RURT991 ORDER NO. 28142 On February 9, 1999, Rural Telephone Company submitted revisions to its Local Tariff IPUC No. 2 to the Commission to add a vacation service at one half the total monthly network access line rate and to bill any additional items as a fixed monthly service or surcharge. Currently, Rural does not offer vacation service. All residential customers presently pay one rate. On March 4, 1999, the Commission suspended the operation of this Tariff Advice for six months to allow Staff to investigate and analyze the reasonableness of this proposed tariff. Order No. 27956. On August 6, 1999, the Commission determined that the public interest may not require a formal hearing in this matter and, therefore, ordered that the matter proceed under Modified Procedure. Order No. 28113. On August 27, 1999, only the Staff filed comments. Staff opposed the Tariff Advice. On September 3, 1999, pursuant to the Commission’s Rules of Procedure, IDAPA 31.01.01.067, Rural withdrew its Tariff Advice. In response, Staff recommended closing the case without prejudice. Based on the record and the withdrawal of the Tariff Advice, the Commission dismisses the case without prejudice and orders the docket be closed. O R D E R IT IS HEREBY ORDERED that this proceeding is closed without prejudice as discussed above. THIS IS A FINAL ORDER. Any person interested in this Order (or in issues finally decided by this Order) or in interlocutory Orders previously issued in this Case No. RUR-T-99-13 may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this Case No. RUR-T-99-13. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code  61626.
