DBA SBC ) LONG DISTANCE'S REQUEST FOR CANCELLATION OF CERTIFICATE OF PUBLIC) CONVENIENCE AND NECESSITY NO. 426. CASE NO. SBC-04- ORDER NO. 30296 On April 4, 2007, the Commission received a notice from Southwestern Bell Communications Services, Inc. dba SBC Long Distance that it intended to relinquish its Certificate of Public Convenience and Necessity No. 426 and cancel its Price Lists in Idaho. The Company stated it is no longer in operation and has no customers in Idaho. In its Decision Meeting on April 9 2007, the Commission determined to approve SBC's request for cancellation of Certificate No. 426. COMMISSION FINDINGS In February 2004, SBC filed an Application with the Commission requesting authority to provide telecommunications services within the State of Idaho. In May 2004, the Commission granted SBC's Application for a CPCN to provide telecommunications services within Idaho. Order No. 29495. On April 4, 2007, SBC notified the Commission that its request to cancel its Certificate results from recent changes in its business arrangements in Idaho and that it does not provide local exchange services to any customers within the state. Staff recommended the Commission cancel Certificate No. 426 and remove the Company s price list on file. ORDER IT IS HEREBY ORDERED that Southwestern Bell Communications Services dba SBC Long Distance s request for cancellation of Certificate of Public Convenience and Necessity No. 426 is granted. Certificate No. 426 is no longer in effect, and SBC is no longer authorized to provide services in the State of Idaho. THIS IS A FINAL ORDER. Any person interested in this Order or in interlocutory Orders previously issued in this case may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this case. Within seven (7) days after any person has petitioned for ORDER NO. 30296 reconsideration, any other person may cross-petition for reconsideration. See Idaho Code ~ ~ 61-619 and 61-626.
