TARIFF FORMAT Sheet Numbering - Sheet numbers appear in the upper right corner ofthe page. Sheets are numbered sequentially. However, new sheets are occasionally added to the tariff. When a new sheet is added between sheets already in effect, a decimal is added. For example, a new sheet added between sheets 14 and 15 would be 14. Sheet Revision Numbers - Revision numbers also appear in the upper right corner of each page. These numbers are used to determine the most current sheet version on file with the Idaho Public Service Commission ("IPUC"). For example, the Fourth Revised Sheet No. 14 cancels the Third Revised Sheet No. 14. Because of various suspension periods, deferrals, etc. the IPUC follows in its tariff approval process, the most current sheet number on file with the Commission is not always the tariff page in effect. Consult the Check Sheet for the sheet currently in effect. Paragraph Numbering Sequences - There are five levels of paragraph coding. Each level of coding is subservient to its next higher level: 1.1 1.1.1 1.1.1.1 Check Sheets - When a tariff filing is made with the IPUC , an updated check sheet accompanies the tariff filing. The check sheet lists the sheet contained in the tariff, with a cross reference to the current revision number. When new pages are added, the check sheet is changed to reflect the revision. All revisions made in a given filing are designated by an asterisk (*). There will be no other symbols used on this page ifthese are the only changes made to it (i.e., the format, etc. remains the same, just revised revision levels on some pages). The tariff user should refer to the latest check sheet to find out if a particular sheet is the most current on file with the IPUc. Idaho Account Code: A numerical sequence available at a Customer s request which enables identification of account users and which allocates costs of the services accordingly. Account codes may be verified against a pre-defined list of codes maintained by the Company. Applicant: Any potential customer who applies for service from the Company. Authorized User: Any person, firm, partnership, corporation or other entity pennitted to use Customer s account. Called Station: The tenninating point of a call (i., the called number). Calling Card: A card issued by Company which enables the Customer to charge the call cost to a prearranged account. Customer accesses the account by entering a PIN. Calling Station: The originating point of a call (i.e., the calling number). Commission: Idaho Public Service Commission (IPUC ). Company: Shared Communications Services , Inc. Customer: Any person, firm, partnership, corporation or other entity which orders or is furnished telecommunications service and is responsible for payment of the charges and for compliance with the Company s tariff regulations. Customer Dialed Calling Card Station: Service where the charges for the call are billed to a Company-authorized Calling Card. Day: Rate period from 8:00 AM to 4:59 PM Monday through Friday local time at the Calling Station. Dedicated Access: Non-switched access between a Customer s premises and the point of presence of the Company s underlying carrier. Disconnect or Disconnection: The termination of a circuit connection between the Originating Station and the Called Station or the Company s operator. Enhanced Communications Service: Service which employs computer processing applications that act on the format, content, code, protocol or similar aspects of the Customer s transmitted information; provides the Customer additional, different or restructured information; or involves Customer interaction with stored information. Evening: Rate period from 5:00 PM to 10:59 PM Monday through Friday and Sunday local time at the Calling Station. LATA (Local Access and Transport Area): A geographic area established as required by the Modification of Final Judgment entered in United States v. Western Electric Co.. Inc..552 F. Sup:!? 131 (D.c. 1982), within which a local exchange company provides communication serVIce. Local Exchange Company: A telephone company utility which provides local telecommunications services to a specific geographical area for business and residential customers. Message Telecommunications Service (MTS): Commonly known as "long distance service MTS is the transmission of two-way interactive switched voice communication between local exchange areas for which charges are made on a per-unit basis and wide area telecommunications service or its equivalent. Minimum Average Timing Requirement (MATR): For 800 Services, if the actual usage falls below the minimum average, a surcharge will be implemented to meet the service requirement. Night: Rate period from 11:00 PM to 7:59 AM Monday through Thursday and 11:00 PM Friday to 4:59 PM Sunday local time at the Calling Station. Operator Dialed Calling Card Station: Service which requires the assistance of a Company operator to complete the call and where the charges are billed to a Company-authorized Calling Card. SECTION 2 - RULES AND REGULATIONS 1.2 1.3 1.4 1.5 1.6 1.7 UNDERTAKING OF THE COMPANY Company s services are furnished for the provision of telecommunications which originate and/or tenninate within the State of Idaho. Service is furnished subject to transmission, atmospheric and like conditions. SCS is a resale common carrier providing intrastate and interstate long distance message telecommunications service to Customers for their direct transmission and reception of voice, data, and other types of communications. Company resells access, switching, transport and tennination services provided by interexchange carriers (IXC). Customer s monthly charges for Company s service are based on the total time Customer actually uses the service, except for 800 Services which have a MATR. For billing purposes, duration of each call will be rounded up in six-second increments unless otherwise specified. Subject to availability, Customers may use account codes to identify the users or user groups on an account. The numerical composition of the codes shall be set by Company to assure compatibility with the Company s accounting and billing systems and to avoid the duplication of codes. Company s services are provided on a monthly basis unless otherwise specified and are available twenty-four hours per day, seven days per week. Company s services are designed for small to medium-sized business Customers interested in the simplified rate structures provided by Company. SECTION 2 - RULES AND REGULATIONS (CONT. LIMITATIONS Service is offered subject to the availability of the necessary facilities and/or equipment and subject to the provisions of this tariff. Company reserves the right to discontinue service when necessitated by conditions beyond Company s control or when Customer is using the service in violation of the provisions of this tariff or in violation of the law. The Company does not undertake to transmit messages, but offers the use of its facilities when available, and will not be liable for errors in transmission or for failure to establish connections. 2.4 Title to all facilities provided by Company under these regulations remains in or is leased in SCS' name. Prior written permission from the Company is required before any assignment or transfer of service and/or account. All regulations and conditions contained in this tariff shall apply to all such pennitted assignees or transferees, as well as all conditions of service. USE Services provided under this tariff may be used only for the transmission of communications by the Customers in a manner consistent with the terms of this tariff and regulations of the Federal Communications Commission. Services provided under this tariff shall not be used: For unlawful purposes; or For any purpose for which any payment or other compensation is received by the Customer, except when the Customer is an entity which holds itself out as being a communications common carrier or resale common carrier or entity which resells the Company s services as part of an enhanced communications service. This provision does not prohibit an arrangement between the Customer and an authorized user to share the cost of the service so long as the arrangement generates no profit for any participant in the arrangement. Boise, Idaho ORIGINAL SHEET NO. 12 SECTION 2 - RULES AND REGULATIONS (CONT. 2.4 2.4. INTERCONNECTION Service furnished by Company may be interconnected with services or facilities of other authorized communications common carriers and with private systems subject to the technical limitations established by Company. Any special interface of equipment or facilities necessary to achieve compatibility between the facilities of Company and other participating carriers shall be provided at the Customer expense. 2.4.Interconnection between the facilities or services of other carriers shall be under the applicable terms and conditions of the other carriers' tariffs. The Customer is responsible for taking all necessary legal steps for interconnecting customer provided tenninal equipment or communications equipment with Company facilities. The Customer shall secure all licenses, pennits, rights-of-way, and other such arrangements necessary for interconnection. 2.4.Customer is responsible for charges incurred for special construction and/or special facilities which Customer requests and which are ordered by Company on Customer s behalf. 2.4.4 If required for the provision of Company s services, Customer must provide equipment space, supporting structure, conduit and electrical power without charge to Company. 2.4.Customer is responsible for arranging access to its premises at a mutually agreeable time when required for Company to install, repair, maintain, program insp~ct or remove equipment associated with the provision of Company serVIces. 2.4.Customer must pay for replacement or repair of damage to equipment or facilities of Company caused by negligence or willful act of Customer. CANCELLING IPUC TARIFF NO.ORIGINAL SHEET NO. 13 Boise, Idaho SECTION 2 - RULES AND REGULATIONS (CONT. 5.4 LIABILITIES OF THE COMPANY The liability of the Company for damages arising out of mistakes, omissions interruptions, delays, errors or defects in transmission occurring in the course of furnishing service or other facilities, and not caused by the negligence of the Customer, comm~nces upon activation of service and in no event exceeds an amount equivalent to the proportionate charge to the Customer for the service period. Company is not liable for any act or omission of any other company or companies furnishing a portion of the service. No agents or employees of connecting, concurring or other participating carriers or companies shall be deemed to be agents or employees of the Company without written authorization. The Company shall be indemnified and held harmless by the Customer against: any claims for libel, slander, infringement or unauthorized use of any copyright, trademark, trade name or service mark arising out of the material, data information or other content transmitted over Company s facilities; and any claims for patent infringement arising from combining or connecting of Company facilities with apparatus and systems of the Customer; and any other claims resulting out of any act or omission of the Customer relating to the use of the Company s facilities. Company is not liable for any defacement of, or damage to, the equipment or premises of Customer resulting from the furnishing of services when such defacement or damages is not the result of Company s negligence. Company shall not be liable for, and the Customer indemnifies and holds the Company harmless from, any and all loss claims, demands, suits, or other action or liability whatsoever, whether suffered, made, instituted or asserted by the Customer or by any other party or persons, for any personal injury to or death of any person or persons and for any loss, damage, defacement or destruction of the premises of the Customer or any other property, whether owned by the Customer or by others, caused or claimed to have been caused directly or indirectly by the installation, operation, failure to operate, maintenance, removal presence, condition, location or use of equipment or wiring provided by Company, where such installation, operation, maintenance, condition, location or use is not the direct result of Company s negligence. Company is not liable for any failure of performance hereunder due to causes beyond its control, including, but not limited to: unavoidable interruption in the working of its circuits or those of another common carrier; acts of God; storms fire, flood, or other catastrophes; any law, order, regulation, direction, action or request of the U.S. Government or any governmental agency, commission, or other instrumentality; national emergencies, riots, rebellions, wars, strikes lockouts, work stcppages, or other labor difficulties; or notwithstanding anything in the tariff to the contrary, the unlawful acts of Company s agents and employees if committed beyond the scope of their employment. The above tariff language does not constitute a determination by the IPUC that a limitation of liability imposed by the Company should be upheld in a court of law. Acceptance for filing by the IPUC recognizes that it is a court's responsibiltiy to adjudicate negligence and consequential damage claims. It is also the court' responsibility to detennine the validity of exculpatory clauses. Boise, Idaho SERVICE It shall be the obligation of Customer to notify Company of any interruptions of service. Before giving such notice , Customer shall ascertain that the trouble is not being caused by any action or omission of Customer, not within Customer control, and is not in the wiring or equipment connected to the tenninal Company. Credit allowance for interruptions of service which are not due to Company testing or adjusting, to the negligence of Customer, or to the failure of channels equipment and/or communications equipment provided by Customer, are subject to the general liability provisions set forth in Section 2., herein. Without incurring liability, Company may interrupt the provision of services at any time in order to perform tests and inspections to assure compliance with tariff regulations and the proper installation and operation of Customer and Company s equipment and facilities and may continue such interruption until any item of noncompliance or improper equipment operation is rectified. RESTORATION OF SERVICE The use and restoration of service in emergencies shall be in accordance with Part 64, Subpart D of the Federal Communications Commission s Rules and Regulations, which specifies the priority system for such activities. ' SECTION 2 - RULES AND REGULATIONS (CONT. 8.4 PAYMENTS AND BILLING Service is provided and billed on a monthly (30 day) basis. Service continues to be provided until cancelled by the Customer (see Section 2.9) or by the Company (see Section 2.10). Customer is responsible for the payment of all charges for services furnished. Charges are based on actual usage during a month, except for 800 Services which have a MATR, and will be billed monthly in arrears. Billing will be payable upon receipt and past due 30 days from invoice date. A late payment fee of 1.5% of the outstanding balance will be assessed for past due accounts. The format and contents of Customer s bills will comply with IDAPA 31.41.01.201.02. The name(s) of the Customer(s) desiring to use the service must be set forth in the agreement for service. Company may require a deposit from Customer for use of Company s services. Pursuant to IDAPA 31.41.01.110, Company agrees to comply with IDAPA Deposit rules 106, 107 (except paragraph 2), 108 and 109. Customers may receive credit adjustments up to an allowable amount for contested charges by contacting the Company whose number is shown on the Customer s bilL Adjustment may be authorized by the Company after appropriate investigation. Customers have the right to refer billing disputes and any other complaints to Company at 1095-25th Street, Suite 201 , Salem, OR 97301 , (800) 285-6100.
