On May 22,2013,TC Systems,Inc.(TCS)filed a Petition requesting that the
Commission grant a waiver of FCC threshold requirements for numbering resources in the Boise,
Idaho rate center.TCS earlier filed a request with NeuStar,the pooling administration,
requesting a 1,000-block number assignment preference to be used to serve a large business
customer in Idaho.The pooling administrator denied the request because the application did not
meet the months to exhaust and/or utilization requirements.
On May 10,2013,TCS filed its request with NeuStar,requesting 3,000 numbers for
the Boise.Idaho rate center.TCS developed a communications plan to serve a customer to
implement and assign the numbers as soon as they are made available.The customer needs the
numbers to convert its existing internal network figuration to Internet-protocol.
Federal regulations allow a carrier to appeal a decision by NeuStar to withhold
numbering resources to the appropriate state commission.The Commission may overturn
NeuStar’s decision,based on its determination that the carrier has demonstrated a verifiable need
for numbering resources and has exhausted all other available remedies.See 47 U.S.C.§
52.15(g)(3)and (4).
Staff reviewed TCS’s Petition and recommended the Commission approve it.TCS
asserts that a waiver is essential because it is unable to satisfy the numbering needs of this large
customer without an exception granted by the Commission.The Commission finds granting this
waiver will not have a detrimental effect on the numbering resources on the Boise,Idaho rate
center.In addition,the specific sequential 1,000-block numbers requested by the customer
currently are reserved and can be released to TCS upon approval of a waiver.
ORDER
IT IS HEREBY ORDERED that TC Systems,Inc.’s request for a waiver of FCC
threshold requirements for numbering resources in the Boise,Idaho rate center is approved.The
ORDER NO.32833 1
reserved 1,000-block numbers of 208-333,3,4 and 5 can be released to TCS for its Boise rate
center customer.
THIS IS A FINAL ORDER.Any person interested in this Order may petition for
reconsideration within twenty-one (21)days of the service date of this Order,Within seven (7)
days after any person has petitioned for reconsideration,any other person may cross-petition for
reconsideration.See Idaho Code §6 1-626.
