QWE-02- I. INTRODUCTION Q: Please state your name, address, and occupation. A. My name is Gary Neal. I am a graduate of the University of Oregon School of Law and I have been an attorney in Boise since 1994. I am a principal attorney with the law firm of Neal & Uh1 PLLC located at 1101 West River Street, Boise, Idaho. My firm consists offour attorneys and 6 full or part time support personnel. We emphasize real estate law in our practice, and we also have a debtor and creditor bankruptcy practice. Q: Do you have a telephone system in your office, and if so, please describe it. A. Yes we do.We buy four business lines ITom Qwest Communications and they are incorporated into a phone system that has 10 extension phones placed at various locations in the office. The phone system has intercom capabilities, and each of the four lines rolls over. My business also has a Facsimile machine, and each attorney and our runner has a cell phone. Q: Please explain what you mean by "rolls over A. I mean that when one business line is in use, and a caller calls on the main number, the caller s call is "rolled over" so that the next line will ring and can be used. Q: Have you invested quite a bit of money in this system you have? A. Yes. In 2002 we replaced an older system with the new one I am describing. It cost us about $3245 and should last 10 years. In addition, it required staff time to locate the extensions where we wanted and to tailor the system to each individual's needs. I spent time comparing prices and assessing our needs in connection with the purchase of this system. n CELL PHONE EQUIVALENCY Extension Phones QWE- T -02- March 13 , 2003 NEAL D. INT . MEIER Q. You stated you have 10 phones on your system. Why so many? A. Well, each attorney of course needs a phone at the attorneys desk, where the attorney also has a computer with internet and the DSL feature. Each secretary s station needs a phone and we have one in our conference room and in our photocopy and break area room. I believe we save considerable time by having a phone available so that personnel don t have to get up and retrieve phone calls at a different location. These extensions allow a secretary to cover the phone when the front desk receptionist is unavailable, and the intercom feature allows communication without leaving a work station. Q. Is it necessary that personnel be able to communicate with each other through your phone system? A. Absolutely necessary. It would be a very ineffective use of personnel time to have people moving about the office to communicate. The receptionist would be away ITom the ITont desk if messages had to be delivered, and then a secretary would have to cover the phone and be away ITom that station delivering a message, and so on. My client service would suffer if clients had to wait for the receptionist to return ITom delivering messages. Clearly this would be a very inefficient and impractical situation. Q. Do cell phones have a place in your telephone needs? A. Yes. When firm members are out of the office, usually at the Courthouse, they take cell phones. We don t "publicize" the cell phone numbers because we only want a very important communication and really only the secretary and close family members know the number. So once in awhile the office calls us on the cell phone to let us know, well, for example, that the attorney should return to the office because the Court hearing being attended has just been canceled by the Judge. Why not use cell phones in place of the telephone system you have previously QWE- T -02- March 13, 2003 - 2- NEAL D. 2 INT.MEIER - 20 described. A. That would be impossible because cell phones all have their own individual number. I can buy 10 cell phones and have the same number ring on each phone. Even if that could happen, how would those phone numbers transfer and how could I have four phone numbers go into a single phone unit? If we had 10 cell phones instead of our telephone system there would be 10 phone numbers and the phone numbers can t be put in one place. If all 10 cell phones were at the receptionists desk the receptionist would have tq carry each phone to the recipient. This would be a logistical nightmare. There is no way I could have a common receptionist, and there would have to be many listings in the phone book. ROLLOVER LINES Q. You referred to the "rollover" feature. Can cell phones satisfy this need? A. Not at all. Cell phones have individual numbers and I guess you could have some kind of complex forwarding system if one cell phone was busy. But that isn t what I want or need. I mean if the main cell phone line was busy, which cell phone would the incoming call be routed to? That cell phone might be sitting at a vacant work station, and go unanswered. Meanwhile, assuming there are 10 cell phone replacements for my extension phone, the other 8 cell phones wouldn t even be picking up the incoming call. It is totally umealistic to think a law office could operate this way. I would lose business. My system has to have the rollover feature. FA CSIMILE MACHINE AND DSL Q. You indicated you have a facsimile machine. How important is it to you in your business? A facsimile machine is absolutely essential to my business. For example, we handle many property foreclosures and a significant number of the rental evictions in Ada and Canyon County. QWE-02- March 13, 2003 - 3 - NEAL D. 3 INT.MEIER My office receives eviction orders ITom property managers and clients through this device and we send process service returns via fax. I note that many title companies, other attorneys and lenders regularly use the fax process in their dealings with my office. We rely significantly on the fax machine to file documents with Canyon County, where the Clerk of the Court accepts fax filings. The fax option usually saves our employes ITom having to make a trip to Caldwell for urgent Court filings. In fact many County Court Clerks accept fax filings including rural counties such as Owyhee County. Q. You mentioned that the attorneys have the DSL internet feature on their computers in their offices. How important is that feature? A. Today most attorneys perform on line legal research. This involves being able to rapidly review many pages of legal opinions and statutes. We also search the internet for public records information, such as business organization status at the Idaho Secretary of States web site. All Federal Court pleadings are on the internet, and we regularly review them and are required to review them by individual Federal Judges. The high speed DSL feature is essential for us to be efficient. Q. Can a cell phone operate these features you have described? A. No. My fax machine needs a land line to operate. Qwest provides our DSL service and I am very pleased with it. I have been told however, that it requires a land line to use DSL. ill LAW OFFICES IN GENERAL Q. As a small law office practitioner, please describe the bare essentials for any lawyer operating -a law practice in this area. A. A lawyer has to have an office. People don t think you are credible if you work out of your car or your home. Further, there has to be a location for other attorneys and clients to deliver important or urgent pleadings and papers. The office has to have a phone, and some kind of person available, whether on contract, part QWE- T -02- March 13 , 2003 - 4- NEAL D. 4 INT.MEIER time, or full time, to respond to phone and in person client contacts, as well as to receive pleadings and documents ITom other attorneys or the Court. The person providing this assistance needs to have intercom communication with the lawyer. The office needs a word processor, photocopier access a fax machine, internet access and a set of the Idaho' Code. This is a bare bones operation, and these necessities can be shared with other lawyers at one location. Q. Are you familiar with the operations of other law offices in the Treasure Valley area. A. Yes. I have visited dozens oflaw offices and communicated with over a 100 attorneys ITom time to time over the last 9 years. I usually visit other offices for depositions, mediations or just to iron out settlements.One, two and three person law firms, or associations of several attorneys have multiple lines and extension phones, for all of the reasons I have described. A serious attorney office needs these features. Q. Do you have any data which would indicate whether law offices are being run by land lines or cell phones? A. Yes. At Mr. Gannon s request I generally reviewed the 2002-2003 edition of the Idaho State Bar Directory and Reference Guide.This publication is prepared by the Bar, which regulates attorneys in Idaho. Attached are the first few pages (pages 17-21) of 65 total pages. (Intervenor Meierotto Exhibit 202). A11lawyers have an obligation to keep the State Bar advised of our current address and phone numbers and then the Bar prepares this publication which is used by lawyers to locate or communicate with other lawyers. In generally reviewing this publication, I just don t see any prefixes which I would identify as being cell phone numbers. The Ada County attorneys appear to have land line prefixes. Q. Are there any lawyers to your knowledge who use cell phones in place of land lines for their business? A. Again, an active law practice requires the telephone system I have described. Now, I can QWE- T -02- March 13 , 2003 - 5 - NEAL D. 5 INT . MEIER think of only one lawyer I know who may be using only a cell phone. He recently closed his office at Rose Hill and Vista, and now he works out of his house. He is winding down his practice. plans to go into another area of work, and he isn t taking much new work. Q. Do most other lawyers use a facsimile machine? A. Absolutely and this can be verified by looking at the Directory and Reference Guide. It appears that 95% or more of the attorneys listed have a Fax number. IV. FUNCTIONAL EQUIV ALANT Q. Mr. Neal, do you have any evidence that cell phone competition is the functional equivalent of land lines for small businesses such as yours? A. None. The technology simply isn t there. Further I have a cell phone and they are not as reliable. There are occasional reception problems or I have forgotten to recharge the battery sometimes. V. PUBLIC INTEREST Q. You have mentioned that you use Qwest service in several respects. Do you think it is in the public interest to allow Qwest to price small business and residential service without regulation by this Commission. A. Unfortunately I have to say no, because generally I don t like government regulation. However, there is no competition because cell phones don t offer the "functional equivalent" of service, which I understand to the be legal threshold. But just as important for me is that past Qwest actions with regard to my bill indicate some umeasonableness in their approach to customers and this makes me uncomfortable with them having an umegulated monopoly. My staff and my family don t have the time to scrutenize Qwest billings, and we have to really trust Qwest and other companies to be fair. But in December, 2001 , my wife noticed a long distance QWE- T -02- March 13 , 2003 - 6 - NEAL D. 6 INT . MEIER charge on my home bill for $17.10 for a 4 minute collect call. (Exhibit 203). I believe I personally used an Albertson s pay phone. This kind of charge is clearly unreasonable, and we contacted Qwest. Customer Service who said the bill had to be paid, and we should contact something called Zero Plus. I may have eventually even inquired at the PUC. But my wife is a busy attorney with Hewlett Packard and we have two small children. We don t have the time to deal with this and the bill was paid, but we were very unhappy. Qwest is collecting the bill and should have some responsibility for the accounts they collect and this was very unfair. I have heard frequent other complaints regarding billing issues ITom many people. Qwest should improve their customer relationships and then they will have more land lines and more profit. After that experience my family wanted to use another provider, such as cell phones, but we need a land line at home because we need an extension phone in our 2000 square foot home. So relying on a cell phone at home isn t a good option for us. VI. CONCLUSION AND RECOMMENDATION Q. WHAT IS YOUR RECOMMENDATION TO THIS COMMISSION 1. The commission should regulate land line usage in Idaho for small business because there is no functional equivalent cell phone technology available. Residential regulation should continue because of the need for extension phones in the home and the need for one central line. , Qwest should receive a reasonable rate of profit ITom the business and residential line services it provides and Qwest can do so by improving its customer relations, so that people want to use the Company services. I believe the Commission should implement a very informal mandatory arbitration program to resolve billing and service disputes to help Qwest improve its customer service and increase its bottom line profit.
