The Company requested that its Petition be processed under Modified Procedure and have an effective date of June 1, 2020. The Commission now provides notice of the petition, suspends the proposed effective date, and sets deadlines for public comments and Company reply comments. NOTICE OF PETITION YOU ARE HEREBY NOTIFIED that in its Petition, the Company seeks authority to begin offering its customers resold intra-state and other long-distance services pursuant to the long- distance price list, effective June 1, 2020. YOU ARE FURTHER NOTIFIED that Commission Staff subsequently asked the Company if the Company would consent to extending the proposed effective date beyond June 1, 2020. . The Company agreed to Staff’s request. See May 7, 2020 Decision Memorandum. YOU ARE FURTHER NOTIFIED that the Petition is available for public inspection during regular business hours at the Commission’s office. The Petition is also available on the Commission’s web site at www.puc.idaho.gov. Click on the “TELEPHONE” tab at the top of the home page, then select “Open Cases” and then locate and click on the case number as shown on the front of this document. RUR-T-20-01 NOTICE OF PETITION NOTICE OF SUSPENSION OF PROPOSED EFFECTIVE DATE NOTICE OF MODIFIED PROCEDURE ORDER NO. 34670 NOTICE OF PETITION NOTICE OF SUSPENSION OF PROPOSED EFFECTIVE DATE NOTICE OF MODIFIED PROCEDURE ORDER NO. 34670 2 YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission’s jurisdiction under Title 61 of the Idaho Code. The Commission may enter any final order consistent with its authority under Title 61. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission’s Rules of Procedure, IDAPA 31.01.01.000 et seq. NOTICE OF SUSPENSION OF PROPOSED EFFECTIVE DATE YOU ARE FURTHER NOTIFIED that the Company’s Petition proposed an effective date of June 1, 2020. To allow for adequate opportunity for public input, and pursuant to Idaho Code § 61-622, the Commission suspends the proposed effective date for 30-days plus five (5) months from June 1, 2020, or until the Commission enters an order accepting, rejecting, or modifying the request in this matter. NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter, and that it will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Commission’s Rules of Procedure, IDAPA 31.01.01.201 through .204. The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this Petition must file a written comment in support or opposition with the Commission within 21-days of the service date of this Order. The comment must contain a statement of reasons supporting the comment. Persons desiring a hearing must specifically request a hearing in their written comments. YOU ARE FURTHER NOTIFIED that the Company must file any reply comments within 28-days of the service date of this Order. YOU ARE FURTHER NOTIFIED that if no written comments or protests are received within the time limit set, the Commission will consider this matter on its merits and enter its order without a formal hearing. If written comments are received within the time limit set, the Commission will consider them and, in its discretion, may set the same for formal hearing. O R D E R IT IS HEREBY ORDERED that the Company’s proposed effective date of June 1, 2020 is suspended for 30-days plus five (5) months or until the Commission enters an order accepting, rejecting, or modifying the request. See Idaho Code § 61-622(4). IT IS FURTHER ORDERED that the Company’s Petition be processed by Modified Procedure, Rules 201-204 (IDAPA 31.01.01.201-.204). Persons interested in submitting written comments must do so within 21-days of the service date of this Order. The Company must file any reply comments within 28-days of the service date of this Order. IT IS FURTHER ORDERED that parties continue to comply with Order No. 34602, issued March 17, 2020. All pleadings should be filed with the Commission electronically and shall be deemed timely filed when received by the Commission Secretary. See Rule 14.02.
