ALPHONSUS REGIONALMEDICAL CENTER. CASE NO. QWE-03- ORDER NO. 29279 On June 18, 2003, Qwest Corporation filed a Petition for a waiver regarding the denial of an Application Qwest previously filed with the Administrator of the North American Numbering Plan, Neustar. In its earlier Application to Neustar, Qwest requested that Neustar assign it a new central office telephone prefix (NXX -) to meet the growing requirements of St. Alphonsus Regional Medical Center located in Boise. Qwest filed its Application with Neustar because it does not have an entire discrete prefix available in the Boise rate center to meet St. Alphonsus request. As outlined in greater detail below, we grant Qwest's Petition. THE PETITION In conjunction with a major construction project, St. Alphonsus requested that Qwest provide it with a new number prefix to accommodate additional direct inward dialing (DID) telephone numbers.! The new construction project will double the square footage as contained in the present main hospital. In addition, surrounding physician offices and clinics also use DID numbers tied into St. Alphonsus' telephone system. Because Qwest did not have an entire NXX prefix available in Boise, it filed an Application with Neustar to obtain a new prefix. In its Application to Neustar, Qwest was required to submit a "months-to-exhaust" (MTE) worksheet which indicates when Qwest would deplete or exhaust its numbering resources in the Boise rate center. Qwest calculated that its existing prefixes would be exhausted (i., run out of telephone numbers) in approximately 59 months. On June 12, 2003 , Neustar denied Qwest's Application. Under the Federal 1 DID is a feature of a PBX or Centrex telephone system that allows a caller to directly dial an internal telephone number. ORDER NO. 29279 Communication Commission Number Optimization Order 2 Neustar cannot assign a new prefix unless the applicant demonstrates that its existing numbering inventory will exhaust within six months ofthe Application. Consequently, Neustar denied Qwest's Application. Under the Number Optimization Order and Neustar s central office code assignment guidelines, the respective state regulatory commission has the authority to review Neustar decisions to deny a request for a numbering resource. Petition at 2. Consequently, Qwest filed its Petition with this Commission. In addition to not being able to meet the numbering request of St. Alphonsus, Qwest indicates that the lack of a numbering prefix hinders its ability to provide DID service. DISCUSSION After considering Qwest's Petition and reviewing Neustar s initial decision, the Commission finds that Qwest's Petition should be granted. The requested NXX is necessary for Qwest to meet St. Alphonsus' service request and will be used to fulfill reasonably expected and identified customer requirements. On at least one prior occasion, the Commission has granted a similar Qwest Petition for Rick's College (now known as Brigham Young University-Idaho). See Order No. 28769. We further find the available numbers remaining in the 367 prefix are not sufficient to meet St. Alphonsus needs once it begins the new construction. Therefore, we find that it is reasonable to direct that Neustar provide for a new NXX prefix as requested by Qwest to meet the customer requirements of St. Alphonsus RMC. ORDER IT IS HEREBY ORDERED that Qwest Corporation s Petition to be assigned a new NXXs prefix for St. Alphonsus RMC is approved. IT IS FURTHER ORDERED that Neustar assign an NXX prefix to Qwest in the Boise rate center to meet the customer requirements of St. Alphonsus RMC. THIS IS A FINAL ORDER. Any person interested in this Order (or in issues finally decided by this Order) may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code ~ 61-626.
