HomeMy WebLinkAbout20010905APA Notice of Proposed Rule - 42-01.docIDAPA 31—IDAHO PUBLIC UTILITIES COMMISSION 31.42.01—THE IDAHO PUBLIC UTILITIES COMMISSION RULES FOR TELEPHONE CORPORATIONS SUBJECT TO THE RULES OF THE IDAHO PUBLIC UTILITIES COMMISSION UNDER THE TELECOMMUNICATIONS ACT OF 1988 (THE TITLE 62 TELEPHONE CORPORATION RULES) DOCKET NO. 31-4201-0101 NOTICE OF PROPOSED RULE AUTHORITY: In compliance with Section 67-5220(1), Idaho Code, notice is hereby given that the Idaho Public Utilities Commission proposes rulemaking to delete certain rules. This action is authorized pursuant to Sections 62-602, 62-611, 62-614, 62-615, 62-616 and 62-622, Idaho Code. PUBLIC HEARING SCHEDULE: A public hearing concerning the Commission’s proposal to repeal rules will be scheduled only if requested in writing by twenty-five (25) persons, a political subdivision, or an agency, not later than October 17, 2001. The hearing site will be accessible to persons with disabilities. Requests for accommodation must be made not later than five (5) days prior to the hearing to the Commission’s address set out below. DESCRIPTIVE SUMMARY: The following is a non-technical explanation of the substance and purpose of the proposed rulemaking: The Commission proposes to delete its rules adopting interconnection and access standards for facilities-based competitive telephone corporations that provide basic local service to previously unserved areas of the state. More specifically, the Commission proposes to delete Sections 401 through 411 of IDAPA 31.42.01, The Title 62 Telephone Corporation Rules. The Commission believes that these rules of general applicability are no longer necessary. FEE SUMMARY: There are no fees associated with this proposal to delete rules. NEGOTIATED RULEMAKING: Pursuant to IDAPA 04.11.01.0811, negotiated rulemaking was not conducted.
