NOTICE OF PROPOSED RULEMAKING

BY THIS NOTICE WE PROPOSE to amend several rules contained within the Commission’s Operator Services and Pay Telephone Rules (IDAPA 31.51.01.000). These Rules were last updated in 1994.
The proposed substantive changes to these Rules are made so that the Rules are consistent with recent changes in federal law. See generally, In the Matter of Implementation of the Pay Telephone Reclassification and Compensation Provisions of the Telecommunications Act of 1996, CC Docket No. 96-128, Order No. 96-388 (September 20, 1996). Furthermore, substantive changes were made in order that these Rules are in compliance with the Americans with Disabilities Act and American Disabilities Act Accessibility Guidelines. Finally, the Commission is proposing to make several non-substantive changes to clarify and streamline these Rules. These changes were agreed upon by the participating parties and persons at the workshop held on September 27, 2000. Thus, the Commission has deleted obsolete and redundant material and added several terms and abbreviations that are consistent with terms and abbreviations used by the FCC in its payphone orders.
NOTICE OF PROPOSED RULEMAKING
The Idaho Public Utilities Commission hereby gives notice of its proposal to amend its Operator Services and Pay Telephone Rules (IDAPA 31.51.01.000). Two appendices are attached to this Notice. Appendix A is a Notice of Proposed Rule suitable for transmission to the Administrative Rules Coordinator. As explained in Appendix A, the comment deadline for this Notice of Proposed Rulemaking is July 25, 2001. The proposed rules are shown in Appendix B in legislative format.
