ORDER VACATING
PROCEDURAL SCHEDULE
ORDER NO. 29991
On February 9 2006, the Commission issued Order No. 29977 adopting the procedural
schedule submitted by the parties. The schedule included a hearing to convene on March 14, 2006
and a hearing for oral argument on June 27, 2006. On February 28, 2006, a Motion to Vacate
Hearing was filed by Level 3 Communications. In its Motion, Level 3 represented that it had
conferred with Qwest Corporation regarding a conflict that prevents a Level 3 witness from
appearing at the March hearing. Level 3 asserts that Qwest does not object to vacating the schedule
approved in Order No. 29977. Level 3' s Motion also states the parties will submit a new procedural
schedule, and that if, as a result of vacating the hearing, the Commission incurs expenses resulting
from canceling the Arbitrator s travel arrangements, Level 3 is willing to reimburse those expenses.
The Commission will grant the Motion to Vacate Hearing, and will also vacate the
remainder of the procedural schedule as set forth in Order No. 29977. Level 3 and Qwest should
agree upon a new schedule and submit it for approval to the Commission. In addition, Level 3 is
directed to pay any expenses resulting from cancellation of travel arrangements made by the
Arbitrator.
ORDER
IT IS HEREBY ORDERED that the procedural schedule approved by the Commission in
Order No. 29977 is vacated. Level 3 is directed to pay the expenses, if any, resulting from
cancellation ofthe travel arrangements made by the Arbitrator.
