GENERAL ORDER NO. 210

ADOPTION OF PENDING RULE
On August 24, 2000, the Commission on its own motion initiated this negotiated rulemaking to examine what changes should be made to its Operator Services and Pay Telephone Rules, IDAPA 31.51.01.000 et seq. to accommodate recent changes to federal law incorporated by Federal Communications Commission Orders, the Code of Federal Regulations and the United States Code. After the parties to this proceeding submitted a final draft of these proposed rules to the Commission it then issued the Notice of Proposed Rulemaking that was subsequently published in the Administrative Bulletin on July 4, 2001.
The Commission’s Notice solicited public comment on the proposed rule changes. Comments on the proposed rules were to be filed with the Commission no later than July 25, 2001. Qwest Corporation was the only party to file written comments and it supported approval of the rules.
Based upon the negotiated rulemaking and our review of the proposed Operator Services and Pay Telephone Rules we find the proposed rules should be adopted as pending rules.
GENERAL ORDER
IT IS HEREBY ORDERED that the Commission adopt the proposed amendments to its Operator Services and Pay Telephone Rules (IDAPA 31.51.01). A Notice of Pending Rule shall be transmitted to the Administrative Rules Coordinator for publication in the next Administrative Bulletin on October 3, 2001.
IT IS FURTHER ORDERED that the pending rules shall be submitted to the 2002 Legislature for review. If approved, the pending rules shall become final and effective, unless rejected or amended, upon legislative approval by concurrent resolution or upon the date specified in the concurrent resolution.
THIS IS A FINAL GENERAL ORDER. Any person interested in this Order (or in issues finally decided in this Order) in Case No. 31-5101-0101 may seek judicial review under Idaho Code § 67-5270 and Commission Rule 401 (IDAPA 31.01.01.401) regarding any matter decided in this Order.
