The parties, through undersigned counsel, submit the following Status Report:
On May 18, 2012, the Idaho Public Utilities Commission issued Order No. 32550,
approving a Settlement Agreement between Appellant and Staff of the Idaho Public Utilities
STATUS REPORT-1
Commission. Pursuant to Statute, there is as 21 day period following the issuance of a final
order for persons to file petitions for reconsideration. Idaho Code § 61-626(l). The
reconsideration period expired on June 8, 2012, and no one filed any petition for
reconsideration.
In Order No. 32550, the Commission committed to issue a Final Order granting
Eligible Telecommunication Carrier (ETC) status to Appellant pursuant to Idaho Code §§ 62-
610B and 62-610D after the Appellant performs certain actions. Upon issuance of that ETC
Order, Appellant has committed to file a Voluntary Motion to Dismiss this appeal with each
party to pay its own costs and attorney fees. I.A.R. 32(b).
The parties anticipate that within a short time, the Commission will issue its ETC
Order, and Appellant will thereupon file a Motion to Dismiss this appeal no later than June
29, 2012.
