On September 6, 2002, a motion was filed by CenturyTel of Idaho, CenturyTel of the Gem State (collectively “CenturyTel”), and Potlatch Telephone Company requesting a Commission Order allowing those parties to withdraw from this case. The companies are three of several parties participating as complainants against Qwest Corporation, Inc. The motion was filed pursuant to Commission Rule of Procedure 45 which requires a party to move in writing or at hearing to withdraw from a proceeding. IDAPA 31.01.01.045.
CenturyTel and Potlatch assert that their arguments and positions in the case “are essentially identical to those of the remaining complainants and intervenor in this case,” and that therefore it “should be sufficient for parties representative of others in similar situations to participate and have this case adjudicated.” None of the other parties in the case filed an objection to the Motion for Withdrawal filed by CenturyTel and Potlatch.
The Commission finds that the withdrawal from this case by CenturyTel of Idaho, CenturyTel of the Gem State and Potlatch Telephone Company will not adversely affect the presentation of the issues to the Commission. The Commission accordingly will grant the Motion of Withdrawal filed by these parties.
O R D E R
IT IS HEREBY ORDERED that the motion filed by CenturyTel of Idaho, CenturyTel of the Gem State and Potlatch Telephone Company to withdraw as parties from this case is granted.
