OCTOBER 9, 2001 RE: REPEAL OF THE COMMISSION’S TITLE 62 FACILITIES-BASED CLEC RULES, CASE NO. 31-4201-0101

On October 3, 2001, the Commission caused to be published in the Idaho Administrative Bulletin a Notice of Proposed Rulemaking. In its Notice the Commission proposed to “repeal” its Title 62 Rules 401 through 411 governing the standards for interconnection between telephone companies in previously unserved areas of Idaho. IDAPA 31.42.01.401 through 411. The Commission’s Notice provided that comments concerning the Commission’s proposal to delete these rules be submitted no later than October 24, 2001. No substantive comments were received. Legislative Services reported on October 5, that the legislative subcommittees for review of administrative rules will not file objections to repealing the rules. The Notice of Proposed Rulemaking is attached for your review.

Commission Decision
Given the lack of any objections, does the Commission wish to adopt the proposed repeal of these rules as its pending action and submit the matter to the 2002 Legislature for review?
