HomeMy WebLinkAbout990816_dh.docDECISION MEMORANDUM TO: COMMISSIONER HANSEN COMMISSIONER SMITH COMMISSIONER KJELLANDER MYRNA WALTERS STEPHANIE MILLER TONYA CLARK RON LAW BEVERLY BARKER JOE CUSICK DAVID HATTAWAY WORKING FILE FROM: DATE: August 16, 1999 RE: PROPOSED CLARIFICATION TO THE COMMISSION’S RULES 103 AND 105 REGARDING UTITILIES’ SUMMARIES OF TESTIMONY AT COMMISSION HEARINGS, IDAPA 31.41.02.103 AND 31.21.02.105 Two Commission Administrative Rules require that utilities make available brief summary of prefiled testimony offered at “all Commission hearings.” Rules 103 and 105, IDAPA 31.41.02.103 and 31.21.02.105. At several recent public hearings, utilities have not made available summaries of their positions and testimony because the utilities assumed that such summaries were only required to be prepared in rate cases. To eliminate any confusion and to clarify the requirements of these rules, the Staff has prepared the attached clarifications to these rules. Ostensibly, utilities and other parties must prepare a brief summary of their positions and the prefiled testimony submitted on their behalf. If utilities are requesting an increase in rates, then the summary shall address the utility’s need for additional revenue, the total dollar amount requested, and the proposed percentage increase or decrease in rates for each major customer class. The summaries are provided solely for the convenience of the public and will not be allowed as evidence or form the basis for cross-examination of any witness.
