FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO PROVIDE LOCAL EXCHANGE TELECOMMUNICATIONS SERVICE WITHIN IDAHO. ) ) ) ) ) ) ) CASE NO. TCIT981 ORDER NO. 27628 On January 20, 1998, the Commission received an Application from Teltrust Communications Services, Inc. (TCI) for a Certificate of Public Convenience and Necessity to provide local exchange telecommunication services within Idaho. TCIs Application states that it is a privately held corporation organized under the laws of Utah, and is a wholly owned subsidiary of Teltrust, Inc., also a privately held Utah corporation. TCI stated that it initially plans to provide local exchange telecommunications services in those areas served by U S WEST Communications, Inc. (north and south Idaho areas) and GTE Northwest Incorporated. With its Application, TCI provided or indicated it would provide information to satisfy the requirements of the Commissions Rule of Procedure 111, IDAPA 31.01.01.111, and Procedural Order No. 26665 issued November 7, 1996, which sets out the necessary information to be included with an Application for a certificate. On May 28, 1998, the Commission issued a Notice of Application and Notice of Modified Procedure. Written comments were filed by the Commission Staff and four small, incumbent telephone companies. Staff noted that TCI does not yet have an interconnection agreement with U S WEST or GTE, but that TCI has complied with the Commissions requirements to receive a Certificate of Public Convenience and Necessity to provide services in the areas served by U S WEST and GTE. Staff recommended approval of Teltrusts Application. The independent companies filed comments only to remind the parties that rural telephone companies are exempt from certain requirements of the Telecommunications Act of 1996. COMMISSION FINDINGS Based on our review of the record, including the filed written comments and Staffs recommendation, we find that the Application of Teltrust Communications Services, Inc., complies with Procedural Order No. 26665 and the Commissions Rules to obtain a Certificate of Public Convenience and Necessity. We therefore approve TCIs Application for a Certificate to provide local exchange service in the areas served by U S WEST and GTE. O R D E R IT IS HEREBY ORDERED that Teltrust Communications Services, Inc. is granted a Certificate of Public Convenience and Necessity to provide local telecommunications service in those areas of the state served by U S WEST and GTE. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date of this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code  61626.
