CASE NO. 31-5101-0101. On August 24, 2000, the Commission on its own motion initiated a negotiated rulemaking to examine what changes should be made to its Operator Services and Pay Telephone Rules, IDAPA 31.51.01.000 et seq. to accommodate recent changes to federal law incorporated by Federal Communications Commission Orders, the Code of Federal Regulations and the United States Code. On May 24, 2001, the Commission issued a Notice of Proposed Rulemaking that was subsequently published in the Administrative Bulletin on July 4, 2001. The Notice requested that interested persons submit written comments regarding the proposed rules no later than July 25, 2001. Qwest Corporation was the only party to file written comments. Qwest Corporation filed written comments that urged the speedy approval and implementation of these rules. THE PROPOSED RULE The Commission Staff, Qwest Corporation, the Northwest Payphone Association, AT&T, Verizon Northwest, Inc., Citizens Communications, and Lorie Garr (an independent payphone owner), participated in this negotiated rulemaking. After reaching a consensus with the participating parties and persons the Commission adopted these rules as proposed rules and issued the appropriate notices. The proposed rules are attached.
