HomeMy WebLinkAbout28798.docBEFORE THE IDAHO PUBLIC UTILITIES COMMISSION in the matter of THE TARIFF ADVICE SUBMITTED BY QwEST CORPORATION TO REVISE ITS PERCENTAGE OF INTRASTATE USAGE (PIU) REPORTING PROCEDURES FOR ACCESS SERVICES IN ITS NORTHERN IDAHO SERVICE AREA. ) ) ) ) ) ) ) CASE NO. QWE-T-01-16 ORDER NO. 28798 On May 30, 2001, Qwest Corporation filed Tariff Advice No. 01-03-N to revise the procedures for reporting the “percentage of interstate usage” (PIU) in its northern Idaho service territory. The Company requested an effective date of July 1, 2001. On June 29, 2001, the Commission issued Order No. 28768 suspending the tariff advice and requesting written comments under Modified Procedure, IDAPA 31.01.01.202. On July 20, 2001, Qwest and the Commission Staff filed a Joint Motion requesting that the Commission allow the tariff advice to go into effect on the proposed effective date of July 1, 2001, subject to the Commission’s receipt of public comments. Based on our review of the tariff advice and the Joint Motion, we shall allow Tariff Advice No. 01-03-N to become effective as of July 1, 2001, conditioned upon our further review. THE TARIFF ADVICE In this tariff advice, the Company proposed to replace quarterly PIU reporting requirements with voluntary reporting. The tariff advice also proposed to change the basis for jurisdictional rating of Feature Group D terminating minutes of use from one based upon originating PIU calculated by Qwest or reported by the customer, to a jurisdictional determination based upon the call-record detail, when it is available, or the carrier-reported PIU when the call-record detail is not available. In Order No. 28768, the Commission suspended the tariff advice for a period of 60 days from July 1, 2001, so that the Staff and other interested parties could comment on the tariff advice. The Commission’s Order invited written comment concerning the tariff advice to be filed no later than August 2, 2001. THE JOINT MOTION On July 20, 2001, Qwest and the Staff filed a Joint Motion requesting that the Commission allow the tariff advice to become effective, pending completion of the Staff’s continuing review and the receipt of any public comments. In their Motion, the parties stated that Qwest is seeking simultaneous implementation of the PIU change across its 14-state service territory and the interstate jurisdiction. Qwest maintained that the tariff advice change has not been controversial and has been approved in every other jurisdiction. Given Qwest’s assertions, the parties requested that the Commission allow the tariff advice to go into effect conditioned upon the Commission’s subsequent authority to amend or reject the tariff advice. The Joint Motion states that should “the Commission ultimately decide that the tariff advice should be rejected, Qwest will make the necessary changes to return to operation under the tariff that is now in effect.” Motion at 2. DISCUSSION Although Staff initially urged us to suspend this matter, the Staff and Qwest in their Joint Motion now request that the Commission allow Tariff Advice No. 01-03-N to go into effect pending further review. Based upon our review and the assertions contained in the Joint Motion, we believe that it is reasonable to grant the request. The Commission shall allow Tariff Advice No. 01-03-N to go into effect conditioned upon our authority to subsequently amend or reject the tariff advice following the submission of any written comments submitted pursuant to our Notice of Modified Procedure. O R D E R IT IS HEREBY ORDERED that the Joint Motion of Qwest and the Staff is granted. Tariff Advice No. 01-03-N shall be effective as of July 1, 2001, conditioned upon our subsequent review.
