RUR-T-20-01 ORDER NO. 34710 On April 30, 2020, Rural Telephone Company dba RTI (“Company”) petitioned the Commission for an order approving its long-distance price list. The Company requested that its Petition be processed under Modified Procedure and have an effective date of June 1, 2020. Commission Staff subsequently asked the Company if the Company would consent to extending the proposed effective date beyond June 1, 2020. The Company agreed to Staff’s request. See May 7, 2020 Decision Memorandum. On May 15, 2020, the Commission provided Notice of Petition, Notice of Suspension of Proposed Effective Date, and Notice of Modified Procedure setting deadlines for public and Company reply comments. Staff filed comments supporting the Company’s Petition. No other comments were filed. Having reviewed the record, we now approve the Company’s Petition as described below. THE PETITION In its Petition, the Company requested authority to begin offering its customers resold intrastate and other long-distance services pursuant to the long-distance price list submitted with its Petition. STAFF COMMENTS Staff recommended Commission approval of the Company’s Petition and accompanying price list for resold intrastate and other long-distance services. Staff reviewed the Petition and the Affidavit of Mr. Mark Martell certifying “RTI will account for all revenues, expenses, and net revenues attributable to its long-distance services to separate accounts apart from revenues and expenses attributable to its regulated services per the Uniform System of Accounts for Telecommunications Companies, 47CFR Part 32.7990.” Staff recommended the Company be required to continue maintaining separate non-regulated accounts. ORDER NO. 34710 2 COMMISSION FINDINGS AND DECISION The Commission has jurisdiction over the Company and the matters in the Petition under Title 61 of Idaho Code, specifically Idaho Code §§ 61-502, and 61-503. The Commission is empowered to investigate rates, charges, rules, regulations, practices, and contracts of public utilities and to determine if they are just, reasonable, preferential, discriminatory, or in violation of any provisions of law, and to fix the same by order. Idaho Code §§ 61-502 and 61-503. The Commission has reviewed the Company’s Petition and Staff’s comments in this case. Based on our review of the record, the Commission approves the Company’s Petition and issues this Order approving the Company’s proposed long-distance price list. O R D E R IT IS HEREBY ORDERED that the Company’s Petition to sell customers resold intrastate and other long-distance services and the accompanying long-distance price list is approved. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration.
