In November 2004, PageData and Radio Paging Services filed a Petition for
Arbitration with Qwest Corporation. In their Petition, the Pagers requested the Commission
arbitrate the issue of whether they are entitled to a refund for transit traffic charges paid to Qwest
under their respective interconnection agreements. The Commission issued a Summons to
Qwest directing it to file an Answer to the Pagers' Petition. Qwest subsequently filed a Motion
requesting an extension of time in which to file its Answer. The Pagers consented to an
extension. Consequently, the Commission issued Order No. 29672 granting Qwest's Motion.
The Order directed Qwest to file its Answer no later than January 4 2005.
Qwest has yet to file its Answer. We understand that the parties mutually consented
to another extension of an unspecified duration. Although we normally grant parties some
deference in the scheduling of a proceeding, we believe it is long past the time that an Answer
should have been submitted. Accordingly, we direct Qwest to file an Answer to the Pagers
Petition within 14 days from the service date of this Order.
ORDER
IT IS HEREBY ORDERED that Qwest Corporation file its Answer to the Pagers
Petition within 14 days from the service date of this Order.
