QWE-O4- ORDER NO. 29525 On May 26, 2004 Qwest Corporation filed a Petition asking the Commission to modify Order No. 28943 issued February 1 2002, in Case No. USW-99-21. Order No. 28943 was a final Order approving consolidation of Qwest wire centers as a method of conserving telephone number (NXX) prefixes. In that case, US WEST (now Qwest) recommended different groupings for rate centers, and Qwest's Group No.6 included Idaho Falls, Rexburg, Rigby, Ririe, Roberts, and Shelley. Staff filed written comments recommending that Rigby and Roberts be removed from Group No.6 and that the two exchanges be consolidated in their own group. In its Petition to Modify Order No. 28943, Qwest requests that Rigby and Roberts now be included in the Idaho Falls consolidated group. In its Petition to Modify, Qwest states that Staff s recommendation to exclude Rigby and Roberts from Group No.6 was based on a concern that consolidating rate centers might impact the Commission s ability to implement EAS in the future. Qwest asserts that since Order No. 28943 was entered , " there has been no EAS activity relating to Rigby and Roberts, nor does it appear that such activity is pending or expected." Qwest states in its Petition that customers in those exchanges have requested certain advanced services from Qwest that it cannot provide with the existing switches. If the Rigby and Roberts exchanges are included in the Idaho Falls rate center group, Qwest will be able to offer advanced services to the Rigby and Roberts customers by using the Idaho Falls switch, while preserving the customers' existing telephone numbers. Finally, Qwest asserts that its Petition does not present an issue that requires industry review, does not present a contentious issue, and does not justify opening a docket prior to a decision.Accordingly, Qwest requests that the Commission determine without further proceeding to modify Order No. 28943 to include the Roberts and Rigby exchanges in the Idaho Falls rate center consolidated group. ORDER NO. 29525 The Commission has determined to approve the Petition of Qwest for modification of Order No. 28943 to include Rigby and Roberts exchanges in the consolidated group that is comprised of the Rexburg, Ririe, Shelley, and Idaho Falls exchanges. Idaho Code 9 61-624 provides that the Commission "may at any time, upon notice to the public utility affected, and after opportunity to be heard as provided in the case of complaints, rescind, alter or amend any order or decision made by it." Because the Commission is responding to Qwest's Petition to Modify Order No. 28943, it is not necessary to provide an additional notice and opportunity for hearing to Qwest. It has been more than two years since Order No. 28943 was issued and no EAS requests have materialized in that time to justify excluding Rigby and Roberts from the Idaho Falls rate center group. ORDER IT IS HEREBY ORDERED that Order No. 28943 issued February 1 , 2002, in Case No. USW-99-21 is modified to include the Rigby and Roberts exchanges in the Idaho Falls rate center group. As modified by this Order, the Idaho Falls rate center group is comprised of the Rexburg, Ririe, Shelley, Rigby, Roberts and Idaho Falls wire centers. THIS IS A FINAL ORDER. Any person interested in this Order (or in issues finally decided by this Order) or in interlocutory Orders previously issued in this Case No. QWE- T -04- 11 may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this Case No. QWE- T -04-11.Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration.
