MINUTE ORDER
On June 3, 2005 , Level 3 Communications, LLC filed with the Commission a
Petition for Arbitration of an interconnection agreement with Qwest Corporation pursuant to
Section 252(b) of the federal Telecommunications Act of 1996. Qwest filed its Answer to Level
s Petition on June 28, 2005. The last entry in the case is Order No. 29991 vacating a
procedural schedule issued by the Commission on Level 3' s Motion. The Order was issued
approximately two years ago, and also directed the parties to agree upon a new procedural
schedule and submit it to the Commission. No procedural schedule was ever submitted to the
Commission.
On March 5, 2008 , Qwest Corporation filed a letter with the Commission stating
Qwest has no objection to the case being closed. Staff notified Level 3 that Staff would
recommend the Commission close the case unless Level 3 stated an objection. By letter dated
March 19, 2008 , Level 3 advised Staff that the Company has no objection to the Commission
dismissing Case No. QWE- T -05-11.
Based upon Staff's recommendation at the March 31 , 2008 decision meeting, the
Commission dismisses Level3's Petition for Arbitration and closes Case No. QWE-05-11.
ORDER
IT IS HEREBY ORDERED that Level 3 Communications, LLC's Petition for
Arbitration of an interconnection agreement with Qwest Corporation is dismissed and Case No.
QWE-05-11 is closed.
