USW-99-30, QWE-02-20, QWE-04- QWE-04-18, QWE-04-21, QWE-05-6, QWE-06-1, QWE-06- QWE-06-3, VZN-04-, POT-06-, SIL-06-1 AND COL-06- BACKGROUND Under the provisions of the federal Telecommunications Act of 1996 , interconnection agreements must be submitted to the Commission for approval. 47 u.S.c. 9252(e)(1). The Commission may reject an agreement adopted by negotiations only if it finds that the agreement: (1) discriminates against a telecommunications carrier not a party to the agreement; or (2) implementation of the agreement is not consistent with the public interest, convenience and necessity. 47 U.C. 9252(e)(2)(A). THE CURRENT APPLICATIONS Owest and Multiband Communications, LLC (Case No. USW-99-30).This Application seeks approval of the Triennial Review Order and Triennial Review Remand Order (TRO/TRRO) Amendment. This amendment adds terms to implement the provisions ofthe FCC' TRO and TRRO decisions. The Commission has previously approved this amendment in other cases. Owest and New Edge Networks, Inc. (Case No. OWE-02-20).There are two amendments to a previously approved agreement for this case. The first amendment provides terms for Qwest Digital Subscriber Line (DSL). The second is the Triennial Review Order and DECISION MEMORANDUM - 1 -FEBRUARY 27, 2006 Triennial Review Remand Order (TRO/TRRO) Amendment. This amendment adds terms to implement the provisions of the FCC's TRO and TRRO decisions. The Commission has previously approved this amendment in other cases. Owest and OrbitCom, Inc. (Case No OWE-04-13).This Application seeks approval of an amendment to a previously approved agreement. This amendment provides terms for Qwest Digital Subscriber Line (DSL). 4. Owest and IDT America, Corp. (Case No. OWE-04-18).This Application seeks approval of the Triennial Review Order and Triennial Review Remand Order (TRO/TRRO) Amendment. This amendment adds terms to implement the provisions of the FCC's TRO and TRRO decisions. The Commission has previously approved this amendment in other cases. Owest and SBC Long distance, Inc fka Southwestern Bell Communications Services (Case No. OWE-04-21).This Application seeks approval of the Triennial Review Order and Triennial Review Remand Order (TRO/TRRO) Amendment. This amendment adds terms to implement the provisions of the FCC's TRO and TRRO decisions. The Commission has previously approved this amendment in other cases. Owest and PiperTel Communications, LLC (Case No. OWE-05-6).This Application seeks approval of the Triennial Review Order and Triennial Review Remand Order (TRO/TRRO) Amendment. This amendment adds terms to implement the provisions of the FCC' TRO and TRRO decisions. The Commission has previously approved this amendment in other cases. Owest and Cordia Communications, Corp. (OWE-06-1).This Application seeks approval of a new agreement that follows Qwest's 14 State negotiations template. The terms are similar to those in previously approved agreements. DECISION MEMORANDUM - 2 -FEBRUARY 27, 2006 Owest and 360networks (USA) Inc. (Case No OWE-06-2).This Application seeks approval of a new agreement that follows Qwest's 14 State negotiations template. The terms are similar to those in previously approved agreements. Owest and Navigator Telecommunications, LLC (Case No. OWE-06-3).This Application seeks approval of a new agreement that follows Qwest's 14 State negotiations template. The terms are similar to those in previously approved agreements. 10. Verizon and Airpeak Communications, LLC dba Nevada Wireless (Case No. VZN-04-. This is an amendment to an existing agreement providing terms for wireless 911/E911 services. 11. TDS Telecommunications Corporation (Potlatch Telephone Company, Inc.) and Mobil USA. Inc. (Case No. POT-06-. This is a new agreement for the exchange of wireless traffic between Potlatch and T -Mobile. This voluntarily negotiated agreement contains terms similar to other agreements between TDS and wireless carriers that have been previously approved by this Commission. 12.Silver Star Telephone Company and Gold Star Communications, LLC (Case No. SIL- T -06-1 ). This is a voluntarily negotiated agreement that contains terms for wireless interconnection and compensation. It contains terms similar to those approved for other wireless interconnection agreements. 13.Columbine Telephone Company (Teton) and Gold Star Communications, LLC (Case No. COL- T -06-1 ). This is a voluntarily negotiated agreement that contains terms for wireless interconnection and compensation. It contains terms similar to those approved for other wireless interconnection agreements. ST AFF ANALYSIS The Staff has reviewed all of these Applications and did not find any terms and conditions that it considers to be discriminatory or contrary to the public interest. Staff believes that these Agreements and Amendments are consistent with the pro-competitive policies of this Commission DECISION MEMORANDUM - 3 -FEBRUARY 27 2006 the Idaho Legislature, and the federal Telecommunications Act of 1996. Accordingly, Staff believes that these Agreements and Amendments to previously approved interconnection agreements merit the Commission s approval.
