTREX LLC FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO PROVIDE LOCAL EXCHANGE SERVICES IN THE STATE OF IDAHO ORDER NO. 30238 CASE NO. TCX-06- On December 21 , 2006, Te1centrex LLC filed an Application for a Certificate of Public Convenience and Necessity to provide local exchange telecommunications services within the State of Idaho. The Application states Te1centrex was formed and has its headquarters in the State of Georgia and is authorized to do business as a foreign limited liability company in the State of Idaho. On January 4, 2007, the Commission issued a Notice of Application and Modified Procedure requesting comments from interested parties. Order No. 30218. The only comments received were submitted by the Commission Staff. Te1centrex intends to provide resold and facilities-based local exchange servIce utilizing the UNE platform purchased from incumbent local exchange carriers. Telcentrex currently has no plans to install facilities in Idaho but may do so in the future. It intends to provide resold local exchange services and to purchase unbundled network elements from Qwest and Verizon. The Company provided an illustrative tariff with its Application; it also avers that it will provide service according to the laws, rules and regulations of the Commission. Te1centrex does not intend to require advance payments or deposits from customers. Staff reviewed the Application submitted by Te1centrex, and believes the Company understands and agrees to comply with the Commission rules and requirements. Based on this review, the Company s filing fulfills the requirements of the Commission Rules and Procedural Order No. 26665. Staff, therefore, recommended that the Commission approve the Application for a Certificate of Public Convenience and Necessity and waive the escrow account requirement until the Company begins to collect deposits. Based upon our review of the filing and the record in this case, the Commission finds that Te1centrex s filing satisfies the requirements of the Commission s Rules and Procedural Order No. 26665. Thus, we approve Te1centrex s Application for a Certificate of Public ORDER NO. 30238 Convenience and Necessity to allow the Company to provide telecommunications servIces throughout Qwest and Verizon s service territory within the State ofIdaho. ORDER IT IS HEREBY ORDERED that Te1centrex LLC is granted a Certificate of Public Convenience and Necessity to provide competitive telecommunications services within the state ofIdaho. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date of this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code ~ 61-626.
