DBA SBC LONG DISTANCE FORA CERTIFICATEOF PUBLIC CONVENIENCE AND NECESSITY TO PROVIDE LOCAL EXCHANGE TELECOMMUNICATIONS SERVICES. CASE NO. SBC-O4- NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 29449 NOTICE OF APPLICATION YOU ARE HEREBY NOTIFIED that on February 20, 2004, Southwestern Bell Communications Services Inc. dba SBC Long Distance ("SBCS") filed an Application for a Certificate of Public Convenience and Necessity to provide resold and facilities-based local exchange and exchange access service within the State of Idaho. YOU ARE FURTHER NOTIFIED that SBCS is a privately-held corporation organized under the laws of the State of Delaware and has its business address in Pleasanton California. SBCS states that it is a wholly-owned subsidiary of SBC Communications, Inc. In addition, SBCS contends it has been authorized by the Secretary of State for the State of Idaho to transact business in this State as a foreign corporation. YOU ARE FURTHER NOTIFIED that SBCS proposes to provide competitive local exchange carrier services including, but not limited to, basic local service and custom calling features, and data services to commercial and residential subscribers in Qwest Corporation and Verizon Northwest Inc. exhanges. SBCS also proposes to provide exchange access services to interconnecting carriers. SBCS also states it does not intend to offer alternative operator services to the transient public. SBCS states that operator assisted calls are provided under contract by the underlying carrier, whose operators are trained to respond to emergency calls. YOU ARE FURTHER NOTIFIED that SBCS states that it does not currently plan to construct facilities of its own in the State of Idaho, but does not foreclose the possibility of doing so. NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 29449 YOU ARE FURTHER NOTIFIED that the Application states SBCS has reviewed the laws and regulations of this Commission governing local exchange telecommunications services in Idaho and will provide service in accordance with all laws, rules and regulations to the extent they are not preempted by the federal Act. NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter and will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Idaho Public Utilities Commission s Rules of Procedure, IDAPA 31.01.01.201 through .204. YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this Application may file a written comment in support or opposition with the Commission within twenty-one (21) days from the service date of this Notice. The comment must contain a statement of reasons supporting the comment. Persons desiring a hearing must specifically request a hearing in their written comments. In addition, SBCS shall have seven (7) days after expiration of the initial twenty-one (21) day comment period to file reply comments. YOU ARE FURTHER NOTIFIED that if no written comments or protests are received within the time limit set, the Commission will consider this matter on its merits and enter its Order without a formal hearing. If written comments are received within the time limit set, the Commission will consider them and, in its discretion, may set the same for formal hearing. YOU ARE FURTHER NOTIFIED that the Application, together with supporting workpapers and exhibits, have been filed with the Commission and are available for public inspection during regular business hours at the Commission offices. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission s jurisdiction under Title 61 of the Idaho Code and that the Commission may enter any final Order consistent with its authority under Title 61. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission s Rules of Procedure, ID AP A 31.01.01.000 et seq. ORDER IT IS HEREBY ORDERED that the Application of Southwestern Bell Communications Services, Inc. dba SBC Long Distance for a Certificate of Public Convenience and Necessity be processed by Modified Procedure IDAPA 31.01.01.201-.204.Persons interested in submitting written comments in this matter should do so no later than 21 days from the service date of this Order. IT IS FURTHER ORDERED that SBCS shall have seven (7) days after the expiration of the initial twenty-one (21) day comment period to file reply comments.
