DBA IDAHO COMMUNICATIONS AND RADIO SERVICECOMPANY CASE NO. QWE-06- NOTICE OF PETITION NOTICE OF MODIFIED PROCEDURE ORDER NO. 30034 YOU ARE HEREBY NOTIFIED that on March 17 2006, Qwest Corporation filed a Petition for Approval of Interconnection Agreements to Implement FCC Ruling in Mobile Order. Qwest's Petition asserts that it is required by the Federal Communications Commission to request and enter into interconnection agreements with wireless and paging carriers for the termination of traffic. Qwest attempted to obtain interconnection agreements with the six parties named in its Petition, but did not receive a response from the companies, despite numerous attempts. Qwest's Petition states that it seeks approval of the interconnection agreements attached to its Petition "as the preferable alternative to discontinuing services relating to termination of wireless traffic to respondents." Petition p. 4. YOU ARE FURTHER NOTIFIED that Qwest specifically requests that the Commission "approve the agreement attached as Exhibit B as an interconnection agreement between Qwest and the paging carriers identified in (its Petition), as written, without changes or disputed issues.Petition p. 7. According to Qwest's Petition, the FCC'Mobile Order provides interim arrangements for pricing that currently govern the exchange of traffic between Qwest and respondents. Qwest states that if the Commission does not approve the agreements Qwest will be forced to discontinue service to the respondents until an appropriate interconnection agreement can be negotiated, approved and filed. Qwest claims it has "taken every step possible to avoid such a drastic result. YOU ARE FURTHER NOTIFIED that after filing its initial Petition, Qwest filed an Amended Petition along with four Motions to Dismiss. With its Amended Petition and Motions to Dismiss, two parties remain as respondents in Qwest's initial Petition , as follows: NOTICE OF PETITION NOTICE OF MODIFIED PROCEDURE ORDER NO. 30034 GEM State Communications, Inc. dba Idaho Communications 1976 Century Way Boise, ID 83709 Radio Service Company PO Box 338 Burley, ID 83318 YOU ARE FURTHER NOTIFIED that if no party objects, the Commission will consider the merits of Qwest's Petition without any further proceeding, and may approve the agreement (Exhibit B to the Petition) provided by Qwest as an interconnection agreement subject to Section 252 of the 1996 Federal Telecommunications Act, 47 U.C. ~ 252. YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter and will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Idaho Public Utilities Commission s Rules of Procedure IDAP A 31.01.01.201 through .204. The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this case may file a written comment in support or opposition with the Commission within twenty- one (21) days from the service date of this Notice. The comment must contain a statement of reasons supporting the comment. Persons desiring a hearing must specifically request a hearing in their written comments. If written comments are received within the time limit set, the Commission will consider them and, in its discretion, may set the same for formal hearing YOU ARE FURTHER NOTIFIED that the Petition, together with supporting workpapers, has been filed with the Commission and is available for public inspection during regular business hours at the Commission offices or on the Commission s Web site at www.puc.idaho.gov under the "File Room" icon. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission s jurisdiction under Title 61 of the Idaho Code and that the Commission may enter any final order consistent with its authority under Title 61. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission s Rules of Procedure, IDAP A 31.01.01.000 et seq. ORDER IT IS HEREBY ORDERED, pursuant to the Motions to Dismiss filed by Qwest, that Teton Communications, Inc.; Mountainland Communications, Inc.; Idaho Phone Service, Inc. and Intermountain Communications of Southern Idaho, Inc., all as identified in Qwest's Petition are dismissed and are not part of this proceeding. IT IS FURTHER ORDERED that the Petition for Approval of Interconnection Agreements filed by Qwest Corporation be processed by Modified Procedure, IDAP 31.O1 01.201-.204. Persons interested in submitting written comments in this matter must do so no later than 21 days from the service date of this Order.
