RURT991 NOTICE OF MODIFIED PROCEDURE ORDER NO. 28113 YOU ARE HEREBY NOTIFIED that on February 9, 1999, Rural Telephone Company submitted revisions to its Local Tariff IPUC No. 2 to the Commission to add a vacation service. Currently, Rural does not offer vacation service. All residential customers presently pay one rate. YOU ARE FURTHER NOTIFIED that in its Tariff Advice, Rural proposes to price vacation service at one half the total monthly network access line rate and to bill any additional items as a fixed monthly service or surcharge. The service would only be available for residential customers. A line connection charge would apply to suspension or restoration of service. Rural requested an effective date of March 12, 1999. YOU ARE FURTHER NOTIFIED that Rural provides service in some of the more remote areas of the state that are popular for those seeking recreational opportunities. Rurals largest exchange, Boise River, covers the Pine and Featherville area along the South Fork of the Boise River and serves an area that is very popular for recreational property owners. YOU ARE FURTHER NOTIFIED that on March 4, 1999, in Order No. 27956, the Commission suspended the operation of this Tariff Advice for six (6) months to allow Staff to investigate and analyze the reasonableness of this proposed tariff. NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter and, therefore, will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Idaho Public Utilities Commission's Rules of Procedure, IDAPA 31.01.01.201 through -.204. YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this Application may file a written comment in support or opposition with the Commission within twenty-one (21) days from the date of this Notice. The comment must contain a statement of reasons supporting the comment. Persons desiring a hearing must specifically request a hearing in their written comments. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission's Rules of Procedure, IDAPA 31.01.01.000 et seq. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission's jurisdiction under Title 61 of the Idaho Code and that the Commission may enter any final Order consistent with its authority under Title 61.
